The issue with the used games getting dumped isn't with willful and malicious actors. As a furthering of this conversation, what happens if a customer buys a physical game from a store, gets the error code that says this copy of the game is banned, and wants a refund? Will that customer be able to get their money back? Or will they be suspected of ripping the game themselves and running it on two Switches? Do we as buyers have any recourse in this scenario?

I think if you are going through all of this trouble, you'll either already know that they have unique IDs or you'll find out in your research if you didn't already know. If people just want free games, there is already a much better and ACTUALLY FREE way of doing it, being modding your console, which they're probably going to do instead. That doesn't require purchasing games and returning them or really trying to find these raw dumps. Even if it has happened, I can see it being so extremely uncommon that either Nintendo wouldn't do anything about it, or if you did get wrongfully banned you could get in touch with their customer support to verify things. They actually do have really good support.

It happens all the time in the hacking servers, where people go for guidance and support with getting their consoles modded. And to clarify, this product exists, mostly, for people who *cannot mod their console,* or who lack the technical knowledge, and motivation to attain it. Most Switches are not hackable, by a longshot, without an expensive modchip and installation fee, or learning microsoldering. The drag-and-drop nature of the product means you never really have to *think* about how it works, as long as you know some basic functions of a computer. As for bans, they absolutely have happened. They are automatic. Once the logs exist, it becomes a matter of when, not if. The rise in popularity of these products will only incite a further crackdown from Nintendo's side, as the issue becomes more widespread.
Bob, you may need to blur more of the footage. The claimed part of Russ's video only showed the _title card_ of a game on the app launcher, not the game's title screen or gameplay. Really, people should be blurring out literally every Nintendo product, bleeping out the name of the company and all their properties, etc. Treat everything they've ever made as if it's too obscene for anyone to see or hear. This eliminates the copyright-based attack vector they use to file bogus strikes, takes away free advertising, dings their family-friendly brand image, and makes a strong point about how ridiculous their behavior is.

It's funny, there's no issues with ripping your music CDs through iTunes to use on your iPod, but for some reason, console games are exempt from this? Didn't Sony get a lawsuit for putting malware on music CDs in the early 2000's to prevent people from ripping said music CDs? EDIT: The banning issue wouldn't apply if you could find a way to generate a ticketless dump. That said, I imagine the lack of a ticket would trigger a system ban if you tried playing said "cartridge" online.
I saw a review of a previous version a while back. All (except maybe 1?) of the tickets are required to be present for the Switch to read it. Some certificate switching from donor carts is possible, but detectable if Nintendo wants it to be
Having no game certificate at all does indeed get you banned, Nintendo only looks at a couple of things, one is making sure the game certificate is there and valid, two is making sure the certificate is not being reused on multiple games to prevent both Gold Points abuse and piracy, and three, if the game utilizes Nintendo Switch Online, the game certificate is sent to the server along with the device token, and if both are valid, the server will give back a application token. If you are banned, you won't ever have a device token as that is given by a different server (dauth server, or device authorization), which looks at your device certificate to see if it's been banned, if it isn't, you get your device token.
The uncertainty is around encrypted games. A GBA game has no encryption on it, so dumping it is entirely fine legally, but something like a Vita or Switch game is a bit hazy.

Only reason console platform holders don't allow emulators is because they don't want their relationship with other platform holders to burn. the hype for the mig switch cart was way too overblown. most people thought it would be like the ds r4 cards back in the day but thats just not the case. the dumper on the other hand is great. purchased one myself

It's illegal if you obtain them without owning them - or even if you own them and obtain them from another source that is not extracted directly from your own personal physical copy. Russ showed games he physically owns, backed up legally, and ran on an emulator. I'm not an attorney though, so if I'm wrong, someone please correct me and site legal sources so we can all learn.

