  • My first update in over 7 months on the Gun Ban in Canada series. The CCFR had it's first day in court on an interlocutory injunction request to stay the Order In Council and subsequent FRT "bans". This is my initial summary of what I heard in during the 8 hours of arguments today.

    I like how the Government and RCMP can admit in court that the FRT isn't law, yet still arrest and charge me based on that same FRT information.

      they do that because they know it's not law and the pressure people to cave because it's hard to fight them financially in court. So they take these small "wins" to make a case on precedent to scare others into conformity. The more we fight back and win the better it will be in the future. Ontario is one of the only Provinces that allows you to have a restricted firearm without a range membership (which isn't necessary in the Firearms Act). It's because people would challenge the CFO and over time the courts ruled people could have them for many reasons, such as going to a range with a friend as a guest. The firearms act also awknowleges a firearm for self defence, however we see the financial hardships that happen when someone is forced to defence themselves or their home with a firearm. We need more fights and more wins in court so the prosecutors back off in the future. The process is the punishment, they want us to think we have no right to self defense, WE DO!

    The big problem is that if all guns have to be registered, then when "they" finally decide to round them all up, they know exactly where they are. Greetings from Australia. Defend them with your lives!

      @Peter Lorimer All those mass killings were set up to get the guns. Less crime and safer women if we all had guns. I used to be a champion and world representative for Australia, pistol, no guns now, but the kids we had shooting junior were the finest kids you'd ever meet. No guns now, but I wish.

      @@davidgiles5030 We are now almost 2 generations away from our guns. I don't have any, but if I did, and the revolution arrived, I would defend my guns with my guns and die rather than hand them over.

      Do all firearms in Australia have to be registered? Only restricted firearms in Canada need to be registered like handguns and AR15 etc . We do need a licence to own them though.

      @Peter Lorimer The majority are actually indifferent to the whole issue. Even some gun owners seemed to be completly unaware of the impending gun ban until it happened. Also, there's very little protest except from gun owners. There really isn't much support for more gun control either, mostly just from groups like Poly Se Souvient and they are also quite small. I feel that more people should care about property rights, especially since banning particular types of guns that aren't even used in crime is unlikely to enhance public safety in any way. Mostly it's just politicians pretending to be busy in order to pander to their base.

    Don't forget the rcmp argued specifically that the ar was NOT an assault weapon in order to procure them for their use...so they can't have it both ways.

      Exactly, when used by police they're "Patrol Carbines", but in the hands of civilians they're "assault styled weapons". The double-speak is quite telling

      @@FreeWhiteNorth the problem for me is using a health crisis to overhaul gun laws without consultation, and without public input from the citizens it is affecting. It had nothing to do with the pandemic, and if the cops in nova Scotia proved anything, its that the rcmp don't do their jobs and follow up on complaints that could have stopped a spree killer. So despite the failure in the system having been the lack of follow up by the rcmp, we're going after legal gun owners.
      Next time there's a car accident be sure to sue your province for issuing other drivers a license. If they ban drivers, they'll get rid of the leading cause of death - car accidents. It just doesn't logically make sense

      The very definition of a Weapon
      Is an object used to harm or threaten harm to another citizen
      Citizens in Canada cannot possess a "weapon"
      I think what you want to say is "firearm"...or "rifle"...or "pistol"....or even (ack!) "gun"
      In Canada we shoot things...not people
      Big difference

      I believe that is the basis of this lawsuit
      The OIC was intended to prohibit "new or unusual" devices (bump stocks?)
      But is specifically prevented (in black ink) from prohibiting a firearm for (words to the effect) which there is a legitimate hunting or sporting use
      So...do people use AR's to protect livestock?
      Got a neighbour who does
      Do people shoot competitions with AR's?
      Yup
      So...invalid process....go find another way

I wasn't talking about propaganda I was asking a question that relates to a very real firearms ban which was instated in a way that, in my opinion, violates a great many ethics. We are not a monarchy and we should not have laws like this, that effect so many people, put in place by one man without a proper debate and due process. In addition if I hear an attempted comeback regarding "How bad firearms are" I would like to hear it from some one who has actually been trained AND has used one. Thank you.

      no we shouldnt the US are idiots and it shows in all the related gun deaths each day. No other country in the wworld has daily deaths like the US. there is no reason to have an assalt rifle or hand gun. I have 8 guns all for hunting I have no issues. You can live in AR if you want and carrye your gun. For no reason unless u are hanging out in places you shouldnt be. The Cons took away the registration which is really stupid since it was already paid for and made sense. the criminal arguement is just plain stupid as there will always be criminals and people who dont followthe laws of the country.

