    I was at a curbside parking spot on a local road in Monrovia, CA., in front a Music Academy, that is where my daughter (3yr old) goes to her vocals training. I was about to leave the parking spot, once I saw the pickup truck coming close to me in a rush, I just pushed the brakes and that is when he collided with my car by taking a right turn in front of me, so that he could enter a public parking lot on the right side of road and crushed my car. I have a video proof which is captured in another tesla car parked close.
    Myself and my daughter are in the car. We both are not injured. Of course my little kid was in a shock and she was crying out.
    Other guy in the pickup truck was with one more passenger - None were injured. In fact their car doesn't even have minor scratches.
    I tried to reach out to other person's insurance and they are denying it. Please advice me and help me out, and let me know whose mistake it is exactly, as I dint even come out of the parking spot or turned.

      I cannot say for sure, but from your description it sounds like the other driver should have yielded to you. In CA, even if you are partially at fault, you should be able to make a recovery minus the percent to which you were at fault.
      If you have already obtained the video, you could start by telling the insurance company you have the video which shows their client _____ (ie. failing to follow California rules of the road) and that you are motivated to settle this matter quickly without involving lawyers and making this case more expensive for them. You just want fair compensation that reflects the damages (property damage plus a little bit for the emotional turmoil to you and your daughter).
      If they aren't willing to play along, you can look for an attorney that takes non injury cases or request a free consultation with one in your area to get more advice on how to deal with the insurance company to get justice.

    I got in a bit at fault car accident where my car was totaled. Clear as day no defense could be made for the other side. I went to the er one time but no internal bleeding or broken bones. I have some cuts, bruises, and soreness. Have missed about a week of work. Should I just try to get paid out by his insurance solo or go to a lawyer?

      Generally speaking, if it's minor injuries, negotiate to cover your medical expenses, provable lost wages, and maybe a couple grand on top for pain and suffering, and settle it yourself. That way you don't have to pay a lawyer's fees.

      A drunk driver damaged my car as he drove on red while I was in green. Both cars are not drivable as they are totally damaged. I am ok. I have no injury thanks God.
      Can I claim for the time wasted no joining my job again.

      @@betutes-ck2up Generally speaking, you have two possible claims in a car accident: property damage and personal injury. If you're not filing a personal injury claim, you'll likely need to try to roll your wage loss claim in with your property damage claim.
      You might do well to consult a local, reputable personal injury attorney. They might be able to provide more in-detail advice than I can do without having a lot more information.
