      @TraBaum. I'm not sure, but even if they bought insurance and IF an accident occurred with the defendant driving, I don't think the insurance would pay out because defendant wasn't listed as a driver. But if the plaintiff had returned the vehicle with damages, either her own insurance or the paid for rental insurance would have paid. Although the deductible might have been as much as if just pay the repair bill.
      Don't rent vehicles for others unless they are listed as drivers.

    when renting a car, always take pictures of the condition of the car inside and out, when you rent it and when your return it! Also wouldn't hurt to note the milage also.

      I take a video of everything on the inside and outside everytime I rent a car! I'd do it before I leave the lot and before I return it, and I keep all my paperwork! Also, I grt the insurance!

    When the defendant is like "I don't see why it's my problem"....because YOU drove the car. She has no right to be frustrated when it's her fault for damage and tickets on the rental car. She had it a week and it ends up damaged in her care. How bad of a driver do you have to be to damage a car in a week that's not even yours?

    As a previous Enterprise Employee, if they did accept the insurance from Enteprise and Enterprise found out that the plaintiff had the Defendant drive the car at any time even if the accident or damages wasn't while the defandt driving and let say the plaintiff was the one that was driving.... The insurance is cancelled due to brief of contract between the plaintiff and Enterprise. Enterprise and majority rental companies require additional drivers to be added to the contract. Anyone who is not (with exception of legal spouse) will be considered not authorized and the contract and insurance is terminated.

    Doesn't matter whether she opted for the insurance or not, the insurance wouldn't insure her since she's not the renting party.
    In order for her to be covered shed have to be listed as a driver as well which would cost more.
    She knew she didn't have insurance.

      Enterprise would have no way of knowing how the car was damaged or who was driving the car when it was damaged. If the renter had collision damage then it would be covered.

      Usually the rental includes a second driver automatically nowadays. At least at Alamo which is owned by Enterprise.

    As a previous Enterprise Employee, we don't profit from the damage money. It's solely to pay to get the car fix. And I hope they put them on DNR “do not rent” list. They are a liability. 😓
    Both violated the contract the plaintiff signed.
    And the fact they dotn have the contract lmao it get sent to the email and they could have called to get it. We have it in records for 1-3 years. 😭

    Plaintiff's so pretty. JM is naive to think that companies like rental car places wouldn't make up damages to to enrich their employer. She has no idea how the employee is profiting from the scam. Also, I don't understand why the Def would be done w the friendship. It would hurt me to have to pay for damages that I know I didn't cause, but I'd pay it bc I wouldn't want my friend to eat the cost.

    No, plaintiff, it IS up to you to prove what you paid. It's foolish to rent a car for your friend. I rented a moving truck for my brother, however, he paid me cash BEFORE I signed, and I only agreed to do it if I drove it, which I did (his credit was too bad, which is why I insisted on cash up front). ALWAYS get insurance.

    Enterprise walks around the car with you to inspect it while your there for damages prior to you renting it and they makes notes about any prior damage, so basically the damage to the rental car by the defendant is definitely her fault

    idk why they didnt rent it in the defendant's name but then just use the plantiff's card? Or list the defendant as a secondary driver? Also when the booking was made if the Defendant did it, she would have been the one to check that she wants the insurance?? This case is WILD

    How people think it's okay to show up in court without evidence I'll never understand. Plus plaintiff's smart mouth -- no, it is the obligation of the PERSON WHO BROUGHT THE LAWSUIT to prove their case, not the defendant's. Further, I would NEVER do a risky financial favor like this for someone who is so dishonest as to not open a bank account to avoid paying their legal obligations. Plaintiff is plain dumb, but defendant is a user, a liar, and didn't even bother to take care of the car her friend rented for her. Plaintiff is bad, but defendant is far worse. I hope she gets what's coming to her.

    Once again, JM is WRONG. Enterprise has many FRANCHISED rental establishments, and they are NOTORIOUS for drumming up fake damage charges.
    The defendant clearly owes the plaintiff, but chances are Enterprise is not innocent.

