    To the person in the live chat stating that Game Freak get to be lazy, after nine whole generations of Pokémon games, no. No, they do not. If they set a standard, said standard should be maintained and the product should be improved to be the best thing it can be. Not blindly, stupidly lean on brand recognition, fan loyalty and the lack of competition. The formula of the games has hardly changed and the games themselves have only become worse, especially since Pokémon made its way from the Nintendo 3DS to the Switch. They are literally at a point where they could shove actual fecal matter in a Switch game case, slap "Pokémon" on the cover and sell it. And the saddest part is that fans will actually, unironically buy it and praise it like it's the second coming of Christ.
    For all intents and purposes, as highly unlikely as it may be, I hope Nintendo loses the case here. Lest this sets a very dangerous precedent for game development overall...

      As a pokemon fan from between the red and blue days to the black and white 2 days, I have to agree with you.
      The rate Nintendo pumps out a new Pokemon game every year is insufferable (which is why I haven't even bought a 3ds nor a switch. The last modern Nintendo console I have is a Wii for reference.
      Pumping out actual bug ridden, same slop all the time is ridiculous and then to charge a $80 price tag on them is absolutely insane.
      Within the past 2-3 years TPC has released slop after slop after slop. There is only so much slop someone is willing to take before they throw it back at the person, even more so when the slop is degrading in both quality and love put into it.
      The only legitimate Pokemon game that had lots of love put into it was Omega Ruby/Alpha Sapphire and Legends: Arceus. A remake of a game and a off mainline game that everybody absolutely loved and adored.

      @@firekirby7979 Not to mention that Nintendo, TPC and Game Freak now charge more for less content and then have the audacity to release DLC for the games when they're either very non-functional or just in a mediocre state. And on top of that, charge extra for NSO and Pokémon Home...
      I personally played the games up until Ultra Sun/Moon, which... while I enjoyed UM, I'd say it's where the cracks really begin to form as it's hardly any different from Moon. And yes, games like Emerald or Platinum don't differ too much from Ruby/Sapphire or Diamond/Pearl, but the differences actually improve the experience and they're noticeable enough. They're not perfect, but yeah.
      I debated a lot about whether or not to buy a Switch, with Pokémon being the main reason for it. But with everything that's been happening, my mind is more than made up. I have no interest in giving my money to Nintendo, be it for the console, these games or their subpar subscription service that all it does is paywall the online functionality of their games with barely any benefits (yes I know about the NES, SNES, N64, GBA and Genesis retro collections but those mean nothing if there's a chance the Switch's servers will be shutdown, down the road because then those games will all be gone). I barely have any interest in emulating Sword/Shield or Scarlet/Violet. Legends is a maybe. Beyond that, I'd rather support more projects like Palworld. And I hope more projects like these can become reality and thrive.

      I agree I have played the games pokemon and palworld alike. Honestly I enjoy palworld as it is something that captured my interest and does update and fix its bugs. I thought that the migration to the switch would let them give pokemon a more realistic look. Yes the terrain looks that way but they load too much map and its a glitchy mess no matter what game it is. They have not properly tested their games and it is showing that they do not seem to properly care for their trademark pokemon. Palworld is something that is a surprisingly fun game. At the current point remakes make me upset as they dont hold all the content that was in the original game without DLC which now needs to be paid for. It feels like the once kind ninteno has been corrupted by greed and charges double and keeps raising the price for something I would only honestly pay 10 bucks for at this point. The best games they had made lately were the legends arceus games. I will only get the new legends game and then stop from nintendo. If this game is not up to par with how the games were in the past. I wish they would take time to learn the software they make before sending out a pokemon game. Even if they have to make a easy enough side game to fill the pokemon void. Like what they did with Conquest or even with mystery dungeon. I liked the darker themes of the older games and the difficulty that they had. Now it just feels way to easy. The only games that gave me challenge over the past few years were the ultra sun and moon and legends arceus. Though it was always only one fight in them that was hard to finish. If pokemon was confident about their brand they would welcome the competition to keep them on their toes to help improve themselves. Instead of thinking of lining their pockets like that. This lawsuit is stupid and will ruin the monster taming genere for people in the future.

