    I woulnt expect every law professional under consideration for a federal judgeship to be conversant in every detail of every case that has ever been argued. But I would expect them to at least have a firm grasp of the basic principles of the law, particularly the ones that set precedent upon which many further elaborations would later be determined, and know more about it than I do.
    Now because this nominee answered the questions and did so honestly when he did not have a clear enough understanding to comment, and having demonstrated his ability to cram for an exam, I will take him at his word that should he be charged with examining an unfamiliar set of circumstances, he will do his homework. Every other nominee has turned to baffle with BS when confronted with a question they could not answer. This is the first judicial nominee I have seen offered up by the current administration who I believe is worthy of a second round of questions. I suspect this guy could actually be a competent judge.

    Dick Durbin's snarky comment at the end of this video should not be overlooked. Does Durbin believe that Kennedy's approach to vetting judicial nominees by asking them questions about the law is somehow unfair? Durbin's comment says more about him than it does about Kennedy.

    When I showed up for a job interview I was prepared to answer questions that pertained to my expertise and knowledge. Why on earth do almost everyone of these Democratic nominees never answer a question directly without going into a word salad as our esteemed VP!     I thought this nominee did better than the vast majority. He wasn't doing that dumb stalling, 'thank you for the question, senator..." and he was not doing that weird smug non answering or flat, memorized, monotone soundbytes repeated over and over. He was to the point, polite and answered more questions correctly than any other Sen. Kennedy victims 😈. I love Sen K, but I would faint if I was on his bad side and had to answer his questions.

    Big fan here of Sen. Kennedy. He shoots straight from the hip. I would however say, this nominee is the first and maybe only candidate the Biden admin presented before the Senate that is not a chameleon. I would say, give him the nomination. Perhaps Biden appointed him by mistake. As you all know they go by some color, gender qualifications and such.

    The political question doctrine holds that some questions, in their nature, are fundamentally political, and not legal, and if a question is fundamentally political, then the court will refuse to hear that case. It will claim that it doesn't have jurisdiction. And it will leave that question to some other aspect of the political process to settle out.
