Would you handle the charge off the same way if the collection that is being reported is less than $600
If I don't file taxes because I'm on social security how would I be able to file a 1099c?
Will I be able to learn how to delete my current charge off and late payment of I join?
I'm certified as a paralegal and also a tax preparer for over 15 years. You're giving an impressive level of legal interpretation and strategy. I've never come across this level of reasoning in the credit repair world. I haven't see the proof of these arguments working but damn it's a solid position.

@@sebastianjackson507 No it all sounds great but it dont work I’ve used all these laws sent letters to the creditor and the credit reporting agency they never remove anything they just verify an confirm all the information. he sounds real great so its easy to buy is ebook that u can easy buy off a ebook site for $5 then say he has a book with letters and a whole course that value at 998 normally sells for 300 but he gonna give it to you today for only 47 and for today only . He just like the rest of these RUclips gurus

Would you suggest that we freeze the secondary reporting agencies. ie : Sagestream, etc. ???? Before sending letters

So I bought the do 4 self packet (thanks) in some of the letters they say include your social its showing like this xxx-xx-0000. Do I fill out my whole social or just last 4. And the addresses were a little off should I use the numbers I found online or the ones you have listed and with the charge off letter does this apply if the repo was 3or4 years ago and lastly do I have to include the part about the violation at the bottom im not sure if I wanna go that route but just asking. It appears that Daraine is misunderstanding the difference between charged-off debt and cancelled debt. Here’s my understanding after some quick exploration. With charged-off debt, the debtor is still liable for repayment of the charged-off debt. It is still debt, not income. With cancelled debt, the debtor is no longer liable to repay the debt. That is when it is considered income instead of debt. That is when the 1099-C form has to be filed if the cancelled amount is $600 or greater. So it seems that charged-off debt can be reported on the credit report and cancelled debt may not. Let me know if I understood that correctly.
Additionally, around the 12-min mark where he discussed exceptions to who must file Form 1099-C, he did not read the whole paragraph which detailed the amounts that were excluded. It did not completely contradict the previous paragraphs.
I have gotten over 300 charged off accounts deleted.
You just gotta do what works for you, or your clients! I know what works for us and that’s what we use! Maybe you found a different way! 🤷🏾

If your debt is not with the original grantor its a chargeoff. In other words citibank card that is trying to be collected by lvnv. Citi charged that debt after they bundled and sold it off to lVNV or anyother collection agency

What do you do if it’s not 600 or if you paid it because you knew nothing about credit and so you owe nothing but they are still reporting it as a c/o
An evaluation of how it’s being reported will be key in getting it deleted.
@@DaraineDelevante What about Webbank/finger hut & Jefferson capital collections? charge off been on my credit for 7years $ 995 an I never received no 1099-c, I can put my own letter together using the law…should I mail it in or dispute on credit Bureaus? An should I send the letter to both creditor an collections to have it deleted ?

I hired a credit repair company back in 2019 and had a Capital One acct from 2013. I got audited for 2019 by the IRS because Capital One had filed a 1099c in 2019 without my knowledge for that debt I “owed.” IRS considers this income and since I was unaware of this filing I obviously didn’t report and now “owe” that amt to the IRS.
Credit repair is illegal, you can get your money back

got a Charge off from dealing with CCBank in the $35K balance. I should have never bought the solar panels from Shine Solar/CC Bank. Am I to infer or understand that I may no longer have to deal with monthly payments?

It says “ unless 1637b of this title …..” specifications are following. Aka the statement notice mailed 21 days prior , etc.

Thank you for your service as a fellow vet. If there is a charge off but no 1099 was ever given and the alleged debt is within the SOL would I either (1) still challenge the consumer report about the 1099-c and/or (2) request a 1099-c with a medical/financial hardship letter to the creditor so they don't try and sue?

My charge off account was sold to collection agency. How do I go about it?
Hey!sorry to hear about your charge off account situation. It can be really frustrating dealing with collection agencies. Have you considered reaching out to your original creditor to see if there's any chance of resolving it directly? Sometimes they're more flexible than you might think.
@@DaraineDelevante I reached out to them and they advised that I contact the collection agency because they’re no longer responsible for the account but yet they’re reporting it as charged off 🤦🏾♀️
Hi and thank you for the gems you are sharing. Is it to late to stop a court ruling to make you pay for a debt that was charged off ? Also if the charge off was done in a different year do you back date the taxes or just use the 1099 c for the next tax year ?

For chargeoffs should you still receive bills from them with payment due dates after the account has closed? I received one today and every month since the acct was closed in July

Second question. If you have a charge off lower then 600 what do you do to get it off
You can request a 1099c. You need to send a charge off letter to the concerned consumer report agency

the answer is yes! if you look carefully it said charge over $600 they must send you the 1099c. if its charge off less than that amount just demand it from them.

1099-C : aren’t they only supposed file a 1099-C if the my CANCEL THE DEBT
Write offs and term charge off is a book function… but did the creditor forgive the debt, which is they cancel the debt…
This is a gray area, and im just asking because I believe that cancellation debt and charge off is a little different, they must actually cancel the debt…
But then again the term charge off must be changed to collection if they did not actually CANCEL THE DEBT….
I have to research this part
Them charging off the debt does not mean they cancelled the debt and then does not have to file a 1099-C….
