  • The plaintiff says he bought a car from the defendant and claims the dashboard lit up the minute he drove it home. He says he tried to return it the next day but the defendant refused, so he’s suing for a refund. The defendant says the car was fine when he sold it, so he won’t take it back.

      Wow I missed the part about him having a background in mechanics!!! And he couldn’t tell it was misfiring?!!! 🤦‍♀️ even I can tell when my vehicle misfires and I have no background in mechanics!

      The dude doesn’t make alot of money yes he’s a truck driver but not all of them make lot’s of money.
      If I was selling a car or suv I’d make sure it doesn’t have major issues and I’d list what’s wrong before a person buys it however if issues unknowingly was happening after they brought it I feel as though it would be on them

      Bought a Toyota corrola for 1300. Car was perfect and ran like a dream. Only had it for 7 days but that was due to user error.

      I've never paid more than $1200 for a vehicle and all have had bluebooked at 4000+ and each lasted me a year+ just gotta look, you can find good deals

      @@granitemoss1451 Yeah very true, easiest bet for getting a good car is getting a cheap toyota with maintenance records, they'll drive forever if well maintained all 3 of mine have had close to 300k on them. Also reading about cars of that year also helps, buddies first problem was going with the envoy those are noteably riddled with problems.

      You can get a good deal on Craigslist. But if your pre-purchase inspection consists of "I drove it for a couple of blocks" like the morons in all of these cases, then you only have yourself to blame when you buy a lemon.

      Buying a used car from a private party, regardless can be a headache. If you don't get an inspection, or a guarantee, you are buying as is. The good or bad, you eat it.

    First 3 minutes of this case, I already knew Geremy was gonna lose this. When you test drive a car, get a mechanic to check that car *before* you shell out the cash!!!! Not after!!!! And this car was a 2002 if I heard correctly. This car is over 15 years old going on 20, which is even more of a reason to let a mechanic check it before you buy it. Classic as is case. Sorry, Geremy, you're not gonna beat Shazam (pun unintended).

    I bought a low mileage 6 year old certified used car from a dealership. Here it is 13 years later and that car still runs like the day I bought it. Being certified isn't a certain guarantee, but it helps.

    I've been a professional mechanic of over 35 years. I can count the times that someone has brought in a used car to be checked out on two hands. A mechanic can't see every problem but can see obvious ones and also give you a good assessment of the overall condition based on things like fluid condition, leaks, previous repairs, previous damage, ect. While no one has a crystal ball at least paying $70 or $100 before the purchase gives you the best chance at not buying a piece of junk.

    I too believe they knew this truck was trash and they did rig it so it would work for a while.. So sad i feel bad but as we know a "as is" sale is just that "as is"... It sucks....

      @@catsliverio4163 It's a 2002 vehicle. This case I believe was in 2017-ish, maybe 2018. By that alone, it should have told the plaintiff to have a mechanic inspect it first before he bought the car. Shazam and his crew may have rigged the car to work for a minute, who knows. But considering Geremy had by his own testimony a background in the automotive industry, it's his responsibility to dot his I's and cross his T's and get that car looked at by a mechanic before he laid down the cash. You feel sorry for him, go right ahead. I know I share no such sympathy.

      It was understandable. Most of the time, who the litigant spoke to is irrelevant. In cases like this, it’s an as is sale. unless the plaintiff set up a warranty with one of the defendants, or as the judge said there was deception, who the plaintiff spoke to doesn’t matter. Since there was no warranty or deception it doesn’t matter who the plaintiff talked too

    The ending statement/advice was the best. Ask the seller to pay for the inspection. The problem is though, likely most will say no. They'll just wait for the next potential buyer. You buy a car cheap, you get what you pay for. That's why it's cheap!

      There's should be absolutely no room for ego in a courtroom. Very unprofesional. But you see it all the time. The justice system is such a broken down mess at best. I'd respect one more if they stood up for what is right and just, and fought to make the changes our system so desperately needs, & is long long long past due. Our future generations aren't going to be proud, but Ashamed of previous generations (especially those in power) who squandered their power and never made much needed Changes. The justice system aids and abetts the worst types of criminals, which inflicts further damages to victims. And these scammers will leave a long lasting impact on generations to come. We'll be assessing the damages for decades to come. The pandemic gave them even more opportunity to scam people. Our authorities are busy and preoccupied with mask and v mandates. Anyways, the scammers do it because they KNOW they'll get away with it. They have more rights than any victim or survivor.. And there's no shortage of cases to prove that point..

    I think English teachers need to make kids define "as is" a thousand times so they grow up knowing what it means! Imagine how few of these used car court cases we would see.

      I agree that this is part of a bigger thing that needs to be added to the school system in North America.
      I believe that "high school reading comprehension" should have a section dedicated to contract/terms of service reading and building connections, that "highschool mathematics" should be allowed to have a section on "responsible financial tracking", that "highschool science" should have a section on "anatomical microbiology", and that "highschool social studies" should have less focus on WWII and have a section on "Individual Impact".
      That said, all of these kinds of courses are often outlawed by the very parents who rely on the system to raise their kids for them.
      I remember in high school (9th or 11th grade), my math teacher thought a course on "spreadsheet use" and finally broke down. He explained that tools like algebra were amazing resources to help us manage our finances and that a spreadsheet system like Excel could help us organize and learn financial responsibility, but that the school board outlawed anything financial because parents were upset "teachers are calling us irresponsible spenders". We all thought that was stupid and agreed to keep it quiet and he showed us how to use maths to see the big picture.
      To this day, I hate when people say "I never use algebra outside of school" as his class on Excel showed how much we use it and how much using it can help us avoid so many financial battles.