      All of this coming from a gun owner..?
      You completely ignore the economic and mental health issues people face there along with general health and addiction issues. If you didn't know before, maybe you'll know now: violence involving firearms isn't caused by the mere existence of those firearms. For you to blame the actions of violent individuals (a small minority) on guns says you have no clue of the root causes of violence and murder.
      Then you try to justify registration of long guns when long guns are statistically not even relevant in violent crimes in Canada. The crime statistics are there if you care to look. But you buy into that because the mainstream media and anti-gun government say so. A heavily armed government, I might add.
      You mention the costs of registration when in reality, the cost overruns were in the billions of dollars when it was projected to cost 2 million. on top of that, it was proven that long gun registration had no tangible impact on violent crime and murder. And you support that..? Or the fact that registration leads to confiscation, which this OIC has proven once again. What you don't understand is that the government and others do NOT want ANY CANADIANS to own ANY GUNS.
      If your opinion is to support registration, that is fine, but when it's not based on facts, that is not fine.
      Because violent criminals and murderers obey gun control laws, correct..?

      @@robm9581 The Liberal registration never prevented a crime, remember only legal firearms were registered, not the ones the gangbangers in Toronto, Montreal, Halifax, Calgary, Vancouver were using. So, it was a waste of money and effort by the Liberals, but then again, it wasn't their money, it was ours, including yours. Why not just flush a handful of cash down the crapper, it would prevent as many gun crimes as the Liberal registry did.

      over 60% of Canadians voted so far left that you should be surprised you can own anything at this point other than knowing that manipulative behavior like what they're doing takes generations. The legal argument of guaranteeing that the government won't "phase out" a lifestyle contrary to a political agenda is what needs to be brought up because they do have a long game that the legal system potentially can stop now. They just have to make the right requests and base it on relevant information.

    the only way it goes the way of gun owners is if the judge determines that the ban is violating our right to be assumed innocent until proven guilty of an actual crime as individuals not as a group. Then it becomes a charter violation.

    one of the things that is missing in all of this is that the people who make some of these ridiculous desidions for very poor reasons always remain in the shadows.. it would be far better if all partisapants who craft these things were identified..it is our right as voters to know who they are and they should be held responsible and have to face not just the people but be held legally responsibe if they use false or incorrect information to forward an agenda that in essence should be decided by the citizens of this country..for far to long the govt has used its power to limit or remove rights and freedoms that are garenteed to us since the bill of rights was put into play... decisions as to what Canadians want there society to be rest not in the hands of nameless , faceless robots who think they know whats best when clearly the mechanism to decide this is vis public vote that will tell those people what we want our society to look like and the laws and regulations governing those regulations.... far to long Canadians have struggled day today to extract themselves from the mire of redtape that has been allowed to creep into law due to wanting to live without fear of govt intervention at the govt whim.. time to stop the erosion of rights and freedoms and expose the faces and info about these people so we the people can hold them to the light of day and make them responsible to the citizens and be punished for any wrong doing..imho

      They don't care if they use wrong descriptions or wrong classifications because it's all a tactic to get the non gun owners or the fudds on their side. Most people get their gun knowledge from movies so if the government reinforces their beliefs they will have no problem backing them to get rid of Scarry guns. Like the Nazis used to say.       That's exactly it, and the government kept making the argument yesterday in the hearings that the court cannot overturn legislation (or at least it hadn't been done before). It's not legislation if it hadn't been legislated in Parliament... so yeah, that argument doesn't hold any water.

    I think it’s worth noting that the government of Canada’s main source of information on weapons in Canada is action movies. Making ‘vague’ laws regarding firearms because they don’t want manufacturers to build firearms that slip through ‘loopholes’ is exactly what you think; wanting something that looks frightening is crimethink now. They don’t need to describe it, you know it when you see it.

      That fact was clearly demonstrated when they banned the HK G11 by name, despite if never going in go commercial production. The ONLY reasonable explanation is that they watched Demolition Man...

      It's quite stupid, they don't know the first thing about firearms, and they rely on "experts", like Mr. Murray Smith, who doesn't even know that an AR-15 has a buffer inside the buffer tube. No joke, it's part of his affidavit and cross-examination

    Since the beginning I've always said that education is key to this whole thing. People should have a basic understanding of something before they make a call on it. The government makes firearm enthusiast jump through hoops which keeps it safe. I think this whole thing is just a big waste of money and time on the government part. Take that money and deal with the real problem of cross border firearms making there way over from the US. Typical of big government says we are going to take this many off the streets without actually taking them off the streets they want to walk through your front door and help themselves..... Not cool not rite and a very cheap shot to law abiding Canadians.

    The US is about to go through this too unfortunately. All it does is hurt law abiding citizens and give more opportunities to criminals. I hope this doesn't go through and that Canadian citizens keep the right to defend themselves.

