      @@bashkillszombies Smoke detectors that are wired do not charge the battery and over time will need to be replaced as the charge dissipates, how else does the detector know when the battery is hitting replacement alarm, it monitors the voltage.

      They are hard wired and all interconnected mate. The battery is only there as backup power.

      The lawyer did say to the police that the owner was entitled to have the inspector enter the premises. But the police made a lawful order to de-escalate. I guess the police thought the two lawyers would take the bone he offered (both sides go to the building authority tribunal to nut it out) and run with it, being lawyers (who basically live for a good dispute). The homeowner will do that after this inspection. So everything is on track.

      @@edithflood631 Its not a lawful order given that he stated it was a civil dispute. If the threat of a criminal confrontation were to occur then the likely agitators are the ones that need be removed (and the homeowner owns the title).
      Really it just comes down to Vic Pol being pussies and doing the wrong thing as always.

      @@edithflood631 If it's within the owners rights to have it inspected the officers shouldn't have given an order for the inspection to not take place. It's not lawful unless it's a actually backed by the law.

    As a licensed electrician of 15 years, I can tell you that electrician who did that job needs to be arrested. There is no way I would be caught dead doing a job like that even just as a matter of personal pride let alone the safety and legal aspect.

      a unique director id is now used in registering companies. no person can have more than one director id which now prevents dodgy builders from just claiming bancruptcy or close down their company when they get in trouble and create a new company.

      @@NikkiWinwood a unique director id is given to a company director no matter what industry that company is in. you can google "About Director ID" and hopefully you will get to the link from abrs.gov.au for more details. I am aware of this because I had to apply for one myself, since I own a SMSF and had to create a company of which i am the director

      Definitely is a strong choice of words. You have a lot of faith in Energy Safe. They did nothing when I reported non-compliant work that led to what the neighbour described as an explosion, where it seems the main line arced out pre meter and went bang after a moron crushed the cable jack hammering the slab edge that had blown out.

      I don't think the issue is about censoring the inspector because He believes deep inside He is guilty. It could also mean that this "specific inspector" is a RUclipsr, and therefore, all the things He will find will expose the builder and hurt the builders' business; I'm sure if they made an agreement, it wasn't going to end up on social media they wouldn't be so reluctant. Now you may argue that the builders' business name and image aren't being published. However, that still doesn't do enough because people who know the person can still recognise his voice.
      Also, this may not be the builder's fault himself; it may be the fault of the guys he hired to complete the work. So the builder himself could have been shafted by his own employees so there can be so much more to the story.
      I know builders who hire electricians, painters, chippies, plumbers etc.
      Just because you have been a builder for 25 years doesn't mean you build every component yourself.
      I'm sure the builder himself will go after the contractors He hired.

      I grew up around builders, construction projects, builders' kids, the rotting neighborhoods they built but didn't live on.
      The builder knew. Inspections are 100% routine and common except when someone is trying to commit fraud.

      If this is the case, why not target the VBA in a royal commission, if you believe this is the case. Why only target the builders?

      Unprofessional is the most basic description of their behavior.
      Then again, if they were doing their job and built it right they wouldn't have to worry about someone checking their work.
      It's one thing to feel a bit of insult by someone coming to check your work, we can all feel that way especially if we do our best, but a professional knows it's not personal its good practice.

      @@EMan-cu5zo Exactly. When someone gets this strong of a reaction it tells me there's a reason they don't want me looking at their work and makes me even more determined to check it.
      I used to build jets back in the 200's and I always had problems with other techs. We learned that certain shifts just didn't do work properly. I would come in and find an airframe signed on for inspection and knew to just go remove it and check it myself. Never once did I not find issues, damage, tools, or FOD in a bird.
      Had one time where the crew got fighting upset when I did this and actually tried to start a fight. I made sure to check that bird with a fine tooth comb and sure enough I found a massive span of damage on the vertical riser. I'm not talking minor in any way, it would absolutely have caused a crash at some point.
      Huge incident that pulled the entire structure form assembly for nearly four months while engineering figured out how to fix it. The tech, shift lead, manager, and the inspector who claimed he had looked at it and tried to fight me on it all not only got fired but they had their licenses revoked. The inspector especially infuriated me.
      Lesson I learned first day in training is you either build a jet, or you build a smoking hole in the ground. There's no in between and you cannot pull over at 30K feet.
      I see the same thing with houses and other safety stuff, the louder the protest the more closely I am going to examine what you are doing.
      Just me, but I think all inspectors should have that attitude.

