Johnny Depp Flipped the Script With His Defamation Trial Victory
Social media, a nonsequestered jury and early dismissal were among the factors that led to the verdict in a Virginia court despite a ruling that went the opposite way in the U.K.
After 13 hours of deliberating, jurors deciding the fate of Johnny Depp’s defamation duel with Amber Heard announced that they had reached a verdict. Only there was one problem: They forgot to specify damages.
Judge Penney Azcarate told jurors to retire back to the deliberation room with no deadline on when to return. It could have taken an hour or another three days. After all, juries are given wide latitude on calculating damages, and there’s no formula to follow. They are not given a lot of guidance.
But only 15 minutes later, the jurors returned with a number. They awarded Depp $15 million in a verdict in favor of the actor on nearly all counts. Of the award, $5 million was in punitive damages aimed to punish Heard for especially reprehensible conduct and to deter similar conduct in the future (later reduced to $350,000 in accordance with the state’s statutory cap).
The decision stood in stark contrast with the result in Depp’s suit in the United Kingdom, where he lost a similar defamation case. One major difference that led to the reversal in Depp’s fortunes, said legal experts, is that his case was decided by a jury, unlike his trial overseas, which was decided by a judge.

In most civilized countries these texts will be privileged and ONLY THE CLIENT can waive privilege and NOT his lawyers or agents. I am really curious.

Part of the problem is that many people didn't watch the trial and their only source of info on the situation is what they've read in the awfully biased news articles.
These News Media outlets need to be held accountable for reporting on only the bits and pieces that supports the narrative they want to spread.

She said in the U.K. trial that when she said she made “payments”, that actually meant giving money to a friend. Donating means pledging. She’s not punching, she’s hitting or defending herself. She’s a pathological liar & so many words she said & so many recordings we listened to ‘meant something else.’ It’d be nice to see her pinned down with one of her lies without her weaseling her way out of it..

Both a pledge and a donation result in donors giving money or goods to a nonprofit. But the big difference between a donation and a pledge is the timing. A donation describes the immediate exchange of money or goods from a donor. A pledge is the promised exchange of money or goods from a donor.

It's absolutely crazy. What I heard was it would be hard for them to prove that she committed perjury. BUT they have all the evidence RECORDED, so what's the problem again?
Unfortunately it'd be more unusual if she did get charged with perjury - for some reason it's rarely prosecuted, and especially not when someone is testifying in their own defense and lies. So yeah basically you can get away with lying on the stand even if you get caught in your lies.
Perjury requires you to knowingly lie. It's so subjective that it's difficult to establish. And a narcissist like heard actually believes her lies are true.

Not trying to sound overly cynical. Lets face it we (men dating women) have dated or known someone who manipulates a man/men. There is a long history of women lying.. For someone to use that moment. Honestly it was all just a matter of time. When people push for "believe all women" deceivers will ultimately take advantage if they can when needed. I'm not saying all women are that horrible but we all know, that they are out there. The fact people stand behind her still show that, some lack critical thinking and that this will be repeated because some people aren't learning.
Why can’t this Lawyer of Ambers be stopped continuously calling Johnny an abuser , and bad mouthing him and his name . He has been cleared in a court of law. Yet she is still lying to whoever will listen to her. How can she be allowed to do a tour going on talk shows dragging his name all over again.

In the UK trial, Amber said she donated her divorce money to charity which played a big role in the outcome. Judge Mr Justice Nicol said "Her donation of the $7 million to charity is hardly the act one would expect of a gold digger,"

I signed it yesterday, this crap has to be exposed. People in a position of power must be held accountable. I would like to see this taken to the end because only half the job has been done. Johnny's name has to be cleared globally. The only thing that is going to shut her down is to be called out globally.

The judge overlooked her lies knowing they were untrue & accepted her evidence without proof & then went on to dismiss credible plaintiff witness testimony because he thought it to be untrue, talk about hypocrisy! The UK justice system is pathetic. My mother did jury duty in the UK and after all the deliberation and conclusions that the jury came to, the judge overruled everything. I think the case was about some guy breaking in to a friends house and stealing property, assaulting children, all the evidence was there, the jury decided he should be punished with time/ fines for the malice, harm, trauma, yet the judge decided “he’s young, let’s not ruin his life, he’s free to go”, the guy was in his 20’s. A judge in the UK can do that. You’re forced to sit through weeks of testimony and meetings and the judge essentially just says “hmm that’s an interesting conclusion this unbiased group have come up with after hours of their unpaid time, effort and energy, but they may as well have not showed up because I don’t give a sh*t, I have all the power, and today I feel like letting a criminal continue to torment their neighbourhood”. I’m a UK citizen and I thought our judiciary system here is just and unbiased. Hearing the questionable judgement done by the UK judge on the defamation case against The Sun was very disappointing to learn. I’ve signed the petition so that they will have the chance to correct their mistake

