@magicaljill, all that Pocketpair would have to do is to use Data East USA, Inc. v. Epyx, Inc. and Capcom U.S.A. Inc. v. Data East Corp. as legal precedents against Nintendo and those two cases by themselves would decimate Nintendo, not just in the USA, but also worldwide. However, as for the argument that Pocketpair could use, then I would go for the following things.
      1. Pocketpair needs to use Data East USA, Inc. v. Epyx, Inc. and Capcom U.S.A. Inc. v. Data East Corp. as the framework for the main lawsuit against Nintendo, and, by extension, Game Freak, Inc..
      2. Pocketpair needs to change the argument in those cases from martial arts to martial arts, real life creatures, Japanese, and other, forms of cultural folklore that are not subject to copyright laws anywhere worldwide.
      3. Pocketpair needs to get other competing companies that made franchises like Digimon, Medabots, Yo-Kai Watch, Monster Rancher, Jade Cocoon, Cassette Beasts, etc., as their allies/fellow defendants/witnesses in its case.
      4. Pocketpair also needs to use those other companies to make other additional charges against Nintendo in the lawsuit if Nintendo, as well as Game Freak, Inc., both get too uppity against Pocketpair and its allies, namely things like violating the Sherman Antitrust Act, as well as the RICO Act, and other similar legislation, not just in the USA, but also worldwide, including in Japan.
      5. Pocketpair, as well as its potential allies, also need to make sure that the wheels are not greased by either themselves, or by Nintendo, Game Freak, Inc., or any of their allies, thus making the judges, attorneys/lawyers/barristers, judges, other legal officials, and juries be unable to be corrupted, biased, and/or otherwise bought out by scumbags.
      6. Finally, to ensure complete compliance to Nintendo, than they just need to bring out all of the people that Nintendo ironically plagiarized back in the 1980s when it was first getting into the video game industry, such as Deep Purple, Ryo Sayazaki, Piper, etc., and have them testify against such things, thus making Nintendo even deeper into the hole than they were before the first opening minutes of the trial.
Were Pocketpair, and its potential allies, to keep on this path, then they all could win the entire pot, but at the cost of potentially leading to a series of events, both related to, as well as apart from, this case that could destroy the video game industry worldwide. Finally, any competent judge and jury would toss Nintendo and Game Freak, Inc. out on their a
      s
      s
      e
s and not award them a single penny. Meanwhile, Pocketpair, as well as its allies, would ALSO have the added benefit or not having themselves end up like the other sides of the cases, who also got thrown out on their a
      s
      s
      e
      s
, and also not paid a single penny, as they would be arguing not what Data East and Epyx did in their lawsuits, but, rather, what the judges handed down as the verdicts from those lawsuits, as well as their opinions, and reasons, for said judgements in those previous legal cases. Pocketpair simply needs to make this case go like this, and Nintendo and Game Freak., Inc. will learn a harsh lesson, for it was at this point in the second case that the quality of Capcom started to take a notable nosedive, and, no, it was not due to the leap to 3D, but, rather, it was due to their actions, and Data East wisely learned to mind their own business until Capcom forced them to this same point a dozen years later. Granted, Data East became more successful up until around 1990 or so after the first place, but the point is that it also did not engage in petty lawsuits, as it truly regretted what had happened with Epyx, who was never the same afterwards.

Also palworld was ment to be released in 2021 when they have video's and game play of it but they postponed the release till 2024 to use unreal engine to improve the gaming graphics and other stuff which again proves that pokemon didn't have any way to prove that they took their own ideas and patent right because pocket pair had theirs out first before pokemon could do anything.

I've read from Japanese responses and comments that Nintendo is allowed to make these patents on video game mechanics and gameplays because the company is highly respected and honored among them. And in Japan, Nintendo is also considered merciful and good when it willingly allows other game studios and developers around the world to use their intellectual property freely as long as they don't compete, step on Nintendo's toes, be disrespectful or try to sue first. And this is a lot about how society, culture, social hierarchy and atmosphere in Japan has become the way it is today.
But in any case, I agree the current globalizing patent system is cery flawed and broken and needs a fix if not a complete overhaul it to patch the loopholes in order to bring it into the modern world. And this should involve all the countries of the world so that the new system can be better and more functionally universalized.