    I think it's important to note that the Pokemon patents were filed *FOUR MONTHS AFTER* Palworld's release. Nintendo knew they probably couldn't sue for character design so they created something they could sue them [Pocketpair] for.

      Approved not filed.
      June or July (I forget) 2021 first ever trailer Palworld.
      They filed on December 22 2021, so it's even worse

      @@a-e1x There's no suing over trailer unless there was case for design of pals. If they filed that patent before they released a public version of the game, then this lawsuit can be fair game depending on how exactly these patents work.

    Japanese individuals supporting Nintendo should realize how shameful it is of the pokemon company and Nintendo to be outperformed by a "copycat". Nintendo and the Pokemon company have had years to improve their quality but instead sat on their laurels which by this point smell like rotten eggs oozing disgusting juice staining their thrones with a acrid odor. Makes one retch with how disgusting it is to resort to lawfare over stepping up their game.

    If Nintendo wins, it's really going to set a scary precedent. I mean, what's keeping them from going after something like WuWa even, we can kinda capture monsters in a cylindrical object & summon them in that game too.

      WuWa isn't in that ballpark. Yes, you're right, we do capture stuff. But it's not the main main point. I put main twice because it's necessary to build the characters but the characters themselves are more important.

      ​@@bkelso61that's not relevant. If a game mechanic is succesfully pateneted, it cannot be used in any form, even if it isn't the focus of a game, it is still taking another's intellectual property. It's like saying 'yeah that restourant stole bread, but they're not the main dish!'

For decades, no game could have an arrow over the character's head, pointing to an objective because Sega patented that specific mechanic. This would effectively let Nintendo monopolize an entire genre if they win.

      1. You need to have an capture object
      2. You need to have a character as target
      3. You need to throw that capture object at that target
      4. The Capture object has to hit target
      5. Has to do a judgement whether or not capturing is successful
      6. Successful capture makes you the owner of it
      What is TRULY scummy is patenting a display of chance to capture something.

    Public disclosure: If the mechanic is publicly disclosed before filing a patent application, it may render the invention unpatentable. Conducting a thorough search of previous public disclosures, including foreign patents and printed publications, is crucial.
    Competitor adoption: If competitors adopt the mechanic before you file for a patent, you may miss the opportunity to patent it.
    Palworld could gather counter evidence to these situations that could leave the patents Nintendo filed and got approved to render them null and void cause let's be honest here there are countless games out there that adopted these mechanics prior to Nintendo filing them. And yes that can target the parent patent that was made in 2021.
    P.s Satoshi Tajiri creator of pocket monster a.k.a Pokémon later on himself admitted that the concept of catching/releasing a creature by throwing an object/capsule/sphere comes from a series he enjoyed in his youth (ultraseven) a UltraMan series which used capsules to capture kaiju's and release said kaiju from said capsule to fight for Ultraseven. So even the idea was not a Pokémon original.

      This is assuming that there are no internal communications by the Palworld Devs where they explicitly say they are intentionally using Pokemon elements changed just enough to not be in legal troubles.
      Which you'd think is something no sapient being would be stupid enough to do, but the reason YuZu speed ran their settlement with Nintendo was because they had internal communications discussing how their new emulator versions, that were behind a paywall, were made with the explicit intention to play Zelda TotK which was unreleased at the time but had been leaked.
      Not the most likely thing to happen, but it would be funny if Palworld had dug their own grave and people are wrongfully assuming it's a baseless lawsuit.

      As a long time Nintendo and Pokemon fan, even I agree with you! There are WAY better JRPGs out there and I'll list some of my favorite ones:
      Skies of Arcadia
      Final Fantasy 1-6
      Paper Mario
      Paper Mario The Thousand Year Door
      Mario and Luigi RPG series
      Octopath Traveler
      Bravely Default
      Digimon World Dawn/Dusk
      and that's to name a few!!

