    Hi ,
    The 26QB form requires the following two values to input:
    1. Total Value of Consideration (Property Value)
    2. Amount paid/credited currently (B)
    and if i understand correctly, the first value should include tax/GST paid while the second shouldn't.
    Example: Property purchase @ 1cr with 10 installments of 10 lakhs each.
    1. Total Value of Consideration (Property Value) = 1 cr + 5% GST = 1,05,00,000
    2. Amount paid/credited currently (B) (aka Installment) = 10 lakhs.
    3. TDS @1% = 10,000
    Can you please clarify if this is correct ?

    1 form for seller one Sale consideration 1 crore likhenge aur tax 50000
    Or
    Sale consideration ko hi 50 lakh ker denge aur tax 50000 hoga

    Good, but time to deposit tds is 30 days from the end of the month in which deduction is made not from date of deduction.

    While filling form 26QB, there is a field 'Total stamp duty value of the property (C),. What is the meaning of this term and from where to get this amount.

      Total stamp duty will be paid on the circle/market value of the property and 1% will be deducted based on the market value. You can take help from lawyer to know the circle rate of the property that you would want to buy/sell.

    After he received the advance we made sale agreement, seller applied for Low TDS certificate submitting this sale agreement, and he got the certificate.
    Now, my question is what's the TDS % on the advance which is paid before the Certificate issued?

    My issue is I paid TDS on 11/1/2021
    Against the amount payment in Mar/2020 property is under construction
    Amount paid is grace period given by ministry of finance of India during COVID period
    & Builder was not able to claim above amount. account department is telling me to repay the TDS amount 28000
    When I have already paid total amount

    Basic price 47,00,000
    Gst 7,50,000
    Edc 4,00,000
    IDC 50,000
    Sold the property after 2yrs before registry/posession
    At above complete amount
    59,00,000
    Will edc idc gst will be added in total sale consideration for tds deduction in this case

      @@rishabhgusai96 yes i got my answer. In this case u need to file only one TDS form in the name of only one owner (principal) i.e who is paying the full consideration & select more than one transferee. Or you can file 2 tds form if any partial amount is paid by co owner but in both the form need to select more than one transferee. Hope it will be help u. Thanks & Regards

      Both need to deposit tds in equal share from their own accounts. So, two 26QB will have to filled by wife and husband (assuming the property is purchased by a married couple) respectively. TDS will be 37500 each for total tds amount of 75000 and a sale consideration of 75 Lakhs. Hope this helps.

    Thanks for informative and helpful video. If A and B ( Husband & Wife ) purchased a residential builder flat of 75 lacs in joint name and entire amount 75 lacs paid by wife. Who will deposit TDS . whether entire TDS anount of 75000 to be deposited by wife or it is partly by wife Rs. 35000 and partly by Husband Rs. 35000. Grateful for your valuable advise .

      Both need to deposit tds in equal share from their own accounts. So, two 26QB will have to filled by wife and husband respectively. TDS will be 37500 each for total tds amount of 75000. Hope this helps.

      What should be the Property Value in both the 26QB forms ? Will it be the total Property value or split into half? Also if the property value is being split into half in each Form 26QB it may bring the property value to less than 50 Lacs (which is the threshold for applying the 1% TDS)

      @@neerajsinha I feel these youtube videos of CAs are just scam and all leading to extract money in the name of consultation...as instead of making it simple they complicate or unanswered or give clarity on real issues and just say what they want to say.... off course we need to understand here they are here to make money too:)!
      If you fill the 26QB forms directly from the IT portal by using your pan user id and password and if we mention total value consideration below 50L (split for joint buyers) it gives error message that 26QB is not required as value is less then 50L... so ideally in the total value & Stamp duty of property we have to mention (irrespective of no of buyers) the total value consideration paid by all buyers ... however while filling the payment portion tab there split as per share and TDS of 1% per payment share needs to be mentioned. so ideally in form 16B and 26AS only your payment portion and equivalent of 1% TDS will be reflected... of course all buyers total payment when added will become the total value consideration (stamp duty valuation)

    Hi Bro, If seller is NRI as well as non resident , then do buyer ( resident of India ) needs to apply for the TAN number , when the price of the immovable property ( ex flat ) is of 70 lacks ?
    Also note NRI wants to submit the LDC ( Lower Deduction Certificate ) to the buyer for lower TDS/TCS deduction.

      Each buyer will have file 2 form 26QB... For example... Consider a sale consideration of 60 lakhs... You the joint buyers have 50% partnership... Then for each buyer the sale consideration will be 30 lakhs respectively.
      Now if the sellers are having equal partnership then each buyer will have to fill 2 form 26QB of 15000 for each seller.
      Hope this helps.

    Hello Dev,
    Please suggest on a query..
    If there are two 2 join buyers(father - co applicant and son - applicant) and one seller.
    Father has paid half the property price to seller(1st installment) and 2nd installment(remaining 50% when the property is fully constructed for builder buyer agreement) will be paid by son after 4 year.
    Then does father needs to file 26QB on the amount he has paid now and then does son has file 26QB to pay after 4years when he pays the remaining amount or do they have file 2 26QB with dividing the 50% presently paid amount for each of them.
    Please shed some light with your suggestion on filling 26QB?

    My agreement value is 44 lakhs. Flat is underconstruction & stamp duty registration charges 294000 & gst is 222000, Development charges is 2,60,000. Should gst & stamp duty included to calculate total sale consideration. My builder demanded 1% on all above transactions. is it legal or if gst/stamp duty tax is not incluuded then my sale value goes below 50 lakhs & no tds applicable.

    Hello Dev, one question how TDS is applied in case of 2 joint seller(father and son) and if father is in Indian resident and son has moved abroad for work on work visa and has pan card in India.
    Father has General Power of Attorney on behalf of son. All transactions will happen to father account who are Indian resident. Property sale agreement value is less than 50 Lacs in Maharashtra Pune.
    And no amount being paid to his son all amount will be transferred to his father living in India.
    So in this case what will be TDS applicability?

      if amount is less than 50 lac then TDS is not applicable. but father have to show sales amount in the ITR.