    Everyone feeling bad for the plaintiff....when a bill of sale says AS IS how your product turns out is ALL ON THE BUYER. When something says As Is you should try even harder to inspect and fool proof your reason for buying. Also record all transactions and communications just in case you are being lied to by the sellers...that in turn will nullify the contract of sale. I received my education through People’s Court of RUclips. Thank you for your time ✊🏼

    There's no excuse now a days to buy a vehicle without getting a diagnostic check. You can buy a data reader and do it yourself.

      A car tool is what scammers use to clear any codes. So when a buyer comes it looks fine. Only after being driven for a certain number of miles will the codes come back up. The defendants definitely did that.

    I bought a car that I kind of second-guessed if I should or not in my mind....
    It was a lemon!
    It was my bad, I knew it was an as-is deal
    Lesson very well learned for all the vehicles I bought after that.
    Never made that mistake twice

      The victim lost over four thousand dollars to this SCAMMER... Blame the victim is normal though. And offenders are more protected by the justice system. They don't care about your rights. No issue violating someone. But they always take full advantage of their rights. Pretty pathetic. These scams are getting worse. Some people have lost their entire life savings. It can happen to anyone..

    I've had good luck buying used cars, one out of the classifieds and one off of a car lot. I bought a minivan off someone for $700 and the only thing I had to fix on it in over 3 years was a new starter. I also bought an Isuzu rodeo for $3,000, the brakes had issues the next day and the car lot fixed it for free, which was awesome because I didn't have a warranty. I drove that truck into the ground and it lasted about 4 years. I definitely got my money's worth out of both vehicles.

    Taking it to a mechanic doesn’t always mean things work out. My daughter took a car she was thinking about buying to a mechanic and he gave it two thumbs up. Within a month it was a piece of crap that had to be junked.

    It's obvious the seller knew there were mechanical issues with the truck and they probably had an obd2 scanner and cleared the codes before the buyer showed up to test drive it.

    I sold my 17 year old Camery for $1K and the guy had it for 3yrs. No mechanical issues he said. (Unfortunately some guy T-boned him but insurance gave him $4K for it) Anyways, too bad more people aren’t honest. “As Is” shouldn’t mean piece of junk.

    I don’t even take a mechanic to the location of the car, that seems pointless. I ask the seller to meet me at my mechanic or their nearest Firestone and I pay for them to look at it. Some girl on Facebook that was advertising a car kept refusing my request even when I offered gas money. At that moment no matter how good the car looks you just gotta know when to walk away.

    The problem with taking or TRYING to take a used Vehicle to a Mechanic before you buy it...is....You have to have a Mechanic Ready to look at it at a certain time, so when you test drive it you can take to the mechanic that is waiting on you...otherwise you'd never get a mechanic that can drop everything they are doing to do an inspection, Plus you have to pay for an inspection, so who wants to be out whatever they charge to only find out you shouldn't buy it?

    That advice at the very end about asking the seller to deduct the mechanics fee from the price of a car has to be the dumbest thing I've heard all week. That's clearly spoken by someone who has never bought or sold a vehicle outside of a dealership

    I truly thought since he wanted to return same day that there was a 48 or 72 hour law for that. And I believe the plaintiff, when he says the entire family came outside. The defendants culture is the family protects each other and they back each other. In this case I believe that the young man was cursing and acting a fool.and I wish the judges hands weren't tied. I hope the plantiff announces EVERYWHERE what this guy did to him. Sold him a lemon

    Even if you don't have it checked by a mechanic... the Plaintiff only drove it a couple blocks? 🤦 You are suppose to drive it on the freeway and the street at least 🤷‍♀️ Give it time to warm up for any lights to come on lol

      Apparently the lemon law applies to new cars only.

      Lemon law is for NEW cars and dealerships. Private parties are excluded except in cases of fraud. Buyers should have EVERYTHING they buy inspected before they hand money over

    I'm 40 and never bought a car from a individual, always from a dealership/car lot but if I ever do ITS STRAIGHT TO A mechanic b4 buying. I understand impulse completely but atleast get a 24/48 hour warranty lol

    When you buy a car IT'S AN AS IS SALE. That means do your job before you buy, take it to a mechanic & let them a look at it (DUH). Because once you hand the money over, THAT'S IT. BUYER BEWARE..

    You can have the computer cleared and if you leave the positive cable off it until you drive it a ways will take a while for it to compute all the codes.

    He would literally sell the car for blue book value explaining what all the issues are and then say the price is negotiable, he probably would get 2k for it, and at least he’d get his money back that way and then make like 500 off of it too

    Shit I bought an audi couple years old but only had 40 thousand miles. Took it to my foreign car mechanic that day he said it was in great shape so I bought it. Thats what you are supposed to do and it worked out for me. Simple.