      The battling system itself is unmatched but yes the stories are always very straightforward and bland. I do believe with longer dev cycles they con create much better games. Legends arceus was very fun imo and a step closer to what I wanted.

    So after checking out legal mindset view of this case, I am all for removing patents, the point about Pokemon patents that were filed/approved in this year that appears in other comments, it seems that is a divisive patent, used as a litigious strategy, because basically is a child patent of their main patent, however, it takes the same "release/approve" date of the parent patent.
    So you could say this is the main reason that they took their time to sue Pocket Pair, because they were waiting for patent approval, making all this case seems very "personal".
    Again after hearing this... I am all for removing patents from the world, because the main reason for patent was to "incentive innovation", by protecting the inventor in the first years, but in practice, is always used to stop innovation.

    The Pokemon formula is a very popular one, and Nintendo just wants to monopolise it, they dont want competition because competition necessitates competitive quality and innovation, but Nintendo is lazy and their idea of innovation for a while now has been a series of increasingly nonsensical gimmicks

    So if you see anyone supporting Nintendo, try your best to make them understand how terrifying a precedent could be set. There’s tons of other monster taker games to play as well on all the consoles. There’s no excuse to support them.

      It's not nearly as bad as it sounds. Their patent is VERY specific about details of their mechanic they patented. You can either just not throw the object but still capture creatures and it's fair game. Or make the chance 100% or 0% every time. The reason why Palword is in trouble is because they blatantly copied 1:1 this game mechanic.

    Instead of suing pocket pair, the Pokémon company should be working with them to make an amazing different type of Pokémon game similar to power because that would give a lot of older audiences a game to enjoy or at least working with them to innovate on the Pokémon series because it is been the same game it has been since I was like five years old and I’m almost 30. I don’t think the games are solid, but there are issues with all of them and the fact that it is basically been the exact same formula consistently for over that amount of time with very little changes that stick around is just frustrating.
    Don’t get attached to any new mechanics we come up with because they’ll be gone in the next generation. Every single cool idea or mechanic lasts for like one generation and then it’s gone, and some of them never come back it makes Pokémon become more of a gimmick than anything else.
    And the excuse they had were oh it’s too much work for us to get done bitch you have billions of dollars higher or more employees or make more time for the games or something because if you wanted them to be better, you have the fucking resources to do it

    For all i know, Nintendo didn't sue Digimon or Yokai Watch, I think Palword walked too close to the sun and triggered this massive heat wave.
    I mean come on look at the design of certain monsters, don't act it's not similar. Even if they are not sueing them for this,
    It's pretty arrogant from pocketpair, the world is not made of Black and White, This case is pretty gray.
    I can see the good and bad from BOTH side. ( By the way a lot of japanese are also on Nintendo side, it's more divided than you think)

      Pocket pairs lawyers already went through pokemons lawyers long ago to make sure the designs were not copyright infringing. The precedent that would be set from Nintendo winning is the equivalent of only 1 resturant being allowed to use tomatoes.

    It took so long because they didnt think palworld was a threat but got the patents just in case. Palworld got popular, got rich, and completely humiliated them. Nintendo doesnt want competition. Its gross.

      It's opposite... They waited for them to collect money. so they could get something out of it.... There are lots of small Pokemon clones out there but Nintendo doesn't sue them cause there is no benefit...

    Pokémon would trigger a lawsuit, stretch it out until Palworld runs out of money, settle for chump change knowing Palworld is dead. BEFORE hiring a larger staff to make a quality Pokémon game is a weird flex IMO.

    it will be the most kramatic justice for Nintendo to loose this law suite, lose the very patent they once held, just like DC did to Nintendo when they tried to copy-strike Nintendo's donkey kong with king kong only for DC to loose that completely and now its available to the public

    I have pretty bad misophonia and the way that guy overpronounces the P in "PocketPal" and "Patent" was driving me crazy(Nothing against him)

    I'm really surprised that Nintendo is suing PocketPal. This is the same company, who in the 90's used to strong arm retail stores to only sale their consoles & not Sega's with threats of removing their product from said retailers.

