      Wouldn’t the fact he was in a public lobby make a difference to the “expectation of privacy”. I’d understand if he was walking the halls and offices but he never went outside of the lobby area.

      Since that is a public lobby with no restricted access, hasn't it been ruled by the supreme court that there is zero expectation of privacy in a public setting?
      I question your part in the video that states where there is a reasonable expectation of privacy. The expectation of privacy is behind the glass and doors where the paperwork is handled. If I have access to the lobby and I see private information, it's the same as if I record private information. No filming policy on the door is not the law and therefore, it is not valid from what I can see and understand from our rights and laws.

      @@grkxkosta3396 I don't agree with this assessment. If the officers believe that the man is interfering with the publics reasonable expectation of privacy. You can't give him an a- and the others an f (other than the officer that refused to identify). It is up to the court to decide whether the officers were correct and they gave him the opportunity to leave willingly. He refused and was place under arrest and also resisted.
      It is not up to the administrator to rule on the legitimacy of his phone as an aid. If he thought the charge was invalid he he should have fought it in court.

    Refusing to identify themselves legitimized his need for recording interactions. As a blind person he has no other way to identify individuals who may refuse to identify themselves and assault or batter him or his property.

      @@dansmith5160 the devices he has were given to him by the VA to help him his injury caused him to have memory problems and as this video shows he can't see to describe or identify anyone. The devices also help him navigate and read he has videos of him showing how those functions work. Now as for recording in a hospital lobby there is no expectation of privacy as it is full of strangers if he had gone into the rooms different story. I see people in waiting rooms on there phones all the time and they could be recording in secret or just playing candy crush who knows. However the force used on him was beyond excessive and and even if it was someone who could see no one should be slammed to the ground like he was over a something so minor as this.

      @@dansmith5160 I saw the video the day it happened he never tried to go anywhere but that counter to ask his questions. He never approached other people waiting to record them. The reaction from these staff was like using dynamite to kill a house fly. This could have gone differently if the first guard had told him who he was because as we have the ability to see who is giving an order he doesn't and for all he knows it's just a random person trying to push him around. The video is a testament to why he records everything because had he not recorded this he would not be able to say who was involved because all he got was Leslie's first name and it's a common name and I can't recall if the captain identified himself but the other guard would never have been identified.

      @@dansmith5160 I'm not disagreeing with the fact there should be restrictions in certain places for people recording. Lobbies open to everyone are not one of those places in my opinion. I don't know how the hospital is laid out but the hospitals where I live have access doors that you need a key card to access for sensitive areas and only staff can open them so in those types of areas I say nope can't record here but in the video he is in the main lobby by the entrance you can see the main doors several feet away so in that area I would say ok this is not a special area. Maybe I see it different than others but that is my thought process on it. What are your thoughts?

      @@dansmith5160 Except this wasn't the hallway of a hospital. This was a public lobby of a health office. No expectation of privacy applies to this case. Staff and security were 100% in the wrong here, lets not detract from that, despite your feelings on the matter. We're talking about law enforcement, not feelings enforcement. No law was broken in this video.

      @@MickSkitz That's what Mr. Nelson said. There is no way to independently prove that outside of a lawsuit discovering the facts of the case. If/when Mr. Nelson files suit this will be undoubtedly explored further.

      @@purplepuffs2095 okay so he's a disabled veteran. Its like knocking an old guy over on the street, the actual injury isn't key here its the potential. Who do you think understands how much more force it would have taken for it to be life threatening.
      The answer is it was enough force to give him a bleed, therefore it was enough force to threaten his life. From the account that he was picked up outside they needed to call medics but they didn't want it called into the facility. Dodgy as hell.

      Recording as a party to a conversation, particularly recording of this nature, is pretty clearly assistive. An ordinary person has no obligation to forget what he sees in the course of his life, a blind man should have every right to share with somebody in confidence what a sighted man could see and remember, in order to restore that basic ability.

    I'm legally blind and I use the zoom function on my phone's camera to see things I need to see that I can't get close enough to such as signs, bulletin boards, fast food menus or items of interest that are in display cases. I have been yelled at, kicked out of places and one fast food employee even tried to physically take my phone from me (I also rely on my phone to help me navigate unfamiliar places, so losing it would have been bad). If it isn't to busy i'll even go out of my way to explain my situation to the staff and assure them that I'm not recording, or exactly what I want to record (usually a photo of a menu so that my phone pointing doesn't make people uncomfortable) and many businesses will still say "no!" but then won't even offer an alternative solution. It can be quite frustrating. Especially when I'm with other people and I can't just leave.
    Also, one time I was walking home at night from my friend's house and two dudes over 6 feet tall told me to go to them. I'm 5 feet tall and

      So sorry this happened/happens to you ☹🥺. I always think about people who may have impairments since I have a grandmother who has several needs although she can do for herself. So many people are so selfish and volatile towards each other based on assumptions. I started being more aware of others who might need help with reading something or a door held for them, etc. Even tho I live in a big city, I do my best to speak up for & help those in need.

      @@mamiminowknowsbest Thanks for doing that for people. I think with how fast technology is advancing, it is hard for people to keep up. Especially if it's in a field that doesn't normally concern them such as assistive technology for the disabled. So, when they see an unfamiliar piece of tech or someone using a piece of tech in an unfamiliar way, it reflexively makes them uneasy and defensive (this is often a useful reflex to have, because unfamiliar things have an unknown potential to harm and it's generally better to be safe than sorry). I try to remember that usually when someone has an adverse reaction to me or what I'm doing, it's usually because, in truth they are actually scared of something they don't understand. Most of the time patience and information can go a long way.

