Unfortunately there’s a boat load of idiots who think you’re not allowed to defend yourself from violent criminals.
That's really going to depend on the letter of the law in this case. It appears that, while the thief did indeed initiate the attack, he eventually withdrew from the fight. Whatever the law says about self-defense in the light of withdrawal and the state of mind of the guard at the time is going to be key here. That being said, I doubt that the police press charges since the thief survived and the optics would look pretty bad if they did.
Finally, someone does something to stop shoplifting.
They'll have the guard up on 1st degree murder charges before the day is over.

The reason this is happening is because law-enforcement refuses to prosecute and lock up criminals when criminals KNOW there is basically zero chance of them going to prison they will continue to commit crime and things have escalated to deaths. Unfortunately, I think it’s a fantastic idea to have armed security - It sends a message to the criminals - they cannot continue to just steal at will . somebody eventually has to put a stop to this

Shooting are a regular occurrence in the Bay Area.The police don't respond in time so I have a licensed permit and own firearms.And I was taught at MCRD in San Diego when I joined the USMC when I was 18 years old. I wasn't taught to be a hostage or a victim.

Anytime you attempt to stop a shoplifter, your life is in danger. Deadly force should be used when needed if your life is in danger. I remember not long ago a man died when he tried to stop a shoplifter. He was pushed down and hit his head. Shoplifters don't just give up and say they are sorry. They fight as if their life is on the line. Security needs to do the same.
As someone who became disabled after a shoplifter, all I can say is good. This is not taking a loaf of bread or a gallon of milk because you haven't eaten in 4 days.

Home depot and the security guard need to be charged. I was a security guard once I got out of the air force and never once did I have to use my gun or Baton. Further this guard shot the guy after he threw away the Baton. There is no reason to shoot a shoplifter especially since the store is insured. Arrest him if you can because in the end you will pay the price and not the store as you're not insured nor indemnified
Well done, security guard did his job. Thankfully this happened in San Mateo County. If it was in Alameda County, the guard would be charged instead of the shoplifter.
Home depot would also be sued for not making it easy to steal goods, 1 million payout to the thief, who also will complain there wasn't enough quality merchandise in stock to steal so will leave a bad rating which will not be removed.

It's unfortunate that the criminal is still upright. The security guard was fighting to save his life. The way all of our Bay Area DAs operate, after the criminal survives, they will be back on the street in a month or two. That is quite unfortunate.
A new catch and release program. They catch them cut off a hand and then release. No they don't get to claim disability or any services. You made your choice. It's really hard to steal with 1 hand. If they choose to do it again you lose the other one. We can put them with other criminals, inside to take care of their needs. Just a thought.

Anyone committing any crime no matter what the severity should expect to get whatever he or she gets. Whenever I was younger and acting a fool, that's exactly what I got. My ass handed to me. It taught me a lesson. It's time for the teachings to begin again, only this time with the new students.

It's not my saying, everyone else said it first. Being soft on crime has got us all where we are today. Ruined streets and ruined lives 20 times worse than if had put an end to it before it even took hold like it has now. I truly hope you never become a victim of crime, but if you do you will then know how it feels. To teach a criminal how to behave, they need some consequences. If that means getting hurt, so be it.

People who conduct themselves in a civilized manner, should not have to be cowed by the people that have no decency or regard for others. Most armed security guards are off duty cops, retired law enforcement and/or ex military and they're more than capable of discharging a firearm appropriately. People like the man saying we need other options voted for these criminals to be released and sees the value of their life over the value of property, safety, staff and livelihood. Perfect solution to the escalating shoplifting problem. They won't be stealing anymore!
The more sensible solution is to reduce the motivations for theft, such as ensuring people have stable fulfilling lives. People with such lives simply do not commit violent crime, there is no purpose to it.

we don't talk enough about these kids upbringings, they probably didn't have a father to teach them about responsibility and how to become a productive in society.. and unfortunately some learn their first lesson either in prison or getting a shot at.