    • @andyowski5021
      @andyowski5021 4 дня назад +22

That's a shame if they are allowed to capitalize on loopholes in the Japanese legal system just because of the business they bring to the country. It shouldn't be surprising though since that's the casing pretty much every country if your business is big enough.

      @imatiu 3 дня назад +7

That is not how it works.
Craftopia having the mechanic doesn't matter because they are not suing over Craftopia. Also having the mechanic in other games doesn't matter because the way patents are implemented in Japanese law.
Legally speaking Palworld is probably going to lose and lose hard at that, at least according to some Japanese lawyers.

    • @myria2834
      @myria2834 3 дня назад +12

@imatiu even in Japan, you can't get a valid patent for something that was already made publicly available anywhere in the world before you filed. Every nation includes this novelty clause to avoid a situation where a product already on the market is retroactively sued for infringement despite being the first.
Patents protect inventors. You can't claim to be the inventor of anything that is already public knowledge, just because the actual inventor wasn't greedy enough to file.
Most Japanese gaming patents are invalid and unenforceable. Companies only file them to avoid wasting money fighting nuisance patent lawsuits from individuals maliciously filing patents in the hopes that the victim company will decide that settling out of court will be cheaper than fighting it. (Which it almost always is.)

Get Palworld. I played arceus and honestly palword's open world is better. Sure you might need to craft items to mount flying/water mounts for some stuff but that's not needed plus you're not forced to stay in one area for 5 hours because the story doesn't allow you to go there or "YoU'rE rAnK iS tOo lOw tO pRoGrEsS!". But you might get reality checked by a boss pal or a random level 40 pal because you accidentally angered it. Plus shinies (Or lucky pals) have actual use in palworld. Sure they are just bigger and make noise unlike normal pals (These are not alphas, alphas are basically boss battles!) but they give you a unique trait which you can pass through breeding called "Lucky" which gives +15% Work Speed and +15% Attack for the pal that has it. And you can breed any species together, that includes legendaries, you just need a male and female pal + some cake and wait until you get an egg. There's also a breeding calculator so you can check which pals come from which parent combinations so you can look and breed for the pal that you want, even you can get one of the better Pals to work for your base, Anubis which is normally a level 40 boss iirc.

      Two thoughts:
1 - If Palworld applied for their patent first _then_ Nintendo applied for the same kind of thing later, Palworld may have a good argument that Nintendo can't "own" it.
2 - Regardless, the Poke Ball is still a recognizable, signature element of Pokemon as a whole, and which predates the one patent suspected so far (about throwing Poke Balls Legends Arceus style).
But, given how even Pocketpair hasn't been informed of all the specific details yet, us armchair commenters are in even less position to make anything but snap impressions at this time. Pokemon _did not_ "invent" the genre of creature-collecting / monster-taming, and they _should not_ be allowed to selectively enforce exclusivity over something as broad as "player throwing a projectile to interact with a non-player entity", but Palworld's (also Craftopia's) method of capturing creatures _does_ appear to be derivative of Poke Balls specifically, which casts at least an appearance of potential IP infringement.

That is pretty much the only thing I could see them successfully pulling off but the lawsuit is occurring in Japan so I'm not sure how it's going to turn out. I don't think Nintendo is targeting other monster gamers in general but I think palworld may have made them angry. With some of the tweets I've seen from pocketpair I wouldn't be surprised if they did something to piss Nintendo off. It would be funny if it was because pocketpair refused to put palworld on switch but I think it was because they have what is basically similar creatures to pokemon and it's popular. It's not even completely original, and it's obvious it's just different enough to be legally distinct.

I don't see how this is anything but taking advantage of the law. In the east, they think of intellectual property in a completely different way than we do in the west. That's mostly because, when westerners demanded legal protections for their processes, people in Japan thought they were nuts. The idea simply didn't exist over there and they didn't have any frame of reference for it. What they came up with, was this idea that intellectual property is like a child. And it is the creator of that intellectual property's duty as the "parent" to see that that idea grows the right way. What's happened since then, has been more like a divorce where one parent tries to take the kid from the other to spite them.

