  • Washington State criminal defense attorney Ryan Witt covers the topic: When an individual is arrested for a second DUI, is there any way for that person stay out of jail.

The trick is to try to get around the sentencing guidelines, and resolve the case in a manner that does not require the Court to impose strict sentences. In some situations, this can be done through "Therapeutic Courts" and also through the the Legislature's Deferred Prosecution Program.