      Would be awesome...sad part is that you need VCAT member or judge to confirm the misconduct before legal board acts. Been there done that! My build was front pages news after it went wrong.....no one is punished.

      @@tanjacristina7913 I agree that wrong was done, but to be clear, an occupancy permit does not mean a person has possession of the home, it means the home has passed all necessary requirements to be deemed ‘liveable’, ie; got a toilet. Hot water, doors, etc. Possession is usually dependent on final payments being made….depending on contract terms…which is a whole different can of worms when works are being disputed. Fact is, the owner ALWAYS has right to access their property, but should be arranged with builder. Builder must be reasonable and make time to accompany owner, else give them permission to access. They can’t stop Onsite from being there….ever….at worst the builder can claim trespass if they enter without trying to arrange a meeting. Stupid thing is….the builders lawyer will still face the report if done after handover, where defect period hold builder liable. Builder can contest what on-site finds, but handing the place over does not mean the Builder is free of liability.

      That said, the builder still takes responsibility as He should also take the time to go over the works of the contractor's He hires. It's going to be a hard lesson learnt for him.
      The issue is complex I just don't like it when people blame the builder and ignore the contractors.

Inspector isn't the one who builds the house, the builder is. Builder is responsible for knowing all regulation and then build the house according to it and the plans, if he doesn't, or can't, then he has no business to be in the industry and should go flip burgers. The reason they had to create inspectors is because of all the dodgy builders cutting corners and building garbage houses just to rip people off and fill their pockets.       If you claim the builder knew. And tried to cover it up. What about the Independently inspector, who is a separate entity such as the VBA, then what you would be claiming is that not only are the builders corrupt but also the Victorians Builders Authority.

      If this is the case, why not target the VBA in a royal commission, if you believe this is the case. Why only target the builders?

    If the builder is so certain that his inspector has passed everything, he should have no issue allowing a second set of eyes in. Unless he's worried there is something he would find that needs to be fixed.

      Yes but in our wonderful state of Victoria, the builder usually arranges the Building Inspector. This casts doubt on the impartiality of the process. Look at how many Building Surveyors turned a blind eye to cladding and EPS issues. BCA is clear as day about combustible building exteriors and the FRL of such structures. Not seeking a fire engineering report if unsure. So the system is broken from a consumer's perspective. VBA has no teeth or balls. Builders call the shots. I think building surveyors should be engaged and paid for by the Building Owner. then they are incentivised to hold builders to account. Simple legislative change but will it happen?

      I would never do it the way these people do. I have been in construction most of my life. I’d rather buy an old house than go through a new house construction. Not just managing the builders, but the government and all the crazy costs. Earlier I might have built it myself. Now I probably would not consider it even if I were wealthy and younger.     And this is why I tell everybody that I have built for is to get an independent builder, electrical and plumbing inspector of their choice to come in at different stages of construction to do an inspection.
    Yes, this will add to the construction costs but at the end of the day it gives Peace of Mind because you know none of this can happen.
    If this guy ever showed up to any of my building sites, I would not only welcome him, but I would ask him to show me and email me all faults found so that they could be rectified as soon as possible.
    If you're dealing with a builder who will not allow you to do this put your money back in your pocket and go find someone else.

      Even though it shouldn't be necessary, the costs of having your own inspector - building, electrical, plumbing - is a drop in the bucket compared to the amount of money you've already dedicated to constructing the home. A few more thousand for peace of mind, you bet.

    Im a tradesman. I hate seeming work like i saw in that roof. Energy safe needs to be called on the electrician. The work is completely illegal. The heater is also not compliant. No markings on duct and used thin straps. Really poor heater install and VBA must be called on the installer. These fools need to loose there licences.