    A smart business move would be for Nintendo would be to go "Oh, you do our thing but better? Well, join us." And we've seen that so many times over the years across various things. It's so irksome to me that Nintendo are just that dumb, that petty, and that lazy to have not done that already. With any of the things they've stamped out.

      I honestly think that may be their projected long game. Bleed Pocketpair out and then buy the studio when they are at rock bottom. And then bam, 100+ "new" Pokemon, region, and even gym leaders for a low cost, modeled with animations, and minimal effort. Just gotta kid it up and spruce it up with reused assets.

    Same tactics like when they Sue Punicon for $30m.
    "Shironeko Project introduced what it called a “Punicon” mechanic, having players drag their finger across the screen and tapping to unleash attacks. Nintendo’s claim covers placing arbitrary coordinates on the screen and then dragging it like a joystick motion."
    Nintendo adjusted the patents to specifically target Punicon to increase their chances of winning.
    I hope Palpal able to win this but the odds is against them.

    Is Nintendo only suing now because Palworld blew the hell up using characters "like" pokemon characters and actually made them interesting enough that Nintendo could never seem to do? Or is it because they didn't think an indie game like Palworld would basically show up a giant like Nintendo using characters similar to theirs? SMH I wonder how this precedent will affect other indie games or just other gaming companies in general going forward.

      They actually are in the legal right here. They filed it before PalWorld was released, and it was approved afterward. The patent is a "child" of their former patent Nintendo had. In which the "parent" patient was done long before PalWorld was in development. It does not matter if the patent was approved after PalWorld was released.
      So yes, the Nintendo lawsuit is very much in Nintendo's favor, and it is not looking good for PocketPair.
      Also, this is 100% DONE TO FK POCKETPAIR BECAUSE NINTENDO DONT HAVE THE TALENT TO CREATE A FKING BETTER POKÉMON GAME, THE LAZY FKS. This has thoroughly pissed me off.

      Nintendo did the opposite and made the language more vague than it was, which is why, under the language of the patent, you can consider a net being thrown to catch a bug to be under the same patent.

    Supposedly nintendo has so many patents that they could sue pretty much any company whenever they feel threatened. Like 1000s of patents over the randomest things such as using shadows etc. Japanese government has to be careful not to set bad precedent

They all make up the Pokémon Company. Gamefreak makes the mainline Pokemon games, Nintendo handles the publishing of the games and owns the trademark for Pokemon, and creatures ink makes the Pokemon 3d models, makes the Pokemon tcg, and makes the Pokémon detective pikachu games. But no company of the major 3 own 40 percent of shares for the pokemon franchise.

    Nintendo created "child patents" of older more vague patents which despite being very recent, retroactively take effect. One being the act of throwing an object at a target to capture it....     Personally I liked Scarlet and Violet. It had the best in my opinion story in all the other pokemon games so far which was nice to see. That is why it hurts so much to see all of this happen. A while back a friend of mine told me about palworld and even bought it for me for my steam deck. It was fun, like really fun as it felt nothing like pokemon and honestly more like ark mixed with botw. I of course have not played it much since given that I am waiting for more content before jumping back in and I still play pokemon a lot too. Basically both are great games but are completely different to the point that pokemon is not even going to struggle due to it. Let palworld do its own thing and you do yours Nintendo, if anything the people will overall see you in a better light and not discount Disney.

    It's so dumb because those mechanics were in pocketpairs first game craftopia which released in 2020. They announced palworld in 2021 the same year nintendo patented pocketpairs mechanic and now might be using that mechanic against them.
    This is bad for all gamers. I'm a fan of both palworld and pokemon but nintendo and pokemon want to make it so the only way you can play a game like pokemon is by buying their crap.
    Palworld isn't even the same genre you can play without ever catching a pal without crafting a sphere

    the nemesis system in shadow of war was so fucking awesome! i had an orc i killed come back to fight me three times. one time i cut off his arm and stabbed him so he came back with a fake arm, another time i cut off a leg and stabbed him, he came back with a fake leg, the third time i put my sword through his FUCKING HEAD! he came back with a metal plate covering his skull and couldn't talk anymore, only scream!!!!! i finally beat him and decapitated him and that was the end of his story. but the nemesis system was so damn good and the powers in that game, you really ended up feeling like a god towards end game but could still get clapped if you weren't careful. the enemy could even adapt to your moves if you used them too often and then you would have to find another way to kill them!

