    During an arrest, accused criminals are told if they can’t afford an attorney, one will be appointed to them. Occasionally, brazen defendants decline a public defender and choose to represent themselves in their case. The Law&Crime Network’s Jesse Weber breaks down the top five times defendants represented themselves in court during high-profile trials.

      Brooks waived his APPOINTED counsel, not his standby counsel. There are no standby counsels in Wisconsin. Judge Dorow told YOU, your WRITERS, and Darrell Brooks that he doesn't have the constitutional rights to standby counsel per Wisconsin law.

    I often hear people think that the judge in the Darrell Brooks trial was too nice to him and let him get away with a lot. It's been explained that she wanted there to be no excuse, no way that Darrell could say he was mistreated or didn't get a chance to speak or didn't get his time to explain anything. She wanted The victim's family's to never have to see his face or hear his disrespectful comments ever again. She had a really tough job and I can't imagine what was going through her head. He is one of the worst people to ever live.

    • @VioletJoy
      @VioletJoy 5 месяцев назад +14

      She could have done much better, though. She constantly lost her cool, got flustered, argued back, made threats, etc. All of that goes against the claim that she had calculated all of that.

    • @TubeSurfer10
      @TubeSurfer10 5 месяцев назад +106

      @VioletJoy I disagree that it negatively impacts the prosecution and her position, they were very careful in not crossing the line, his actions and behaviour was despicable, and when he attempted to sabotage their actions forcing them into an error I believe they were extra vigilant and were able to circumvent his tricks and takits. (Tacit). He has no chance for appeal considering she showed him more than one chance before booting him from court. He just dug a deeper hole, she just kept handing him shovels.

    • @VioletJoy
      @VioletJoy 5 месяцев назад +6

      @@TubeSurfer10 I didn't say that it negatively affected prosecution. I said that the judge was rattled the entire time. She either does not have the temperament for the job or could really use some training in how to handle narcissists. She took everything personally. I didn't see her hand him any shovels. He did that all on his own.

      Knowing that the detective investigating O'Neil's crime was the one to adopt the son is one beautiful thing in an otherwise ugly case.
      Given ONeils demeanor in court, I'm willing to bet money that Ronny was an absolute nightmare to be around. The fact that the detective not only adopted him, he gave him a whole family (the detective had 5 kids already) and they know his story and what he went through in detail, so they also know how to help him heal and move forward. That part honestly moved me to tears when I first heard it.

      Did she though? Or had she already judged him before the evidence was set and refused to let him speak. 100% I believe he was guilty and his crimes were heinous, but that does not mean that he does not get the right of trial with impartiality with innocent until proven guilty. The Judge had already decided he was guilty in this case and used every ounce of her being to talk over him when he had an argument, when he tried to talk over back she said he was disrespectful of the court or held him in contempt. Can't have it both ways when impartiality is supposed to be the backbone of justice.....unfortunately we and the judge herself do not see this case without emotion and that should be a factor for a judge.

I don't for a second believe that the prosecution was jumping to volunteer to do this. I have a feeling someone made them an offer that they literally couldn't refuse. Defendants are allowed to cross-examine and face their accusers. You cannot have a witness for the prosecution without the defense being allowed to poke holes and discredit said witness in case the witness is not a reliable witness.
      There are no exceptions so that the system is fair to every single case. But unfortunately there will be scenarios like this where the Pro Se will be in a position to intimidate a close relative witness.

    Jesse, you're incorrect about Brooks' waiver at 15:29. He waived his appointed counsel, *not* standby counsel. Standby counsel is not permitted in Wisconsin. So either you represent yourself, or appointed counsel represents you, but there is no hybrid where you represent yourself and in effect, keep appointed counsel as second chair to give you advice or complete filings or motions. Brooks was highly suspicious of the prosecution here, but there were several times where the prosecution actually did things to assist him when they had no obligation to. I think due to the overwhelming evidence against him and the number of witnesses, it was obvious what the end result of this trial would be, but it is unfortunate that Brooks' decision re-traumatized witnesses and resulted in the proceedings being dragged out with his nonsensical "sovereign citizen" defense. If this trial stands for anything, I hope it educates the public and other defendants that this is a legally meaningless assertion that will NOT help your case.

      Now, you and I both know that this means he'll be in prison until he dies, but legally there is a difference. In Illinois, Natural Life has no chance of parole.

    The Brooks trial was the most entertaining thing I’ve ever watched. I was never so invested in hours of uncut footage of a trial.

      I really, really wanted to watch the whole trial. The whole case unfolding was interesting, him representing himself, etc. I was looking forward to watching the trial....and God knows I tried LOL....But MAN! I just couldn't do it!! Brooks tried my patience!! I don't know how Judge Dorow did it!!

    12:00 it was comically exhausting. I watched this every day it was airing, but I was exhausted as soon as I tuned in every day because he was allowed to do everything he wanted, which I get why he did that because she did not want anything to come back on appeal, but it was still exhausting to constantly watch Brooks disrespect the court as m8ch as he did.

      We hire specialists to lie and deceive the court system. It is nothing more than that at its base. They know how to lie and cheat a system so we hire them. Defending yourself is the highest god-given right you are given but you will always lose because you are not deemed either qualified enough or smart enough by a corrupt system that would be embarrassed to lose.

    6:40 I watched the entire DB trial. He was speaking in court as though he was getting piece meal legal advice / jargon and using it incorrectly. He kept using these law terms, and yet made egregious mistakes. Nevermind his blatant disregard for respecting the court and the judge. I always wondered where he got his weird terminology from.
