      ​@@studdedleatherlacesure. But she still isn't required to ID for a simple trespassing. Some states like Texas you don't even need to ID unless you are actually arrested. Most states you need RAS or responsible suspicion a crime has been committed, is being committed or is about to be committed.
      Trespassing you have a chance to leave. If you don't then you have problems. But she was clearly trying to leave when the officer said she was trespassing and she said she needs to go home and started trying to walk away. Then the officer put his hands on her for absolutely no reason.

    Actually, you do not need an I.D. to be trespassed. A trespass can be issued verbally.

    This has been described as "Thinking in 10 second intervals". Meaning, hey I'm not in cuffs for this 10 seconds... its ok to go on behaving in such a manner. That process usually repeats over and over until they are being ran off to jail. These vids all play out the same sadly.

    Honestly, I kinda want to see a cultural study that examines outcomes of with regard to race, escalation patterns from officer and arrested, and duration of interaction.
    Time-to-Event data… Could probably use existing bodycam footage to collect all of that data.

    She legally doesn’t have to show ID, and with a trespass she has to be told to leave and if she doesn’t then it’s illegal. If she comes back after she leaves then it’s illegal. People need to learn their rights!

    You don't have to give ID to get a trespass warning. You have to have the opportunity to leave the property. If you don't then it's a crime.

    The way it works is you have to be “officially” asked to leave and if you deny then and only then do you have to identify yourself and be trespassed.

    I didn't see a good cop here, just a bad one.
    The officer did no investigation, immediately relayed the trespass from the first person he guessed could issue one, then detained the lady who was willing to leave after a short argument.
    In Florida, where this appears to be taking place, you're allowed to leave after warning.
    The detainment for information was illegal and the officer can be sued for doing so.

      She didn't leave after a warning. Thats why the cops were called. The police are able to detain a suspect during an investigatory stop. She gave a fake name which is resisting without violence in Florida and thats what she was charged with. The cop was talking to her with respect and was being very patient. The cop wouldn't have even arrested her for it, but she was being disagreble and disrespectfull. Play stupid games, win stupid prizes.

      It doesn't matter, if a business wants someone trespassed, that's their obligation. The police need to officially write that warning. You need a name to issue that warning so it is on record, otherwise it's just hearsay.
      You are such a fucking bootlicker for criminals who refuse to follow simple commands. She even blatantly tried to give the wrong name.

      No, it’s best you know the law and your rights. You don’t just comply with officers blindly, you ought to know enough about the law to not argue when you’re in the wrong and get yourself arrested.

    Less than 2 minutes in she would have been on the way to jail for Fail to ID. He had a legal reason to make contact with her, she declined to cooperate. I have no patience for people like her.

      If you are trespassed, you leave, no crime. The crime is staying after being asked to leave.

      Florida Statute Section 901.151(2)
      If you care, you can look that up. In this instance she didn't have to show ID. Yes, the officer did show up to issue the trespass warning. The officer can temporarily detain her to perform his investigation. His investigation being to determine if a crime is being committed, has been committed, or about to be committed. Since this is just a warning, not an actual crime, the provisions to require identification isn't met and she should be released after that detainment.

    1 minute in and the officer has done things wrong and maybe illegal.
    You don't need ID to trespass. She told the officer she needs to go home and was trying to leave. If she doesn't leave then you go to the next step
    He put his hands on her for absolutely no reason, even if just a slight touch, there is no need and can be seen as an assault.

She was told she can't leave, when someone is being detained cops are aloud to put a hand on her shoulder. Not to mention she thought she was being clever and gave a fake name at first that she knew was actually the employees name (That could have been another charge) and while she does have the right to plea the 5th that does not mean she doesn't have to go to jail.

It is their job to issue her a legal warning not to go back or face arrest. You want the cop to just say to this unknown person, 'don't come back here or you will be arrested'? How is any other cop supposed to know she had been warned before?
      You're confused about the police just rolling up on someone and demanding they give their info to them.

She could literally just say "nuh uh" and with nothing official on file with her name, I would think she would be free from getting arrested.
      It seems so simple to me. Give identification and then keep it moving.

    Maybe I'm wrong here but I was under the impression that to be trespassed, you have to refuse to leave.
    Shes willing to leave. Should she come back, then they call, give her a notice and will be arrested after that.

So the officer has to give her a legal warning that will be put in the system so the next cop that comes back knows that she's been given that legal warning and can now arrest her for trespassing. How is he supposed to get that info into the system for any future issues?

    So. She didn't commit a Crime. Nobody saw her commit a Crime, she does not have to show identification if she has not committed a Crime. She also has the 5th amendment right to remain silent, and a 6th amendment right not to answer questions without the presents of a lawyer.
    Even if you don't like it, or her; she has the right to refuse.

    This woman spent money and time for what..."your not the boss of me" her pride was more important. I can't stand it when ppl, especially ops say "this is nothing" ...your are basically telling them that they can do it again. BTW...that cop chose to be walked on for 10 minutes,,he didn't "have to". There is a whole area in the middle. It is not either beat someone or kiss their ass. They call it deescalation...how did that work out for him? No one belligerent calms down just because a cop tells them to relax. People like her just take advantage of it . They see a weak cop that they can manipulate. If a cop tells someone 15 times...that is the cops fault for being weak. He could have told her 7 times and would not have lost his job. I almost hate the weak cop more than the belligerent idiot.

    Not everyone walks around with my id i never have it i dont take anything but my phone when I leave my house i have zero need for it ever ppl always need a id but being disabled and a caregiver my caregiver does all my legal business including opening a bank account and renting a important

    My son was 12 and he was skateboarding on private property without permission my son gave the cop the correct information so the cop called me to pick him up. I asked the cop would you do me a favor and take him to the police station and lock him in a cell for an hour or so? The cop said, yes Mame I'd be happy to do that for you. 😂 My son never broke my skateboarding rules ever again.

      @randyo8516 neither of my sons have been arrested, had a car accident, got a woman pregnant until they were married, have always worked, and are respected among their peers. No that's great parenting.

      @@michellepfaff7072 your son also didn't need to Id himself. If he was asked to leave and he left that's all he needed to do. Locking up a 12 year old for skateboarding is insane.
      I think you committed child abuse by doing that.

    I don't like your title. This was not and won't become a bad cop. He seems like one of the 95% that let the bad 5% get away with stuff. You know what the bad ones look like from go. Itching for conflict. That isn't this guy and people like this don't turn good cops bad. Those cops were already bad guys.