    I listened to the hearing as well. The Judge seemed to undetstand that adding firearms to the ban throught FRT was RCMP making laws without legislation. Glimmer of hope. I got the impression that government lawyers were gonna offer a crap ton of money to Wyatt and John to just disappear. I don't think either of them can be bought to easily. I would imagine they are both in some financial strain, however.

    I feel this sounds promising for all Canadian gun owners, even as a beginning. The government has literally lied about numerous relevant points in banning guns. It's a matter of presenting facts in a (hopefully) impartial setting where facts aren't just ignored.. I mean we all knew their talking points on the definition of "variant" was and is absolute nonsense.
    In regards to AR-15's and AR-10's, the crimes involving AR's are basically non-existent, correct..? The ones we see being confiscated were from organized criminals and gangsters.
    I feel that if the facts, along with crime stats come out, that the OIC can and will be overturned, setting that precedent needed to stop the Prime Minister and RCMP from doing that again.
    I also feel that the mass shooting in Nova Scotia can have a huge impact on helping Canadians since that was used to justify the ban. We know the RCMP dropped the ball there as well, to say politely..
    I'll definitely donate to the CCFR when I can.

      Not only did the rcmp drop the ball in regards to the nova scota shooting. They allowed it to happen by ingoning all the warnings they got about the shooter beforehand. Two people told RCMP they show and believed the shooter had illegal firearms. The shooter had a pervious firearm ban and a history of violence and domestic abuse. There was Clearly enough warning to take action like a court order to search for firearms. Or put a uncover unit on the guy for surveillance. Then it took the RCMP 12 hours to stop the shooter. Im not trusting my safety to such incompetence. I rather trust myself and my firearm.

      On top of that, they allowed one of their own to be killed not to mention every other victim that day.
      Then the mainstream media paints the killings as purely a mass shooting when in reality, he killed about half the people by arson..

    Thanks for update! Also gotta mention when they said something like “oh why can’t you just use another gun to go hunting or sporting with” it would have been the perfect chance to say that what does it matter. It’s all the same! A lot of rifles are all chambered to 5 rounds and semi automatic. How is it any different if the looks are? and to finally shut down the whole assault style weapon term.. you can’t have more than 5 rounds in a magazine for a rifle in Canada, all rifles are either semi automatic or bolt action. Most importantly, assault style weapons like fully auto, high magazine capacity, and select fire guns have been ban for many years already.

Even during the first couple days that they banned the ar15, a liberal on the news was arguing with a legal gun owner and every points made by the gun owner made soo much sense that the liberal either stayed quiet or not respond to her points.

Cause right now a lot of the guns in the prohibited list is just as effective if not even less tactical than a lot of guns in the non restricted category.

    The problem for them is they want guns banned period. Canada as a whole is largely wilderness, to ban firearms based on what happens in cities is ridiculous... Banning them regardless is ridiculous... You can't stop people from committing terrible acts regardless of what you do, if anything they should be allowing people more rights to defend themselves and their property.

    Thank you for breaking this down for the average person. As someone who grew up around guns in northren ontario I can't agree with you more. Especially with my current expirence.
    I moved all over ontario and got away from shooting for a number of years. A few years ago I moved back north and started getting back into shooting again with friends. Fast forward to about a year and a half ago, I decided get my firearms licences. I took the hunter safety/pal for non restricted and about a month after took my restricted course. About a month after that I got the paperwork for my restricted license in the mail. After about 8 months and a handful of phone calls to the rcmp and ontario cfo office I finally received my paperwork for my non restricted in the mail. Everything was filled out and had pictures taken and mailed in within a 2 weeks of finally receiving the paperwork. At this point I admittedly forgot about it for awhile but after about 3 months I received a phone call from someone from the rcmp saying that there was something wrong with the payment (I checked with my credit card company and they had not tried to run a payment thru that card number but it may have been that the rcmp typed a number in wrong when trying to run it or I could have wrote a number wrong.) Anyways I digress, I gave them the number over the phone and they ran it fine. This also got me very excited thinking that I would be getting my licenses soon... well I was wrong. I waited a few more months and then started to Google to see if there was a way to check the status of my apps where I found the rcmp individual web services webpage. My online rcmp account shows they received the applications in July 2020 with the standard "we have processed your initial application and have submitted for further processing" screen. Well I would check in on that every few weeks and to my dismay the page never changed. After months of seeing the same thing I started calling in. The rcmp at that point had finished doing what they needed to do with it and had sent the app to the ontario cfo. The cfo office blamed covid and back log and said they would email the app to the people that process it. The problem is that I was told the same thing every 2 weeks from then until now. About 3 weeks ago I finally got an update on my online login saying that it was accepted and is being mailed out but to call if I don't receive it within 2 weeks. I called after the 2 weeks and was told that covid my be slowing down things and to give it a little more time to get it in the mail.
    I personally think that the government is trying to make this process so hard for new applicants that they just give up. I will continue to call and bug them once a week until I receive my card and I would advise any new applicants to do the same. It states on the rcmp website that it should only take 45 days to complete after it is received. I also wanted point out that there are no phone numbers listed for the cfo office on our government website. I had to read through numerous blogs to find a working phone number to get in contact with someone. I am a hard working family man. I have never been in trouble with the law. I pay my taxes. There is no reason why this process has taken over a year and a half now that I can see besides to stop law abiding citizens from legally acquiring firearms.

