There are broadly 3 types of judicial system 1. Judge-based system (India, Pakistan, and almost all African countries) 2. Judge accompanied by lay judges. Lay judges come from civil society and usually have fixed terms, generally much shorter than a judge like 3-5 years (Italy, Germany, Japan, Norway, Taiwan, Sweden, China) 3. Jury system where for each case randomly jurors are selected from the society. (Eg Australia, Hongkong, USA, UK, France) Trends: # In most of the world including Russia, the UK and to some extent in the US, elites are trying to weaken the jury and bring as less cases before a jury as possible. In Norway, there was provision of jury in higher courts but now it is replaced with lay judges. # Japan has been a new entry that moved from judge judge-based system to a lay judges system. # China has a lay judge-based system which makes it more democratic than India as far as the judiciary is concerned. Although the lay judge system in China itself is less than perfect. # There is a trend. The more we move from System 1 to System 2 or 3, we find a more powerful/developed country. And the more random the jury, the better the results. # It is just not enough that there is the provision of a jury in a country but the nitty-gritty of the application should also be considered. Countries like Ukraine and Ghana have juries but either the jury is not random or cases brought before the jury are minimal. In Ukraine, a jury is selected from people who have already applied for the same and cases brought before the jury are also very less. In Ghana, the jury is entirely composed of civil servants only.
