Thank you for this invaluable info. I was injured at work and my employer and the insurance tried to close the claim immediately… until they found out I had hired a lawyer. He got the claim reopened the next day. I went 5 weeks without TTD benefits and my employer wouldn’t give me a light duty assignment. I was nearly evicted with a new baby. My lawyer had to have a judge court order my employer and their insurance to pay me, get me a new work assignment and proceed with my treatment. I was injured in May with a serious neck and spinal injury. My surgery was finally approved today. DO NOT WAIT TO HIRE A LAWYER, DO IT IMMEDIATELY. Your employer and their insurance don’t care about you, your health or your family. Their only aim is to save as much money as possible and if that means scooting your mess under the rug, so be it. They tried everything they could to make it look like I was at fault or had done something wrong, when they were totally at fault (and who’s at fault doesn’t matter with workers comp, all that matters is you were injured while on the job) But anyway, thank you. This short video will help a lot of people who face what I’ve been thru this year.

How come even though i can prove this no attorney wants to help, not even with filing my complaint. I just had my alj hearing and it went well. I haven't got a ruling yet but my attorney is very confident in my case being approved given the evidence in the case. I was told that when i was at my hearing to make sure the judge makes the connection of the medical negligence to my disabilities so that when i file a malpractice claim i have solid evidence of becoming disabled from what should've been a routine procedure. Please help😢 i have my whole case already made there just doesn't seem to be an attorney near me willing to hear me out. I would like to eventually stop having to repeat my trauma
I am sorry that you are going through this. The type of claims are difficult and many factors are involved.
@BurgerLaw I completely understand. If I knew how long it was going to take to not find a lawyer, I should've went to law school so I could represent myself. I just need representation. I would say about 90-95 % of my medical records are gathered, there's just a couple doctors giving a hard time. My case speaks for itself. Whether I find an attorney or not, I will take my case to trial, it's that strong.

Im a convicted felon because i set up a sting operation to take down a crack cocaine organization. Coos arrested me instead... Released me. I went back to get my gun, badge and property? I then was held for 6 months and would have been locked up for over a year if i hadnt plead guilty to 'criminal possession of a firearm'. I made Staff Sergeant at 26, stopped a 3 armed individual attempted robbery without firing a shot. I stopped a mass shooting in 2023 saving 73+ Americans without firing a shot while licensed for years with the police board commissioners. No red flags and nothing but extreme professionalism and love for my community. Now Im being persecuted by the government. They took away my second amendment right. "Yeah, lets take away the guys gun that has actually stopped a mass shooting and has been protecting Americans and their homes, assets and properties, commnnities. Ive had intense and intricate training through various private agencies and law enforcement. This is absolutely ridiculous and I now hate this Country, I have no faith in our government. Trump? He's a convicted felon. Im proud to be one... But its time for a fucking change. I have a felony for doing something I was more than trained and more than capable of doing. I had a meeting with the DEA the day after I got arrested to take down a man that was funneling fentanyl pills into Kansas City. A convicted felon with hundreds of illegal firearms, over 250k in cash, duffle bags of fentanyl. What did they do? Lock me up instead and take away my fucking rights. Time for a rucking revolution. Often the workers' comp insurance will cover what is needed but sometimes their doctors want to say you are fully recovered when you aren't, and other issues may apply that allow you to make an additional negligence claim for further recovery. It's very possible that you can resolve this without a lawyer, but it's a good idea to consult one anyway just in case there are other underlying legal issues. Is a compensatory claim necessary before a punitive is alleged?

I was involved in a car accident May 29th 2023, a driver ran a light and totaled my car (he was at fault) out and went to er same day and I got a lower back injury( only was 19 years old at time) I lost my job due to my lower back injury took physical therapy for about 6 months got an attorney and we recently served them a lawsuit . What should I be expecting in this case?
not that much.. tops .. 12k possibly. policy 25k. your attorney takes most. you walk away with 12k ..I've totaled many cars. it depends on their policy. car insurance policies are shit.. most polices are not that much..I mean if you were paralyzed then it might be different or if you needed surgery. but 6 months of therapy wont get you a lot. something but you wont be rich.

@@mosieliza817 if you didn't get medical treatment or have injuries, then your damages are usually minimal (and it's a good thing if you didn't have to suffer any serious permanent injuries) BUT it's always a good idea to get checked out by a doctor just in case since some injuries are not obvious right away. Look at how much work you missed or any other losses you experienced and compare it to the 1500. It may be adequate compensation in your case, I don't know. But on the other hand, since the insurance company made an offer on its own, you may have a chance to negotiate for something more - with or without an attorney. Without high damages, you may be better off handling it on your own, but I always recommend getting a free consultation with a lawyer located in the area where the incident happened. They may have some insight into what to expect and how to get the best outcome. Or they may tell you that $1500 is way too low and that it would be wise to hire a lawyer
I was at work. I was doing a pre inspection for My cdl semi truck with Amazon. Truck next to me was departing his parking spot and ran over my ankle. My attorney dropped me as a client when I went to jail in a workers comp case. But I did not receive any notice of this until after the deadline I had to hire another attorney. My case was dismissed with prejudice because of this. I have permanent hearing damage which is considered a permanent partial disability. Can I sue my attorney for malpractice?