    The govt and RCMP don’t want consistency or lawfully based interpretation.
    Anything that looks like a black rifle is a “variant” of the AR15.
    Okay.
    But then just to prove “variant” actually really does mean nothing as far as prohibition goes....
    They ban the M14 style rifles which are a variant of the still legal and non restricted semi auto M1Garand (which is also grand fathered to be legal for 6 rounds of full Mblock).
    None of it means anything except they take what they want and tell citizens to eat cake.
    It’s all BS and randomly selected opinion by the RCMP and govt.
    Will there actually be any judge(s) that wants definitions and “closure” of certainty for property owners or businesses. I doubt it.
    But but but... “public safety”
    But I support the cause of trying.

    I think what we need from the injunction is a stay of the OIC until the merit can be determined by the review process which may take longer than the amnesty term. This would rectify the situation of someone inadvertently breaching the order by the vagueness of the order and unnamed variants and the 20 mm. bore diameter clause.

      Yes, that's exactly right.
      The government kept arguing about a "public safety issue" to the court, but legal licensed firearm owners who have owned and used these firearms for decades had not committed any crimes with them, but all of a sudden it's such an urgent risk that they must be banned immediately? This was one of the arguments made to the judge yesterday, so we'll see what happens.

And as far as random numbers go, 10000 is about as round as it gets I guess. But tell me this: how many murders in all countries where 50BMG is legal have been committed with a 50BMG, ever? A hit in Canada costs about $5000 while a 50BMG costs $7000: who in their right mind is going to use a 50 when you can use a 45 or a 9mm? There's no public safety argument at all to be made here!

    Not a gun owner, but think what the government is doing is a major waste of money. Instead they should be putting that money into stopping the smuggling of guns and gang violence.
    I am surrounded by gun owners and feel very safe. All of them have had background checks and all of them are well trained in gun safety and strongly beleive in gun safety.
    They are also very nice people who are always ready to help you in need.

    Out of curiosity, in what capacity were you participating in the Zoom call you mentioned? Is there an equivalence to the public gallery during these strange Covid times, where us plebs can get abreast of the developments?

      If he was there like me then yea, its like being in the audience watching. You are under the same rules as if you where in court as well, so no recording, streaming or pictures. I was just watching as a citizen though.

      Yes, I was just watching as part of the "gallery". I have zero legal experience so I was not representing anyone LOL
      I was invited as part of my volunteer work with an advocacy group. They had capped the max audience at 800, so several groups that were the applicants had limits on who they could invite.
      I believe that the CCFR had opened it up to their paid members ($50/year) so go ahead and join, then you'll be able to get priority for future hearings.

    M14.ca must have lost 99% of his business. I have a fully kitted out M14.ca rifle that was Non-restricted now its a $4000 safe queen. I would like to sell it and buy a Ruger Precision Rifle but like you say they could ban that one tomorrow.

    I'm from the US (in a state which is one of the most restricted states on gun control) and will most likely be moving to Onatrio within the next couple years. The gun laws over there really confuse me

      The one "good" thing is that our laws are generally federal, so they don't vary much from province to province.

I honestly don't even know how we could begin to measure that "it's working", since the target of this is not to reduce crime or increase public safety as they claim. How could it be that, if they're going after the safest most law-abiding citizens, according to their own Stats-Can and RCMP data??

    If every legal gun owner donated even $10 that would be a huge legal,fund. 2starbucks drinks each. That’s it. If you haven’t donated, you really need to rethink your firearm ownership privileges.

      I’m planning on putting a call out to all of the competitive shooters in Canada that have had their matches cancelled due to this to submit their Match fees for the year to the legal fund

    Wow, I dont know much about Canada, but this is wild. Are the gun-supporting Canadians the minority, or majority?

      We're the largest sporting group (hunters and sport shooters) in the entire country, but sadly there are divisions in those groups. The hunters hate the black gun guys since "I don't have one of those, so I don't care, they'll never take my hunting rifle/shotgun" mindset. There are 2.2 million licensed gun owners in Canada, in a population of 36 million.
      Sadly, the rest of the population is either somewhat tolerant of hunting, they hate the idea of semi-auto rifles/handguns due to the negative connotations of mass shootings and gang crime.
