Asleep in Taco Bell drive-thru, woman gets arrested for DUI

- On December 11, 2021, at approximately 2:48 a.m., Officer Joseph Geil with the Pullman Police Department was dispatched to the Taco Bell restaurant at 425 NE Stadium Way in Pullman, Washington to reports of a female who had fallen asleep in the Taco Bell drive-thru. The woman was briefly woken up when the 911 caller had knocked on her window, but she soon went back to sleep. To mitigate against the possibility of harassment, the driver will be referred to as “the driver” or similar in the narrative that follows.
From the report of Officer Geil, lightly edited for brevity: "I arrived at Taco Bell and started walking toward the drive-thru and was pointed toward a silver 2001 Honda CRV. I approached the vehicle and observed its driver asleep in the driver's seat with the vehicle running. I knocked several times and asked the driver to roll her window down. The driver woke up and appeared confused, and then appeared to wave me off.
I knocked on the driver's window again, asking her to roll the window down. She opened the door. I observed that the vehicle was in neutral and told the driver to place the car in park. I was getting a strong odor of an alcoholic beverage coming from her. I observed the driver's eyes were red, watery, and bloodshot, and her face appeared droopy. She appeared to be having a hard time understanding my instructions. I observed an open case of beer in the back seat and an open beer can in the cup holder adjacent to her. The driver placed her hands on the steering wheel as if she was going to drive away. I reached in, placed the car in park, turned the vehicle off, and dropped the car keys by her feet. The driver's pupils appeared dilated.
I asked the driver what was going on. She said she was trying to go home. I asked her to step outside of the vehicle. She said okay and then tried to shut the door on me. She began trying to start her car without her keys, placing her hands where the keys would be and making a turning motion near the ignition, and then placed her hands on the steering wheel as if to drive away. I told her again to step outside of the vehicle, asking her several times. She said that she was ready, then grabbed her keys and appeared to try to find the key to start the vehicle with. I told the driver that she was under arrest and grabbed her wrist and her right shoulder gently encouraging her outside her vehicle. WSU Sgt. Kurht assisted me in getting her outside of the vehicle. Once the driver was outside the vehicle she became compliant. I placed the driver into handcuffs and checked for a good fit.
WSU Sgt. Kuhrt asked the driver if he could park the car, she said yes. I asked how much she had to drink. She told me "Not much, honestly". When asked why she fell asleep at the wheel at Taco Bell, she said it had been a hectic week with finals and she was tired. When asked about the beer in her cupholder she said it wasn't hers. She then said it was hers from two days ago and then told me it wasn't hers again or something to that effect. I asked the driver if she would be willing to perform some voluntary field sobriety tests to which she agreed. I took the driver out of handcuffs.
HGN: I observed lack of smooth pursuit in the driver's left and right eyes. She moved her head several times throughout the test. At times she would stop looking at my stimulus, look at me, and look back at the stimulus.
WAT: The driver had issues with balance while in the starting position, and had trouble getting into the starting position. She used her arms for balance while walking and stopped walking during the test. On her 9th step, instead of turning she began walking slowly backwards.
OLS: The driver began walking forward while counting out loud. I stopped her, gave her the instructions again. During the test, Ofc. Emerson had to remind her to lift her foot at least six inches off the ground. Several times during the test she raised her eyes from her foot and look straight ahead. She swayed while balancing.
PBT: I asked the driver if she was willing to provide a breath sample. She agreed. The driver provided a PBT of .249% at approximately 3:09 a.m.
It was my opinion that the driver was impaired. I placed her under arrest for DUI and transported her to the Pullman Police Department."

I got a DUI in 1985 and shortly after quit alcohol. I’m almost 80 now and in very good health which I believe had a lot to do with zero alcohol or cigarettes for 35 years. Add up the plusses and minuses for either and you will have a short list on one side. Me getting busted was actually a good wake up call.

Disagree on the attorney part of your statement. Nothing wrong with protecting yourself legally. I know someone who was arrested for a DUI without an attorney on hand and lost their career (went from 6 figure science-related occupation to a waiter working minimum wage) and another arrested for DUI with an attorney on hand who got their charges dropped (and learned their lesson because it was a huge hassle and involved large legal fees).
For those wondering why all the other cars stayed in line...it's almost 3am in a Taco Bell drive thru. Anyone in that line is either wasted or high as a kite! They aren't about to turn around with the cops there, they would be the next DUI...

One of my buddies that got caught with me, his parents owned quite a few cars. He had to clean every single one spick and span. One of the joys of being a parent is finding creative ways to punish your kids lol.