They dont do much, only because car accidebts are so rare they never get to deal with them. Over 99% of car crashes in America are deliberately caused. Hit and run is a terrorist attack. Don't sugar oat it. The act of running away is a statement that it was done deliberately. A bank robber doesn't wait around after they rob the bank for the police to show up. Over 99% of all car crashes in America are deliberately caused. Accidents are very rare in America from government and police corruption refusing to stop terrorism against their own country. No wonder they were sitting ducks on 9/11. America loves terrorism. They protect it. Crime, Anarchy and terrorism using motor vehicles as weapons to deliberaty cause crashes to take innocent lives indescriminantly is the number one threat to America now. Speeding at Ludacris speeds, high speed suicide missions on the wrong side of the road for no reason, into red lights and stop signs like planes flying into the WTC, tailgating 3 feet behind a vehicle st 40 miles per hour to cause a crash and/ or to create a phoney excuse to terrorize an innocent mitorist because they were obeying the law, and when the victim slows down to turn off, the tailgating terrorist attacks them because the sf terrorist didn't have enough reaction time because of their own tailgating. If the crash is the result of intentionally doing something to cause a crash, it is NOT accidental. It is NOT an accident any more than 9/11 was an accident

So I got a letter from the person who hit my cars insurance stating that they accepted my demand for single person bodily injury liability the limit of 15k but my attorney called and said I have to wait now to see how much they are going to give me. Any good advice I don’t understand why can’t I just take the 15k I hope my law firm doesn’t try taking most of it !
Hmm...you'll have to talk to your attorney and ask what they mean. It is your case and ultimately YOU have the right to decide whether or not to accept an offer. Maybe check for clarification that the letter you received is indeed an offer and they are offering you the policy limit. It may get more complicated if there are other parties involved or other sources of compensation to consider. As for what your attorney will take, you should have agreed to a fee when you hired them. Usually it's a percentage of the settlement, usually somewhere between 25-40%. Sometimes they will reduce their fees at the end or there may be expenses from the case depending on the work involved (service processing, mediation, expert witnesses, etc) that can come from the settlement and if you received any care on a line basis (such as seeing a doctor), those will have to be negotiated down or paid from your settlement. Be sure you're clear on all of that and get it in writing.

Yes, you mentioned this before. Casey and the rest of the team will tell you that she was just reluctant to talk on camera. To me she appears to lean in when she's laughing and being introduced. Regardless, we have had a great working relationship for more than a decade and she is integral to our firm's operations. We couldn't do it without her! My family and I also consider her a close friend. It's hard not to after all this time together. Well first, this particular class action suit has been settled for the members of the class. There are cases against other employers for certain groups of employees like Corizon for nurses and medical staff working within the DOC. As for cooks, it depends. I'm sorry that happened to you. I don't fully understand your comment and do not have enough knowledge of your case to offer specific legal advice. If you mean that your lawyer valued your case at 30k or informed you of a $30k offer from the responsible party, your past and future demonstrable medical expenses like your surgery should be accounted for in your settlement (and 30 does sound low for injuries requiring surgery, but again, I can't advise on specifics). If this is from a car accident, the total you can recover may be limited by the other party's insurance policy limits, but if that is the case you may be able to make recoveries from other sources such as your own underinsured motorist coverage (UIM) if the limits fail to cover your damages. My car was parked at grocery store while I wasn’t there it was hit and someone took off. They have insurance but my car is cosmetically shit at this point I’m in very much distress and will be out a vehicle for the month or more it’s being fixed. Should I sue
That is frustrating. It sounds like the driver was identified if you know they have insurance, so that's a plus. Your best bet is to report the incident to your own insurance and they are sure to work hard to hold the at-fault driver's insurance company accountable (assuming you live in an at-fault state, which I'm assuming you do since you mention their insurance). You should be compensated for your property damage and you may even be able to get help with a rental car or otherwise fill in the gaps in the meantime, especially if your vehicle was damaged to the point of not functioning and requiring a month to be fixed. As a personal injury attorney, I don't typically deal with property damage-only claims. Knowing only what you have shared, trying to sue the driver personally for additional compensation is unlikely to be fruitful. But you are always free to consult some lawyers in your area or even pursue the case on your own. If you are going after a recovery for pain and suffering without physical injury, you still need to demonstrate the cost mental anguish has had on your life. In the ski resort example - what if you signed a waiver covering the hazards of mountains and skiing, but then the chairlift broke and you fell and got hurt? In other words, gross negligence in maintaining the equipment caused the injury, not the ordinary hazards of skiing. Thank you.
I was in a wreck 3 months ago.. I was out of work for a month I’m an owner operator truck driver.. my wage lost alone is over 20k plus pain and suffering but the insurance company telling me they can’t pay over 15k cause that’s all they covers minus my medical bills… is this true? And what can I do ?
That depends on your insurance policy. You may want to read over the terms of your plan first. Is this your personal liability insurance? I don't know enough about your circumstances to directly answer your questions, but there are policy limits, and if your medical bills eats up the majority of that, then it's possible that you may not be able to recover as much for your other damages from that policy. But there may be other forms of coverage that could apply as well. Seems like a situation you should run by a lawyer in a free consultation before you agree to anything from the insurance company. Hello 👋 I was involved in an accident 2 months ,(not my fault) I was taken to the hospital 🏥 was in for 7 days , I have broken neck , broken pelvis , right arm broken and got surgery ,also bruised left side lung , chest chest pain and bruised , left foot ankle muscle damaged, can’t walk long distances without getting pain and swelling, how much will my case approximately settle?? Way too many variables at play for me to give you a number, but it sounds like a high damages case. I'm so sorry you had that experience and dealing with such pain and limitations. That is so hard and I hope the best for you and your recovery. It depends on where the accident took place (what state), how much insurance the liable party (or parties) has, the amount of your damages and how effectively you can demonstrate them, whether or not you have a lawyer, whether the other party accepts liability and negotiates in good faith or not, and so on. The amount of time it takes (a few months up to a few years) depends on a lot as well. Namely, if the other side is cooperative and communicative, it could be resolved more quickly. If I were in this situation, I would start with where the accident took place. That will tell you a lot based on the laws and limits in that state. I suggest at least speaking to a couple of lawyers in your area. I may practice or know someone who practices in your area if you let me know where.