    Pokemon is obviously the basic jrpg style.
    You recruit soldiers, pokeball is sort of bribe to try make them join you, instead of dying.
    Computer is barracks where your soldiers hang when not in use.
    You use your soldiers to fight other commanders in typical turn based gameplay.
    And eventually fight the bbeg
    And so on.
    Tho difference in Pokemon is that the gathering of soldiers is more highlighted mechanic.

      Palworld copied 1:1 nintendo's most iconic game mechanic, that is quite specific by the way. This Nintendo's new patent does not prevent anybody from making a monster capturing game. What it stops is blatant 1:1 copies. Easiest way to dodge that patent is just to not throw an object. You can still have a pokeball but not throw it and it's safe. The patent is very specific, else it wouldn't have been approved at all. Hate nintendo and their lack of creativity, but people are blowing this beyond reasonable proportions or just not understand what's going on.

    Seriously, how can people defend Palworld dev's action?
    They could have made Palworld without purposely using Pokemon's art direction. But they chose to.
    When a Vtuber rip off Shylily's model design, she got called out and shun'ed by the community. When Palworld rip off Pokemon's art design everything is fine now? What is this double standard?
    Don't bring out the BS reason like "Oh, they are both based off sheep so of course they are going to look similar"
    With that logic, I can make a Sonic + Knuckle fusion with Tails' tail added on, icing on the cake, I will draw it in the same style as Sonic and call it my OC. Since my OC is based on hedgehog so of course hes gonna look similar to Sonic.
    I am a character designer, and I can tell you art style and design idea are like signature of the artist. You won't stumble upon the same style unless you deliberately try to copy it. Much like forging a signature, you won't get the person's signature unless you go out of your way to copy everything down to the weight of the stoke to angle of the letter's curve.
    Seriously people, you can like the game they made, but you cannot support their action.

      At least PocketPair have said that every Pal design has been approved by Pokemon. And this is probably done on purpose to ensure that the creature designs are legally in calm waters. And this is also why this lawsuit is not about copyrights and creature designs, but this lawsuit is about patent infringement related to mechanics and gameplay. But since Nintendo owns several hundred patents for many video game mechanics, it is not known exactly which patents are involved.

      No. I went to check both the short version of the patent specific to capturing and the way Wuthering waves does it is not the same. Nintendo specified that the "capture object" has to be thrown at a "character" and then do success/failure roll. If any of those are missing then it's not covered by the patent. Nintendo's Patent is too specific, otherwise it wouldn't have been approved in the first place.

      @@spugelo359 It is never specific enough. A good enough group of lawyers can go after any number of games where catching something is a part of the gameplay. Take pretty much any fishing game or game that has a fishing mini-game in it.
      The fishing rod or net can be the "capture object" and the fish, whether visible or not visible (because the patent is NOT specific on the visibility of the character trying to be captured), are the "character(s)". As for the success/failure roll, a good enough group of lawyers could argue that even games that require only player input (and no chance rolls) to catch the fish are still bound by various other in-game events or game code that the player cannot control. After all, legally, what actually constitutes a "success/failure roll" in a video game? An example could be the fish's random swimming pattern or how the fish reacts to bait or lures at the end of the fishing line, etc. It could be any line of code that randomizes any number of actions the fish takes in different situations in the game.
      Again, patents are specific, but they are still rarely specific enough to deter a very determined corporation with access to the best lawyers money could buy from abusing it. Nintendo probably would never go after fishing games, or any other games that feature capturing, but don't dare say they couldn't try.