Okay I've been on a manhunt for weeks now because I didn't realize the item I was looking for was the MIG. I thought I saw a video of someone who had a 3rd party cartridge that had a switch program that could then copy whatever physical games you inserted, guess I'm living a little too far into the future! I really appreciate your video since it fully turned me over from wanting my own to "I would literally rather just swap my cartridge at that point". I was hoping to find something to make it less of a hassle when I'm at home and wanting to quickly change out my games without buying all my physical games as digital copies . The only thing that would truly suck about a hypothetical where Nintendo strikes/bans both users is I honestly don't know the origins of at least half my games at this point. Idk about everyone else, but outside of the second hand market I've just been full on gifted copies of used games from friends who aren't attached anymore. I can imagine this would create all kinds of issues for people who may have forgotten which games of theirs they got second hand or not

They should just make a Nintendo [ allinone ] cartridge where you can fully move your games onto one cartridge for multipurpose reasons, to stop pirating just make it unreadable to a PC via a chip that verifies if its in a switch
I hope years after the switch is discontinued and Nintendo takes their servers down that these cards are allowed to expand and be what they're supposed to.
There will probably be software or bootrom exploits at that point for all units which makes the flashcarts irrelevant, it's what happened with the 3DS.

The lawsuit covered a cease and desist on development and distribution of the emulator plus giving up their domain name (paying 2.4 million in restitution fees as well) which is different from them owning the emulator code. Nowhere does it state Nintendo owns the code, if you have a link to any official court documentation that states otherwise I’d be glad to be proven wrong but as it stands you’re spreading misinformation.

My modded OLED is amazing as you can dump the cartridge games straight into the SD card. I just love the comfort of never swapping cartridges and I still have my original copies for preservation.

I doubt people who are downloading these care about playing online. Even the online features like the retro games are on these downloads. So as long as you know you won't be playing online it's a meh to those people. I have over 100+ games in my physical library and maybe 1 or 2 even have online capabilities. Also your account doesn't get banned its the switch console that gets banned. So buy another one and your back in business.
I ordered the dumper from their main website the day before they got sued and I still haven't heard anything about my order. They have since closed their previous domain, started a new one and continue to sell more products without fulfilling old orders. I'm not sure if everything is still on preorder, but it stinks that they're still taking people's money without updating old buyers who've been in limbo for months

I ordered the Mig Switch bundle (cart and dumper) back in March from the store of the company that actually makes it. It shipped in August and still hasn't arrived. Really hope I actually get mine.

Everyone should stop crying about what they're TRYING to do and instead spend their time GETTING it before they can stop it, rendering their attempts completely pointless at the best case scenario. Nintendo wants to block all piracy of mario games? who cares, I got them all with 3 backups and I've got 5 phones and laptops to play them on! RUclips fills videos with ads and adblocker demands?! Get it from the official site, I got mine like 2 weeks after I ordered the V2. And with the V1, get the 8 game card switcher, put the V1 and another game in, and then just press the button to switch games. That way you don't wear out the cartridge slot
I actually do worry about these being out in the wild, my local library has switch games to check out, I don't want to get banned (or worse some unsuspecting kid) for just using the game that someone else dumped and is playing online. I know the likelihood of it happening is very low, but the fact it's still possible worries me

Nerd here. My dumper just got delivered this week after a 4 month delay. My plan is to keep my OG library on the shelf and only travel with the backups. In the past, I had a 3DS stolen and it sucked to rebuy all my games again.
But how does the dumper work? Dumping games should be legal, but if the dumper basically has a prod keys that was extracted from a Switch, it wouldn't be legal.

Lmao, I did the same. Watched russ vid on it. Twice. Then ordered one. Also because I hate nintendos. Even if I don't use it. I got it as a f u to them.
I thought the dumper would be more appealing than the cart itself. Even without the niggles, it just isn't worth risking Nintendo banning the user account, or having to cautiously go offline on the Switch etc. By using the dumper to play emulation on different hardware sych as the Steam Deck, typically you know it's all safe offline and won't have to worry about Nintendo's firmware updates or account banning.
I can attest to the production being slow. I got my preorder for the v1 card+dumper combo in JANUARY ‘24. Then there was the v2 upgrade… Thankfully I was upgraded to a v2 card+dumper in June. I JUST received my combo in SEPTEMBER!