Am sorry but it isn't a Time thing with Gamefreak anymore, they haven't even figured out 3D game development on a console fully and it shows in their games. Can they make something fun and enjoyable yes, will it be new and innovative, possibly, will it look great? No. Ever since Gamefreak hit the Switch their games have had a lack in quality that isn't just a product of time constraints, if anything it's become harder for them to hide just how much they were winging it with their game designs on the Gameboy and DS. Hackers have picked apart thei games and have seen how out dated their development techniques are and how wasteful they are with Memory. Gens 1-5 had one man on the team that actually knew his shit and knew how to compress files, he was the sole reason gen 2 had two regions. After gen 5 he left and eventually passed away. My hot take is Gamefreak needs to clean house and hire people that know what they're doing and stop being stubborn about doing it the way they've always done things. Gen 9 was enjoyable but it had a vast amount of room for much needed improvement and not just the bugs. People will say graphics don't matter, but the reality is they do to some degree and for those that say they don't, you've just admitted you'd play the game whether it looked like garbage or mind blowingly amazing. Ultimately Gamefreak is being kept alive today because of their fluke with pokemon, without Pokemon they'd have faded away in this industry a long time ago. And now they're hiding behind Nintendo who is just as guilty of not enforcing quality control on Gamefreak, because it's making their system look bad.

The number of people who stop buying Nintendo IPs won't even *register* with Nintendo. As far as they're concerned, this has ONLY upsides, and the only way we can convince them otherwise is not to buy their games. .... which we won't do.

Scarlet/Violet are abysmally designed in optimization, this team has struggled with this yet were unable to get a time extension. Normally teams would get help or get a time extension (Tears of the Kingdom) which implies Nintendo or The Pokemon Company are responsible for rushing and declining quality while refusing to offer funding.
GameFreak would likely face repercussions for this and Nintendo would hire or replace them with better Devs, which in turn means the now jobless ex-employees would have incentive to speak out against Nintendo.
Imagine this: "If I was respectful and kept working I'd get fired, if I tried to save the series from this and show children and customers respect I'd get fired." If this kind of thing came to light it could destroy Nintendo's reputation with its own people.

A trademark isn't a patent. If you don't defend your trademark then you will lose it.
For instance, the name Pokemon is a trademark. That's why Pokemon Uranium (and other fan games) are cracked down on so hard, because if Nintendo and the Pokemon Company don't defend that trademark, then everyone will be able to call their game "Pokemon".
A patent on the other hand doesn't have to be defended. You can allow others to use it, or turn a blind eye, or come after people who use it... all at your discretion. For as long as you hold the patent, it's yours.
And to answer your question... no. Game mechanics absolutely should not be able to be patented.

Digimon has absolutely nothing to do with pokémon.
Compare Digimon World from the PS1 vs Pokémon Red&Blue, night & day difference.

Along with how different the franchises are, you have to also remember Nintendo and Bandai have a very close working relationship. There's no point in burning bridges. Palworld is off on its own island though with no relationship with Nintendo.

Because Nintendo also got hit with Patentwhoring by some companies over the Wii series and the Switch. So it's pretty bass ackwards for Nintendo to then do the same to others, especially when they're making patents AFTER THE FACT and trying to retroactively sue Palworld.

This boils down to Nintendos greed they care about money and that's it they aren't sueing for copyright infringement they are sueing because they are mad about the success the game had early on and decided that they would just be Nintendo and do Nintendo things like try to ruin anyone who creates something even slightly something they created they claim to be a family friendly company but we all know how cruel they are to anyone who crosses them no matter how minor they will sue you for so much money that you and your family will be in debt to Nintendo for generations your great great great grandkids will still be paying Nintendo and their great grandkids will still be paying Nintendo while Nintendo just sits back laughing they are almost mr krabs level of greedy

The same Nintendo that sold defective Joy-Sticks right? no be real talk let's be honest the Pokémon series is in heavy decline and GameFreak is in a very scares situation. How ever tho I actually predicted this before hand honestly I'd love if PlayStation acquired a "Kirby Parody" series I can't wait for my fellow Kirby fans to scream "Then stop neglecting the series ffs"
Now I'm in full support of Palworld & PlayStation alliance if Nintendo doesn't want to except some series are meant to die off and experiment more with others then let PlayStation take all their fans also Nintendo needs to stop being afraid of firing Dev's and Directors let this be the wake up call.

I do hope Sony does back Pocket Pair in this engagement, as much as I enjoy Nintendo's game franchises, they are getting too cocky as of late with all these bans on fun from fan games just wanting to spread the joy they had for pokemon or mario and what not, to now trying to screw over palworld with a stupid lawsuit.
    Get your shit together Nintendo.

