Not true. I called the police multiple times when I was attacked by my partner even burned by him they didn't do anything they told me they couldn't see my injury we were outside at night and they didn't even use a flashlight to look. But then when I defend myself finally I am taken to jail. And I am a female so don't think it's because I'm a male and they did something sexist.

My breath test was 2 hours after my accident and the road side test, which was an hour after the accident, was 3 points lower. So the math and science show that my level was in fact lower at the time I was driving. Pointing that out isn't an excuse, it's fact. So far what I've learned, is no one cares about facts or the truth. Money and punishment is all they care about.

As an attorney why aren’t you concerned about the prosecution making this the new norm? It certainly is to me. For a number of reasons. Just because it’s legal doesn’t make it right. What’s going on here in Washington is the prosecutors office is literally waiting till last minute then filing charges on a person. Why are you they waiting till the very last moment to charge people? Is there any reason why especially if this has been happening for as long as you mention, why aren’t you asking them what is going on? You mentioned Covid & Potentially staffing issues, if I had to take a guess it whatever they might say is an excuse and complete rubbish it’s simply a way to avoid adherence to the constitutional right to a speedy trail. every single person in Washington state should be terrified. I DUI for instance simple gross misdemeanor state waits on average over the last 2yrs 18mos to file charges. How is this protecting the public? How many people showed up to the last arraignment you went to? How many bench warrants were issued? Ask yourselves what kind of strain this puts on the cops and jails. Do we want our tax money going to fund this? Is this the best use of law enforcement resources?

Basically, keep your mouth shut. Dress nice. Let your lawyer do the talking.

Was charged with an Assault 2 DW, (no injuries), prosecutor came down to Assault 3 (without DW enhancement) and offered 3 months custody, low end of the range with the offender score of (1). My question is, how likely is a judge to accept this offer? Edit: the police report makes it difficult to understand who the aggressor was in this situation

So, the obvious question is what to do if your vehicle, when made, never had a third taillight, but you were pulled over because the cop did;'t see one. Do you point it out on the roadside, or wait for court? Or Both. If a lack of twilight was the reason for the stop and you didn't have to have one, is the stop itself invalidated once this is pointed out to the cop? Lots of classic cars and trucks, pre-date the 3rd taillight law.

Are you talking about a refusal on the road side, or a refusal to take the better, more accurate BAC at the station house? It seems like you should be able to say no to all roadside tests, while saying yes you will take the more accurate test at the station.

You should talk more about when the statute of limitations runs or tolls and when it doesn't. For example: If a person steals some money from their employer but the theft is not discovered by the business for three years, in most states those years don't count toward the statute. It is only when the crime is discovered or known, that the statute begins to run. And, in sex crimes, particularly against children, many states have a whole other set of rules. You might also talk about WHY society has statute of limitations to begin with. Shouldn't a person who committed a crime be punished no matter how long it had been? In Ohio, in general, it is (a) For a felony, six years;. (b) For a misdemeanor other than a minor misdemeanor, two years;. (c) For a minor misdemeanor, six months. BUT, there are a whole slew of exceptions for homicide, sex offenses, and other select crimes.

I received a DUI in 2013 in Illinois when I was 22 years old. I had previously had two underage drinking tickets as well and I was honest with my evaluator getting the median amount of hours needed for classes. I completed my community service but due to how messy my life was at the time I was unable to complete the classes I continued going to court over this for years and in 2018 ended up moving to another state resulting in my court supervision being revoked and being charged with the DUI and license revoked. 11 years later I'm trying to resolve this case and have a new evaluation coming up via tele-heath going thru an approved Illinois treatment center online. I lost my mother in 2014 to a drunk driver and have not had a drink since then. I'm nervous for the upcoming evaluation and worried i might say the wrong thing. Any advice?