The most painful thing about all of this isn't that she hurt a famous person, who undoubtedly is much more famous then her, but that she used the women's cause. She not only hurt all women going through abuses daily but all men who go through the same abuse but feel they cannot speak out due to gender prejudice.

agreed. i’m tired of people acting like this isn’t going to have an effect on women. i’m already seeing it. people championing for other male celebs to sue the women they abused. actual abusers (not johnny) could see this case as a way to further abuse their own victims by suing for defamation when they haven’t even mentioned their abuser.

god i do hate this case. i believe parts of JD’s story (the physical abuse against him) and i also do believe parts of AH’s story (the verbal/emotional abuse) bc that was the only time her emotion felt genuine + her evidence backed up those claims more than anything.
i just wish she hadn’t lied about the physical abuse. the ramifications of that will be so long lasting.

She deliberately mislead everyone over everything and there was clear conflict of interest with that judge in the UK trial. For the sake of justice and on behalf of actual victims of abuse and charities as well this should be dealt with and not just swept under the rug. I know the people of the UK do not want to come off as unjust and corrupt over this case.

Weirdly enough almost nobody gets charged with perjury, famous or not. When is the last time you heard of a criminal being prosecuted for perjury when they lied on the stand testifying in their own defense? It just basically never happens at all.

As a uk resident and someone who has had to go through the legal system due to being a victim of domestic violence. I can say with no doubt In my mind that there is no justice in the uk and our legal system is completely broken and useless! Johnny’s case should definitely be reopened and that dodgy judge should be sacked!

Judge was chosen to sit on this trial BECAUSE he was about to retire and he was chosen to do a favour to Rupert Murdoch who has insane close ties to the British Establishment. it runs deep the corruption of this case.

he conveniently retired just before the appeal hearing, just after he refused jd the right to appeal, they need to go after this judge retired or not he was in a case which he should never of been aloud to call, his son works with the journalist who wrote the article, the lawyers were from his school and he even co-wrote a book with one of them, they can't let him get away with this

@@jamyDodger the property is in a trust in her accountant’s name. Someone told me famous people do it all the time. It’s so the accountant can handle the financing and pmts on their own while the actor is somewhere else. I’m not sure tho just what I was told. It does make some sense, I worked for Wells Fargo, we had the ability to look anyone’s mortgage up. It was really hard to find famous people bc their houses aren’t listed in their stage names, sometimes not in their name at all. I did get to see brad pits and will smiths but this was 20yrs ago. Their pmts were above what some make in a year.

Same in US. Your ability to win a case no longer hinges on the truth, it’s all about your social or economic status, and political affiliation. Our courts need completely cleaned out, Soros and crew have spent a lot of money and time putting their people in place. If you are conservative in the US you are pretty much screwed.

@@wesleysmith9593 I work as a lawyer in Macedonia and here it is the same, corruption flourishes, unfortunately as long as a judge decides, not the people, corruption will not be eradicated. Our judicial system and the judicial system in general in Europe is based on continental law, while in America Anglo-Saxon law is applied .. until this Anglo-Saxon model is applied in Europe, there will be no justice and rule of law until then.

Been saying this for weeks. She was called out on at least one of her SA stories in 2017, She also lied about the events in the rental where she threw glass bottles as a weapon in austrailia. She never should have written the Op-ed after the london trial, as this is all fallout from the trail of tales she began during the Sun-v-Depp trial.
I've just listened to audio Amber recorded after she took out the restraining order and then asked to meet him in San Francisco and recorded the conversation!!! The UK court got it so wrong and she should be brought back to the UK court!!

The U.K. Judge Nicol had a vested interest in the Heard Depp case, as his own Son worked for the Sun Newspaper and did not want him or his company to be discredited! Complete fix!
What I don't get is how that judge, in the UK trial, wasn't investigated as he clearly should have recused himself from the JD case due to the direct ties his son had with the author of the article from the Sun and the Sun itself.
And AH had links with his wife …at several social/charity dinners & photos of them talking together.
I note Mr Nichol retired immediately after this case (so escaping any action against him). I agree that it was outrageously unprofessional for him to undertake this case….with his links he was obviously unable to be open minded & unbiased ….just see his wording of decision…..Any professional judge, operating to their code of conduct should have recused themselves

Trial in UK was between him and a newspaper company. So only had to deal with certain things was not the same trial.