    Poor lady, good on her for standing up for herself. Must be frightening, these guys obviously trying to intimidate and acting like thugs.
    The builder says he has been doing it for 26 years and tells a story of how this is hurting his family, but if he had any pride in his craft or cared for his family he would have gotten in the ceiling and seen and fixed these issues himself. He only has himself to blame.
    Russell is great and explains things well. The point about the craftsperson leaving it to the plumber to figure out, the the plumber being unable to change anything, is really solid. Then there’s the lawyers - the builders lawyer total scumbag and the owners lawyer spineless.
    Also a good lesson it’s a waste of time to involve the police in anything.

    The other building inspector should lose their licence, and the home owner should sue them for the money they paid for a shit original inspection. Thank God site inspection showed up to find all the faults. The ceiling cavity was a mess, was good to see the body cam.

      I'm related to a private building inspector, and whilst Zahir is incredibly knowledgeable, it's easy to miss some things. That's why inspectors insurance is so incredibly high, it's a high pressure job.
      I think if major defects, NC are missed then there should be a body that notes that and if there's 3 lose your licence and sit before a review board. Unfortunately whatever you do will only affect the private inspectors and never the big dudes who just tick boxes, cause they pay their way

      Because cops cant deal with civil disputes, if they do they risk lawsuits, so the simplest solution at that time is to tell everyone to go home so the situation can't be escalated. Its shit but unless every cop is required to have a law degree, de escalation is all they need to do.

      @@Jacopski although that's true, the cops here lacked a lot of common sense. if your neighbour came to your house and then told you to leave, and cops were called due to the civil dispute, imagine how stupid it would be if the cops told you to leave your own home to de-escalate the situation. the title of the house is in that lady's name, the occupancy certificate has been issued in her name, she owns the house and should be free to come and go, stay, have an inspector look at it etc. instead the police tell them to leave to de-escalate the situation.

Seems like there was a technicality where the builders are in charge of the house as its "before handover", she mentioned she can change the locks at any time but maybe that would void the contract and the builders wouldn't be liable to repair? Either way it seems like a sticky situation and I think there's more to it than just "she owns the house"

      Correct, it is a civil matter and the police have no jurisdiction there. The home owner had an occupancy certificate and had every right to have the inspection done and the builder should be sued for interference.

    the builder's lawyer is clueless about building construction. a formal handover doesnt mean that the builder is already immune to any claims for repair of shoddy work that the owner is not happy with and the owner has full rights to bring in her own inspector to get a 3rd party opinion.

      We've had a builder come back dozens of times to attend to defects, esp water leaks. His 'fixes' made things worse. Home owners are being ripped off by builders who throw away the building regulations book and cover up the cheats. For many owners, it becomes too expensive and stressful to have inspection after inspection, lawyers, etc. The VBA seems to be a joke, leaving the public screwed. Government and local Councils collect their revenue but do little to protect us from these rogue builders.

    Good work mate. Wish there was inspectors like you! I went through 3 inspectors on my new house in Canberra and they were all garbage and and none of them went in the roof except for one for who I had to remind to go in the roof as he was packing up. I've given up on ACT inspectors and now trying to dispute issues with the builder myself. Terrible process.

      Many construction firms put NDAs into the inductions so they can protect from being exposed etc .. just assume that all construction companies are dodge even if the builder themselves has a good rep I can attest to the fact the contractors do not all hold that same standard to regard

If you sign an NDA with your builder, they do terrible work and you post about that terrible work, the NDA has no affect.     I remember when my parents built several homes in the 1970s and 1980s. They had inspections at every phase of the build, starting from the ground works all the way through to completion. If, for example, the frame works were not up to code, the build would stop until the issue was rectified before further work could continue.

      I had the same experience when i built back in 1985. Each phase of the build had to be cleared by my BANK'S inspector before the next stage could go ahead. House was built in 3.5 months. Those days are gone and I feel so sorry for anyone wishing to build in todays world.