I use to drive for Uber and would always get questions about how much it must suck to drive drunk people, my answer was always the same I’d rather have them be in my car safe than on the road possibly killing them selfs or other people or even crashing in to me. Yes they can act obnoxious but I actually respect the fact they were smart enough to order an Uber instead of driving drunk.

if you do happen to be suspected of dui remember when you do those field sobriety tests you have an inner ear infection affecting your balancing and also have chronic nystagmus affecting your vision, and you just started a new medication for it and aren't entirely familiar with how it affects you ;) whatever you do, don't admit to consuming any kind of intoxicant. be cooperative and say as little as possible.

I saw a guy do it once but he was being all sorts of odd... he did a back flip while in cuffs to prove he could, then stayed line dancing and singing and ended it all with a nice high jump into the splits. That was quickly followed up with a bit of a scream and him being for help to get up as he just pulled his groin muscle. He was taken to the hospital and then jail.

That's one hell of an alcohol tolerance. 0.249% is insane - 0.30% or above is generally considered the range of alcohol poisoning. And she's coherent and responsive!

Either she's on stimulants or has a very high tolerance. But being 24 years old I don't see her having that kind of tolerance. I've blown a .324 and I was totally coherent and honestly didn't think I was that drunk, but that was a bit over a decade of drinking in excess daily. So it's possible, but I don't see it here. Being a college student and her mentioning finals it is most likely adderall keeping her alive.
Edit: BTW I wasn't driving, I learned that lesson when I was about her age. At the time I had to take random BAT tests at the methadone clinic I was at.

Damn this brought back memories. I got a dui when I was 21, NOT something I'm proud of. I drove from one city to another and I passed through a mandatory check stop 5 minutes from my home. I blew a .22, I had a very high tolerance at the time because I was struggling with alcoholism. I didn't even feel drunk at that amount. I've been sober for almost a year now. A sober life is a better life 💯

@@ronp9709 @ABMcC86 yes except most of the time, being probably 95%, declining to do testing is almost a guaranteed conviction in most states. I've been LEO in two states now and it was that way in both. You can't exactly "wait until you're 100% sober" to do fields. I mean, are you going to show up after bonding out the next day and be like oh yeah I'm ready for those tests now? lol. Also in a lot of cases and states, depending on circumstances, refusals can also result in search warrants for blood draws which will show your BAC. But like the OP said, best strategy is don't drink and drive lol.

That's how you handle it. Not making excuses, blaming everyone else, fighting with police, being disrespectful, etc.. She handled the situation correctly, many people do not. Own your mistakes, be respectful, obey instructions and things go much more smoothly.

I have watched a lot of these videos but NEVER have I seen someone walk backwards at the 9th step. She was rocking and couldn't get going. I'm glad her and everyone around her is safe.

The sad thing is she seems like a genuine nice girl. She just made a big mistake but seeing how this is the first time she's ever been in trouble with the law, I get the feeling this will wake her up and she will be more careful. It's a good thing she fell asleep at Taco Bell instead of on the highway. I hope she learns a lesson and never does it again.

Excellent job of Horizontal Gaze Nystagmus (HGN) by this officer, and the body cam did a great job capturing it too. If you're not familiar with HGN, nystagmus is an involuntary jerking of the eyes and is affected by alcohol impairment. Keeping the head still is mandatory since it interferes with what the officer needs to see during the test. It's also part of the instructions, and not following instructions is part of the test. (All Standardized Field Sobriety Tests (SFSTs) include elements of divided attention and the ability to listen to and follow instructions.) The officer begins by checking for resting nystagmus, which a small percentage of people have by default. He then does several passes to check each eye for smooth tracking as it follows the tip of the pen back and forth across the full range of motion. Lack of smooth pursuit is an indication of impairment. Then he checks each eye for nystagmus (jerking) at maximum deviation, all the way to the right or all the way to the left. As he's moving his finger to the right, he's looking at the left (outer) corner of her left eye. He'll hold it there for a moment to watch for nystagmus, which will be obvious due to the contrast between the eye's colored iris and the white part as it bounces back and forth at the edge (maximum deviation.) Nystagmus at maximum deviation is indicative of someone with a Blood Alcohol Content (BAC) of 0.08 or higher - the legal limit in most states. The officer then does another set of passes as he checks for the approximate angle that the nystagmus starts. Basically, if the eye start to jerk before it crosses the approximately 45-degree mark between straight ahead and maximum deviation, then it's considered a "high" level of impairment. And the sooner the onset of angle of nystagmus, the greater the degree of impairment. A competent DUI investigator can do a pretty good job guessing someone's BAC based solely on HGN and no other tests. An accomplished impaired driver can practice and fake out a sobriety test, but they can't control these involuntary eye movements. If administered properly, it's the most accurate of all the SFSTs.