As a victim of physical abuse, Amber Heard is right in saying we believe victims. HOWEVER, we need to stop this guilty until proven innocent. In the US, the courts say innocent until proven guilty. And we need to acknowledge men can be victims as well, just like women can be abusers.
Amber is not a victim. Her loosing this case is not a setback for women. Hell, it's not even a setback! It's a step forward, showing that if you lie about someone simply to gain popularity, the truth will be found out and the liar will face consequences.

For me, the BIGGEST issue is the conflict of interest with the UK Judge, without regard to the people or the case involved. The Judge should be punished for not recusing themselves from the case due to multiple conflicts of interest. For the judge to get away with this is a direct attack on the whole court system.
I couldn't even say "me too " during its movement. The 1st time I spoke up about the fact that I'd experienced SA & DV in a public space was bc of Johnny.. With regard to Elaine claiming Johnny Depps team unduly influenced the jury is that reason to bring a case for defamation against her by his team and a bringing into question the integrity of the US justice system?
It was AH legal team that introduced all the hashtags into evidence. They literally told the jury what the internet was saying so I see no possibility of outside influence argument winning on appeal.
I wondered the same thing. She's essentially accusing them of a crime, suggesting they were watching social media and were influenced.

HI Andy & Daniel, the fact is the "pledge" vs. "donate" debacle is an issue that would be 100% completley negated if this case were to be appealed in the UK, bc she used neither one of these words, and MORE THAN ONCE. Under oath in UK she said she had donated in the past tense, and also on that talk show in the UK where she said "I wanted nothing" lol🙄- in that talk show she says verbatim "I gave half to the UCLA ,&
The other half went to the Children's Hospital of LA." She said donated and gave-those were the words she used 2 times. The pledge bs should be struck down aggressively as a complete non issue here, bc it was a new one she came up with over time obviously.

Thank you for highlighting the justice aspect of this. I as a domestic abuse therapist unfortunately also have witnessed countless times one partner is believed over another just because they are confident good liars. I have seen many use the court system to continue their abuse of their ex partner and children be used as part of that and harmed terribly. It needs to change. That’s why I’m so grateful for what this case exposed.

Totally agree. And, I’ve signed the petition. As a victim of DV, I feel the UK courts should allow the appeal. Heard has done such disservice to people like us, who genuinely suffered, this must be corrected.
This was an embarrassment to UK Justice system. And I believe that people in UK should push the reopening of the case. Because we saw US trial in real time and even though we are just ordinary people, we clearly see who is truthful and who is lying.
The only way Depp's appeal will be reopened is if his legal team makes a request to the Lord Chief Justice of England and Wales but even then it's extremely unlikely that it would happen. As BBB said, the alternative route here is for somebody to start a private prosecution against Heard for perverting the course of justice. If there's some meat on it then the CPS might take it over and turn it into a full blown criminal prosecution. Max sentence is 8 years if I recall.

In UK defamation trial it was JD vs Sun and not AH. The UK judge relied on AH's testimony on DV and DA without the requirement of any other witnesses and medical proof that bruises were real. Also the judge's son was in employment of Sun. It cannot be reopened but appealed on certain grounds.
I think that judge should be brought up on criminal charges. How is it not illegal for him to have overseen a case where his son was involved? America's pretty f__ked up but even that would come out here and the judge would be forced to give the case to someone else.
@@taylorbug9 Yup, the conflict of interests should have been declared and he should have stepped away from the case. That would have been the right and honourable thing to do. Obviously as we could see from the result doing anything honourable was the furthest thing from his mind.
@@taylorbug9 Its difficult to do anything to a judge when all around the world judges are held to the highest esteem within the system (old boys club) hence the title honourable. Even with undisputable facts of criminality the usual thing is to retire them or here in the UK install them in the house of lords.
Not only was the Judge's son working for the parent company that owns the The Sun, but apparently the Judge's wife does fundraisers with the wife of an executive of The Sun (possibly the chairman or CEO), so I'm sure the judge and this executive have ran into each other at one of these fundraiser. The evidence provided in the US should be given to the court in the UK and have the judge answer questions as to why he didn't look at any evidence that would have shown AH was lying.

No. Dan Wootton, one of the defendants in the UK case was executive editor of the Sun newspaper which is part of News Group. The Judge's son worked for Talk radio which is a separate division within News Group.

I think more awareness about narcissism or malignant people in general... will make it so that those with good looks won't be able to weaponize those looks anymore. It’s one of the only solid things ambers team uses now to defend her.