    Enterprise associates do try to make up damages. It happened to me. When I said go through my insurance company they dropped the charges. I did the same thing. I had to be to work so I walked in to the office. there was someone ahead of me. I asked can I leave the key? The associate said yes. I left the key and then they sent me an email saying there was damages of 900 and something dollars. I said show me the damage. They sent a picture with some circle on the bumper. I said to them I need to see the car in person because there was no damage when I dropped the car off. They said their body shop place fixed it already, so there was no car for me to see. 🙄 So they were lying from the beginning. Somebody might get a commission off of charging for damages or something.

      You inspected every single inch of the vehicle prior to returning it? I don't get how that makes them liars just because they already fixed the damages so you couldn't see it in person. They do not wait for people to pay them before they fix the damages on the vehicles, there is nothing sketchy or abnormal about that. Most people do not request to see it in person and even if they do, that would add a lot of issues and delays for the company (such as having to schedule a convenient time for the customer to come in and view the vehicle, taking staff away from other duties in order to have someone show the customer the vehicle, and the inevitable nuisance of those customers who would never show up but instead only delay the shop from being able to make repairs). They definitely do not get a commission for that. People who work at Enterprise are normal every day people like you and me... they do not care enough to go and do all of that. If you know that you didn't do any damage then it's probably just a very human mistake. Like the damage was there already and was somehow missed before, therefore unfortunately placing the blame on you. Or the damage occurred during the period of time between when you dropped it off and when they inspected it. Or there even could have been a different car with this damage that was the same make/model as yours and the employee just made a mistake. Accidents happen. I worked as an insurance Adjuster and people seriously believed that I purposefully went out of my way to deny their claims, pay them less, etc lol as if I am not human. If the piece of paper (policy) signed lists the type of incident then its approved, if it says the incident isn't covered then it's denied. I can't control it and it always amazed me how many people think insurance company's are evil or malicious as if they are not just normal people working there.

They dropped off the cars did a whole walk through with the employees and days later see that enterprise charged them with NO CALLS to inform why or anything.     Always take photos and videos around any rental car at pickup and drop off. I brought a vehicle back once and a week later they tried saying I owed them money. My photos showed the damage wasn't there when i dropped it off.

    My boyfriend at the time rented a car for his cousin. A cousin he just found out was his cousin. Like a week ago. So they got the car and the cousin disappeared for 2 weeks. The boyfriend finally got in contact with his cousin and they turned in the car

    You know what, I learned the hard way that certain employees take their job way too seriously. The defendant has a good theory, because a lot of people do stick by the rules. I want to give you a hard time just because they can. It’s sad, but people make problems for absolutely no reason. Glad they figured this out

    The defendant has the audacity to say if she had known it didn't have insurance then she would never have taken it, yet she wasn't a named driver, she was fraudulently driving the car under the plaintiff's name, so even if it had had insurance, it wouldn't have covered 'her' but the plaintiff, so the insurance would have been null and void anyway...

    If there WAS insurance, would the plaintiff be covered? I would think that Enterprise would disclaim because the defendant was neither the borrower nor a listed driver.

    jesus gotta love the attitude when someone has to actually provide PROOF of what they are claiming happened, then trying to say the judge was doing it first.
    gotta also love the defendant, the only way she can live her life paying all cash is if she has horrible things in her past that she's just trying to run away from.

    Enterprise has been apart of many lawsuits for lying about damages (literally settling millions of dollars on cases). They should have taken pics the day of pickup (on the lot) and the time of drop off (on the lot) with proof of date. Many of their employees are taught to try and upsell fees and to get as much money out of people as possible. They get commission of the fees they haggle out of people.

      Yes, have often heard of similar dealings over here too, common fraud in the car rental business. When renting a car, always take photos of it from all angles and mark date and time before leaving rental lot. They also try to scam for fuel but am not sure how that one works. Judge lives in a very honest world does she?

    The defendant, just thinks everyone owes her something. This girl doesn't even have a bank account, that right there is a reason to not help her. She's extremely ungrateful.