A lot of it comes down to personal preference. In-person can be a more controlled environment free from distractions and other people. It also cuts down on the potential for technical issues. But a lot of attorneys like in-person depos and mediations in order to read body language and add weight to their words. Communicating in person is just a different experience.

I was mandated to sign a non-disclosure agreement so I can’t give details but the case has been settled after 3 long years. Let’s say going forward I will do any shopping I need to do online as much as possible and forego the risk of shopping at a brick and mortar store.

What happens if you file a civil complaint against a driver who hit your car and cause damage to your vehicle but the judge found in favor of the defendant because they said the case is about the actual value of the vehicle and the judge decides in their favor because I did not accept their settlement offer

GREAT ADVICE!!! I was rear ended, and I got offered a check and a recommended shop from the other person's car insurance company. I have a friend who is a mechanic and said he could do it cheaper. Can I keep the money and pay a friend to fix my car instead of going to a recommended shop?
It depends on the arrangement. If you're handing this outside of the courts and insurance companies completely and the at-fault driver's is offering you a sum out of their own pocket, then once they hand you the check, it should be yours to do with what you wish, and their involvement ends there. You're being compensated for your property damage losses, and how you use that money is up to you. Cautionary note: I don't know the details of your collision, but before you accept or sign anything, it would be wise to get a medical evaluation even if you don't believe you have any injuries. If it was only a light tap and you feel that the amount they are offering you is fair, it is your decision to accept it, but taking the check now will prevent you from being able to recover more compensation in the future if you discover that the repairs are more extensive than originally estimated or you suffer from new physical symptoms like neck pain or a brain injury.

It depends. On things like state laws, insurance policies, and being able to show negligence. In many states, the insurance follows the vehicle, and it sounds like they are already going after your insurance carrier. IF they exhaust your insurance coverage by receiving the policy limit, there may be additional avenues of compensation available for them to pursue, such as your daughter's insurance policy as secondary coverage, the claimant's own underinsured motorist coverage if they have it, etc. If they are going to go after private individuals to collect the rest of their recovery, that also depends. Generally, the driver would be liable, and the injured party would demonstrate how the driver's negligence led to their injuries. However, they could also try to build a case against the person who lent their vehicle to the driver (if the owner should have known that the driver would likely be unsafe on the road, such as if the driver was drinking or had a history of multiple at-fault collisions). Talking to your insurance company might help too. Depending on where you are in the process, new developments can arise and the course of the case can change. And if $145k is their first demand, you and your insurance company may be able to work with them to come to a fair outcome.

The rules are a little different for government entities and vary from state to state. I don't usually practice in New York but we are happy to take your call at 314-542-2222 and answer your questions. I don't know that I will be able to give you a straightforward answer for what kind of settlement you can expect, but I can get you marching in the right direction. The settlement depends on the total medical costs and future medical treatment (such as if your doctor recommended you for an additional future surgery or ongoing physical therapy) and other damages, the insurance coverage the fire department is carrying (which should be considerably higher than a typical passenger vehicle), whether any other parties share liability, and how hard the defendants fight you. If you have an experienced attorney, you probably have a chance of receiving a great settlement but I don't know enough to give you a specific number.