Mega Evolution = Digivolution from Digimon. It's essentially the act of evolving during battle to become stronger and then reverting after battle. Digimon has done that for years.

Id argue pokemon has been trash since gen 6. Ever since i learned that they kill fan projects i stopped sypporting nintendo. 20 years i have sailed the high seas and I'll continue to do so. My kids will be taught to hate nintendo for generations to come.

And i hope Nintendon't to go bankrupt forever

PalWorld brought a new take on the Pocket Monster genre, which I find a lot of fun as far as how I found out about this game was all the youtubers I watched. The internet is a powerful tool. When enough people showcase a game, the word gets around fast.

Not only did Nintendo not invent the ball capturing mechanism, but Nintendo can get sued for stealing designs from classic dragon quest, gen 1 pokemon designs were ripped straight from dragon quest, Nintendo didnt even try to hide it, it was a direct copy and paste.

So basically nintendo is being a giant baby just because pocketpai, a much smaller game dev studio is using the same idea of throw [catching item] at [creature] to catch [creature] and use [creature] to battle? Wow. Just wow. That's like if sega tried to sue every company that tried to rival sonic because a smaller company made a platformer where you play as a anthro animal and that game suddenly blew up. I hope that sony and microsoft help pocketpair out in this lawsuit. Make this a lesson for nintendo because they should leave something that might push them to making a higher quality pokemon games, not sue them. Sure some pals might look close to pokemon but they aren't just "oh hey lthat's that lycanroc pokemon! let me just take it with no changes and slap it into a mobile game and name it rockdog! No one will recognize it!" They have changed them. Sure the grass rabbit might look similar to cinderace but it's different enough, same with direhowl, for me it looks different enough from lycanroc, even if it's too close to the pokemon, i would argue that it's hard to make a feral wolf creature look like a fantasy creature that's not infringing (can't spell, eglish is not my first language) on pokemon's look of lycanroc and is not too close to looking like wolf/dog in our world.. And i'm on Palworld's side. Palworld is just os much fun, even if i died like 10 times to pals 20 levels higher than me and my pals

Despite me liking Pokèmon, I really hope that Pokémon lose the lawsuit or else the damage to other monster franchises like Digimon, Monster Rancher, Yu-Gi-Oh, Neopets, Yo-Kai Watch, Palworld, Bakugan, Monster Hunter, TemTem, Chaotic, or Moshi Monsters is permanent.
People needs to realize that Pokèmon doesn't own the word "monster taming genre".
Pokèmon needs to have some friendly competition.

I'm a huge pokemon fan for the record but the fact that Nintendo and the pokemon company had to go make 2 new pattens in secret this year just so the had a legual reason to sue paleworld shows the public Nintendo and the pokemon company fear the possibility and petencal of paleworld. If Nintendo win basied off of what their trying to sue for then assians creed devs could patten the opening up the map and POI by looking from a high place then use nintendo and the zelda franchise. To be frank if Nintendo win thos it give all gams devs from AAA and indy to patten ideas and concepts and game play machinics in secret so the can weaponise it agest other game devs and companys in other worlds if Nintendo win the case the have opened pandora's box and this could set the stage for gaming industry to sabotage and colapse in on Itself causing the end of gaming as a hole Nintendo and the pokemon company have used non nintdeo game machinic and ideas used from small and massive game franchises. We all know Nintendo and the Pokémon company have zero issue with trying to sabotage other by any and all means including but not limited to slander, bribery, lieing, cheating, stealing corprage sabatage and Intidiasion. Im sorry but if Nintendo wins it may be the end for the gaming industry becase all company will start making pattens in secret that can use to ruin or sabotage other gane franchises and ot will lead to a cycle of game companys trying to ruin other fracnises and eliminating the competition and by doing so limite the amount of game made and the typs of games forcing game devs to risk getting sued by other for patten infringement that the didn't know about. I hate the fact Nintendo and the pokemon company stooped to making pattens insecret and waiting till paleworld hype died down bassicly waiting till paleworld was at its most venerable showing the predatory sleezs of both Nintendo and the pokemon company. I hate hypritical bs Nintendo and the pokemon company useing ideas game machinics and otber franchises ideas to boost themselves without any backlash but the instant otber do what Nintendo and the pokemon company has been doing for years its a issue.