Ticketed dumps have been possible for a long time. The only real (yet small scale) damage for an easy to obtain dumper to cause is to places where obtaining carts is cheap or free. For example: A library lending games makes it easy to borrow, dump, return. As soon as they go online at the same time, it gets flagged and both devices get banned. You gain nothing by dumping and going online, you're just putting yourself at risk. Similarly, if you were flipping games (got them cheap and are selling them for a higher price), keeping a dump and going online causes the same issues. If you're being malicious and intentionally going online, you're going to run out of consoles. I guess you could upload the dump somewhere, report it to Nintendo and get it banned. A ticketed dump doesn't really matter to Nintendo as their system just applies bans, and they don't care about the second hand market. Ticketless dumps are available in abundance but will keep you offline if you don't want a ban. Either way, I don't think the dumper is really causing a large scale problem. Happy to be educated otherwise though
I just picked up a dumper from Aliexpress as well. Waiting for it to arrive, but while I was there I found an amiibo thing so I added that... I have the MIGswitch, but still have not even touched it (or tried it out). I think the dumper will nice with the Steam Deck, but we'll see!
the card works well and don’t need to delete the file to get it to work again. just click it in and out a couple times and it’s good to go loading other games!!

If you think files are getting corrupted in the transfer you could use the xcopy command in Windows which includes a verify argument to verify the file after it's been copied
It's so silly, bacause Nintendo could just sell their games on PC and solve every problem that they have, they would pretty much "kill" emulation, and still profit more money considering that PC market bacame a lot bigger on the recent years. People say "well, nobody would buy the switch then", and I think that's wrong, the public seems very distinct, that's what multiplatform games had proven.
The dumper being the cooler part of this combo was what I've been thinking from the start; I don't care much for playing games on my switch, I was more hyped to have a legitimate way to give nintendo money for the products they make that I actually care about. The Switch is kind of a piece of junk but the games are solid usually. The fact that I HAVE to pirate just to get the best experience out of their games is annoying.
The latest firmware locks the last game played, that is why you got stuck on the mario odyssey. The way around this is easy, pop the cart out, then pop it back in and as soon as the green light appears pop it back out, give it a second, then pop it back in. That unlocks the cart and you can now switch between games again. This was in response to an earlier issue that was happening when you would put the switch to sleep with the mig switch in and it would flip to a new game when resuming from sleep, crashing the currently opened game.
I ordered my dumper back in March and still no Dumper... I'd kill to finally get my hands on this. I love playing Breath of the Wild on my Steam Deck, and I'd love to get the rest of my library on it too...
I feel like the mig switch doesn't even need to exist. A good solution to this problem would be if Nintendo gave you a digital copy with your physical purchase of a game. That way you could have all your games on your switch without resorting to piracy. Only issue I could see is that people would probably sell the digital copy separately. But this could be easily solved through having the digital copy only be activated by your account or through some function inside the game.
When the Migswitch won't change games. Insert the Migswitch. Watch for the green light on the Migswitch cart to flash and quickly eject it. Reinsert it and it will go to the next game.

Having no game certificate at all does indeed get you banned, Nintendo only looks at a couple of things, one is making sure the game certificate is there and valid, two is making sure the certificate is not being reused on multiple games to prevent both Gold Points abuse and piracy, and three, if the game utilizes Nintendo Switch Online, the game certificate is sent to the server along with the device token, and if both are valid, the server will give back a application token.
If you are banned, you won't ever have a device token as that is given by a different server (dauth server, or device authorization), which looks at your device certificate to see if it's been banned, if it isn't, you get your device token.
The uncertainty is around encrypted games. A GBA game has no encryption on it, so dumping it is entirely fine legally, but something like a Vita or Switch game is a bit hazy.
Devices that let you play games on a competitor's device are illegal, this was established with Atari and Intellivision.

