What is Bad Faith?

Almost every time I settle a workers compensation claim there’s typically a page that my client has to sign waiving any “bad faith” claim. What’s a bad faith claim?

Is it considered bad faith when:
the insurance company ignores/does not acknowledge receipt of the workers compensation doctors referral for a treatment?
when the insurance company does not pay average weekly wages every two weeks according to the injured workers employer pay schedule (routinely late up to six weeks)

Injury 🤕 in 2018 still haven't received one 💵 dollar, share holders in something so critical should be a crime , in California.
