Warsaw police raided the Polish presidential palace and arrested two members of parliament from the opposition party. Poland's government has been slammed for sending troops into the presidential palace. It is seen a another escalation of the fight between Prime Minister Donald Tusk and President Andrzej Duda. Duda was appointed by the previous government who are now in the opposition. Will Poland's dual power centres keep clashing in the days to come? Palki Sharma brings you the full story.

A month ago, parliamentary elections were held in Poland, in which a coalition of parties advocating for the improvement of democratic standards and the restoration of the allegedly endangered rule of law came to power. However, within a few weeks, not only were there attacks on democratic state institutions, and many basic principles of the Polish Constitution were violated, but there was also a radical threat to freedom of speech. The first political prisoners have emerged. Institutional and increasingly physical violence is replacing the debate. Politicians, the judiciary, and even private businesses are being intimidated.
After years of communism, Poland struggled to rebuild its democratic institutions, casting off the yoke of the totalitarian past imposed by Moscow's occupiers. Despite significant economic progress, changes in some areas were slow and not without serious mistakes, especially in the judiciary. To this day, individuals responsible for the repression during the martial law of the communist regime still sit in the courts, despite their advanced age.
Criticism of the ongoing changes united parties that recently assumed power in Poland. However, instead of improving democratic standards, we are witnessing an attack on democratic state institutions and a dangerous threat to freedom of speech.
The new government's first decision was the forcible takeover of public media. According to Polish law, these media outlets should be managed by government-independent institutions, with specified terms outlined by Polish law. However, individuals appointed by the government disrupted the signal of the main news television channel, and, with the help of hired private security personnel, forcibly removed the legal boards of the media outlets. They were not allowed to return to work even after court decisions declared the government's actions illegal.
Hundreds of journalists are unable to work, and dozens have already been dismissed. The ruling coalition's camp also organizes attacks on private media critical of its actions, using familiar mechanisms of defamation and intimidation seen in authoritarian regimes.
At the beginning of the year, the police stormed the presidential palace, arresting two members of the parliament without the knowledge and consent of the president, who were persecuted for fighting corruption. Both parliamentarians have undertaken a hunger strike, and their lives are in danger.
These arrests would not have been possible without the government rejecting the decision of the Polish Constitutional Court, which had previously deemed the actions against the members of the parliament illegal. A similar decision was made by the chamber of the Supreme Court designated for this purpose by law, and both parliamentarians were pardoned by the president.
Unfortunately, the will of neither of these key institutions for Polish democracy has been respected. The Speaker of the Sejm, representing the government majority, ordered the trial to be held in an unauthorized chamber of the Supreme Court, the only chamber still occupied by individuals responsible for the repression during the martial law of 1981.
A significant number of prosecutors and judges refuse to succumb to pressure from the new government, leading to further unlawful acts. The leadership of the prosecutor's office was completely unlawfully stripped of power, contrary to the law. The Minister of Justice is attempting to obstruct the actions of independent prosecutors seeking to investigate allegations against the new government.
There are serious signs of intimidation of private businesses as well, especially those that could be associated with initiatives unfavourable to the government. The independence of the Central Bank is under threat, and decisions of the Polish Constitutional Court are completely ignored.
For many people in Poland and around the world, it is shocking that politicians who came to power with slogans of improving Polish democracy and restoring the rule of law are implementing standards reminiscent of those seen today in Belarus or Russia.
Poland is heading in a dangerous direction, jeopardizing the most basic civil rights, and undermining democratic institutions. Such actions cannot be accepted in the name of any political plan. These actions must be met with the opposition of the international public opinion.

Polish supreme Court didn't invalidate presidential pardon. It is still in effect.
President Duda could pardon only guilty convicted criminals. They were not guilty yet, when Duda pardoned them. Why would you pardon someone innocent? Kamiński and Wasik have fabricated fake evidence against Lepper. No one is questioning it. Also, when arrested they were not MPs any longer.

Kudos for Palki Sharma for covering this story. I have really grown to respect First Post for it's impartial coverage of the War in Gaza and this story has convinced me that Sharma is an excellent reporter and I wish there were reporters in my country like her, if there were my country would NOT be in the mess it is today. I've seen a lot of critical comments and all I can say is if your one of those who just trust the system and never question elections or the motives of politicians or Prime Ministers and Presidents than you obviously have the wrong channel and you belong on CNN or the BBC where you can get a slanted state crafted narrative and a set of talking points you can repeat at nosism. Critical people who think for themselves appreciate stories like this but sadly some people don't know how to think for themselves and are incapable of doing their own research. These are the sorts of people who just vote for one party their entire life and never question their own world view or whether the people who rule over them are good or bad, corrupt or have an agenda. If more people just questioned everything and did their own research and not just wear red or blue the world would have fewer despots and corrupt politicians in the world and less war and better economies around the world. Actually first court decision said only that he has such right to give presidential pardon and again noting about when he can do it especially not in advance the verdict. And second said that he can't do it before in advance. And third - not by court but Constitutional Tribunal - five days before arrest (done by tribunal members assigned by this president) that stated that actually the presidential pardon law is actually an abolishion law (not named once in constitution like that) which gives him right to gave 007 level of immunity for any future crimes ;) - this ruling is not suspicious at all ;) . - this was nowhere stated in the Constitution and was last ditch effort to save president and those two. BTW there is nothing preventing Duda (except his pride) to issue presidential pardon to the second high court sentence and those two will walk away form prison. The will not be MPs but will be free. Also Duda has issued a presidential pardon a few days back (while this hot stuff is happening) for some celebrity/politician/tv person for a fine ~3k euro - (and this person earns 100k a year). Now people are joking that they will start sending parking tickets to Duda to get them canceled. :D

He was President of the EU, I've never liked the idea of super national governments that make decisions for countries and aren't accountable to the people in those countries and now he's the head of state after apparently losing the election. Parliamentary systems are very sketchy and they allow super unpopular people to stay in power with less than 30 percent of the vote simply by forming broad coalitions. That's how many heads of state in Europe stay in power despite becoming more and more unpopular. They just make backroom deals with other political parties and stay in power despite almost everyone hating them.

But what if the Court is corrupt and decided it wanted the EU to take over Poland and get rid of anyone critical of the EU? In Brazil their Supreme court overturned a serious charge of corruption by a former Prime Minister who wanted to run for President and then turned around and banned his opponent from running in the next election. Maybe that was right or maybe that was political and corrupt. In Israel there's a huge fight between the PM and the Supreme Court. Netanyahu wants to limit their power what if they went one step further and took over the court and then the court said he could stay in power indefinitely? In most countries the top branch of the Judiciary has enormous power and people depend on those judges to make decisions that are free from bias or outside influences because their rulings can effect the entire nation they represent. But Judges are people and some people are bad or corrupt or both and want to use their power in ways that go against democracy and justice.

The resolution is not a source of law, but a political will. Tusk et consortes has been accusing the current opposition of lacking the rule of law for 8 years, and today he does it only ten times more often, and he has only been in power for one month. The media is covering for Tusk, and thanks to the attack on State Television, everyone speaks with one voice. Dictatorship, censorship, lies, confabulations about cuts in the defense budget, failure to keep election promises, e.g. voluntary insurance of ZUS contributions or the tax-free amount of PLN 60,000 are beginning in Poland. PLN etc. It's a shame to even mention it.