Bleem had a Sega Dreamcast version. Only reason console platform holders don't allow emulators is because they don't want their relationship with other platform holders to burn. Didn't stop Rare Replay or the Goldeneye Remaster from having an N64 emulator built-in, so I guess platform holders only really like emulators if it's not at their expense.
the hype for the mig switch cart was way too overblown. most people thought it would be like the ds r4 cards back in the day but thats just not the case. the dumper on the other hand is great. purchased one myself

It's illegal if you obtain them without owning them - or even if you own them and obtain them from another source that is not extracted directly from your own personal physical copy. Russ showed games he physically owns, backed up legally, and ran on an emulator. I'm not an attorney though, so if I'm wrong, someone please correct me and site legal sources so we can all learn.

Okay I've been on a manhunt for weeks now because I didn't realize the item I was looking for was the MIG. I thought I saw a video of someone who had a 3rd party cartridge that had a switch program that could then copy whatever physical games you inserted, guess I'm living a little too far into the future!
I really appreciate your video since it fully turned me over from wanting my own to "I would literally rather just swap my cartridge at that point". I was hoping to find something to make it less of a hassle when I'm at home and wanting to quickly change out my games without buying all my physical games as digital copies .
The only thing that would truly suck about a hypothetical where Nintendo strikes/bans both users is I honestly don't know the origins of at least half my games at this point. Idk about everyone else, but outside of the second hand market I've just been full on gifted copies of used games from friends who aren't attached anymore. I can imagine this would create all kinds of issues for people who may have forgotten which games of theirs they got second hand or not

They should just make a Nintendo [ allinone ] cartridge where you can fully move your games onto one cartridge for multipurpose reasons, to stop pirating just make it unreadable to a PC via a chip that verifies if its in a switch
I hope years after the switch is discontinued and Nintendo takes their servers down that these cards are allowed to expand and be what they're supposed to.
There will probably be software or bootrom exploits at that point for all units which makes the flashcarts irrelevant, it's what happened with the 3DS.

The lawsuit covered a cease and desist on development and distribution of the emulator plus giving up their domain name (paying 2.4 million in restitution fees as well) which is different from them owning the emulator code. Nowhere does it state Nintendo owns the code, if you have a link to any official court documentation that states otherwise I’d be glad to be proven wrong but as it stands you’re spreading misinformation.

My modded OLED is amazing as you can dump the cartridge games straight into the SD card. I just love the comfort of never swapping cartridges and I still have my original copies for preservation.

I doubt people who are downloading these care about playing online. Even the online features like the retro games are on these downloads. So as long as you know you won't be playing online it's a meh to those people. I have over 100+ games in my physical library and maybe 1 or 2 even have online capabilities.
Also your account doesn't get banned its the switch console that gets banned. So buy another one and your back in business.
I ordered the dumper from their main website the day before they got sued and I still haven't heard anything about my order. They have since closed their previous domain, started a new one and continue to sell more products without fulfilling old orders. I'm not sure if everything is still on preorder, but it stinks that they're still taking people's money without updating old buyers who've been in limbo for months

Get it from the official site, I got mine like 2 weeks after I ordered the V2. And with the V1, get the 8 game card switcher, put the V1 and another game in, and then just press the button to switch games. That way you don't wear out the cartridge slot
It's easy as fuck to get most dumps. There's a huge torrent you can run and just pick and choose the games from the collection
The dumper is a really cool bit of kit. I'd love to see an internal mod so you can just put carts into a steamdeck just for big finger to the big N.

I actually do worry about these being out in the wild, my local library has switch games to check out, I don't want to get banned (or worse some unsuspecting kid) for just using the game that someone else dumped and is playing online. I know the likelihood of it happening is very low, but the fact it's still possible worries me

Nerd here. My dumper just got delivered this week after a 4 month delay. My plan is to keep my OG library on the shelf and only travel with the backups. In the past, I had a 3DS stolen and it sucked to rebuy all my games again.
I never knew the dumper could play carts directly on your pc. That makes me want the dumper more then the cart.

I thought the dumper would be more appealing than the cart itself. Even without the niggles, it just isn't worth risking Nintendo banning the user account, or having to cautiously go offline on the Switch etc.
By using the dumper to play emulation on different hardware sych as the Steam Deck, typically you know it's all safe offline and won't have to worry about Nintendo's firmware updates or account banning.

My local library LENDS switch games. I presume if the game ban happens it will be a BIG problem in a lot of places.
Ticketed dumps have been possible for a long time. The only real (yet small scale) damage for an easy to obtain dumper to cause is to places where obtaining carts is cheap or free. For example: A library lending games makes it easy to borrow, dump, return. As soon as they go online at the same time, it gets flagged and both devices get banned. You gain nothing by dumping and going online, you're just putting yourself at risk.
Similarly, if you were flipping games (got them cheap and are selling them for a higher price), keeping a dump and going online causes the same issues. If you're being malicious and intentionally going online, you're going to run out of consoles. I guess you could upload the dump somewhere, report it to Nintendo and get it banned.
A ticketed dump doesn't really matter to Nintendo as their system just applies bans, and they don't care about the second hand market. Ticketless dumps are available in abundance but will keep you offline if you don't want a ban. Either way, I don't think the dumper is really causing a large scale problem. Happy to be educated otherwise though

I just picked up a dumper from Aliexpress as well. Waiting for it to arrive, but while I was there I found an amiibo thing so I added that... I have the MIGswitch, but still have not even touched it (or tried it out). I think the dumper will nice with the Steam Deck, but we'll see!

If you think files are getting corrupted in the transfer you could use the xcopy command in Windows which includes a verify argument to verify the file after it's been copied
It's so silly, bacause Nintendo could just sell their games on PC and solve every problem that they have, they would pretty much "kill" emulation, and still profit more money considering that PC market bacame a lot bigger on the recent years.
People say "well, nobody would buy the switch then", and I think that's wrong, the public seems very distinct, that's what multiplatform games had proven.
The dumper being the cooler part of this combo was what I've been thinking from the start; I don't care much for playing games on my switch, I was more hyped to have a legitimate way to give nintendo money for the products they make that I actually care about. The Switch is kind of a piece of junk but the games are solid usually. The fact that I HAVE to pirate just to get the best experience out of their games is annoying.

The latest firmware locks the last game played, that is why you got stuck on the mario odyssey. The way around this is easy, pop the cart out, then pop it back in and as soon as the green light appears pop it back out, give it a second, then pop it back in. That unlocks the cart and you can now switch between games again. This was in response to an earlier issue that was happening when you would put the switch to sleep with the mig switch in and it would flip to a new game when resuming from sleep, crashing the currently opened game.
I ordered my dumper back in March and still no Dumper... I'd kill to finally get my hands on this. I love playing Breath of the Wild on my Steam Deck, and I'd love to get the rest of my library on it too...

I would LOVE to take my entire physical switch game library and put it on a single cart. But we arent in that future yet.
I feel like the mig switch doesn't even need to exist. A good solution to this problem would be if Nintendo gave you a digital copy with your physical purchase of a game. That way you could have all your games on your switch without resorting to piracy. Only issue I could see is that people would probably sell the digital copy separately. But this could be easily solved through having the digital copy only be activated by your account or through some function inside the game.
When the Migswitch won't change games. Insert the Migswitch. Watch for the green light on the Migswitch cart to flash and quickly eject it. Reinsert it and it will go to the next game.