      @@zachcrawford5 that's unfortunate that you feel empathy for the "people" that have negative reactions to you, however they can't return or extend courtesy back to you 😔. That's why spreading awareness about these things can go a long way. Schools, universities, workplaces etc, should teach about visual impairments & other medical conditions just like American sign language. But even then it's only taught in some schools. We as a whole need to be more accepting of each other in so many more ways. 🤗

A reasonable explanation is that they were informing him that the policy existed and was in place before he entered the building, so that he didn't think that they were just making up rules on the spot. Don't simply assume your preferred conclusion. Maybe that conclusion is the correct one but to ignore other possibilities is to be unreasonable.

      I got one for you. Don't think that just because you're in a wheelchair that people will treat you the way the law is written. I got the treatment of a lifetime by two companies. MTM LLC and Amtrak. Amtrak took my wheelchair away and forced me to use my crutches that I used to transfer in and out of the wheelchair to stand for 6hrs they wouldn't even kick the people out of the handicap seating I was asualtted and threaten in a group of people for someone on the train smoking and I got assaulted on the tracks because my wheels kept getting stuck between the tracks and the cement so I was asualtted by a employee. As a handicap person it was my 1st train trip and my last trip on any public transportation the Airport treats you the same way. Just pray that you don't ever get injured and find yourself in our position because it's not what you think that you have rights.

    I've heard of quite a few blind people who record their daily interactions so they can show it to a significant other who can fill them in on what they missed. It's also a safety thing. So... Basically he uses a video camera as an aid for his disability. Therefore I'm pretty sure this is discrimination. 🤷🏼‍♀️

    If they have protected patient information that is covered by HIPAA that is visible and recordable from the lobby they are already in violation.

      Patients in a waiting room have their privacy protected. You couldn't possibly think it would be cool to audit in the waiting room of Planned Parenthood, for example.

      Thats just it, there should NEVER EVER be ANY patient information out in the open like that. It must be stored under lock and key at all times. And when carried around it must be covered in a enclosed file AT ALL TIMES so that patients Privacy and Confidentiality cannot be compromised. There is also a rule of thumb to not talk about any patients in open area's and in joint accomodation rooms. Talking about them to others that do need to know must be behind closed doors. If you need to talk with the patient, you tell them what you are about to do and then close the door with their permission and speak in private. So the HIPAA law actually shows it promotes laziness and incompetence and actually can be very easily cancelled in court.

      @@theghost6412 Well, you're talking about paperwork. I'm talking about recording the identities of people sitting in a waiting room. I have never been in a clinic where patient/client information was observable to the general public - hell, most of the time they won't even let the patient look at their own file...

    Untrained officers make me sad. When I was in Iraq I got trained on how to morally handle another person. I think cops need a lot more training.

      These were security guards, not cops. Kind of a big difference not to pick up for someone who has so much training. I've been deployed with the army multiple times as well. Not sure what unit you were with, but I never received any training on "morally handling someone". I received multitudes of training on when to engage, and our use of force policy. I was a combat medic for an Infantry team though, maybe they only taught morally handling people in intelligence? Or as a Chaplain?

      @@boom_911 The vast majority of "security" working in those facilities are LEOs...The "security" gig is their side job...Why??...Because even in a "security " capacity they still have the legal arrest powers of a LEO...Best example are bars..They hire cops to work security outside while the bouncers handle business inside...👍👍

      @@freejulianassange7278 Yes. Many places do hire cops. However, Law enforcement officers, when working side jobs, still wear uniforms identifying themselves as Law enforcement. They do not and cannot wear a uniform that displays them as security, as they are not security; even when hired for a security type position.
      Nor does any company want a leo to wear a security uniform. They are paying a lot more money to have actual cops instead of security. They want them in a police uniform.
      Again, these were security guards. Not law enforcement.

      To save money they hire contract security from an outside source. It saves them millions, and they get a break on insurance costs. I use to do security for a children's hospital. We were only paid 12 bucks an hour. It was minimal wage at the time. You were trained in fire, police tactics, how to deal with different people. How to deescalate situations. CPR first aid training. Police report writing, background investigations to make sure no one was on Megans law. Very strong access control. Sign in patients, and check them out of the system. You deal with the morgue a lot. It never made sense to me why the pay was so low. The valet people were making more. Every time we had a security meeting. They would try and distract the team by telling everyone how thankful they are to have everyone here. Thank is for our hard work. The security meeting would never go over security. It would always go over someone's personal life. How they met their wife, why i married her. My kids do this my kids do that etc. Every time staff would ask about a pay raise that wasn't on par with fast food. They would always circle jerk us. We are in discussions about the security budget. We are working on it to see what we can do. And they are the kind of dumb people wondering why 20 people a month were quitting. They wanted top flight security of the world Craig. Bit couldn't pay crap. I had enough after dealing with a woman threatening to commit suicide at the hospital. I wrote a letter telling them why im quitting. I told them straight out it made no ####### sense I can go to In And Put, most fast food places, cut grass, wash cars, deliver pizza and make double the money. They weren't having it. That pist them off. Attitude changed when I called them on their b.s. Also this security company wants 10 plus years of military experience just to do armed security at 16 bucks an hour. It use to be 15. Took them 6 years to go up a dollar. Allied Universal is a joke.

      @r3conwoo It's technically a citizen's arrest: "Under the Citizen's Arrest clause, private citizens and private police, such as security guards, have the power to arrest a person committing a crime...arrest must be reasonable, and security guard must have a probable cause to arrest an individual, such as witnessing the crime." Security guards can detain a person, turn them over to actual police & file a complaint on behalf of company they work for.

    The fact that anyone, let alone any type of law enforcement thought it would be ok to do that to a blind person is insane.
    The fact that the others aloud this to happen regardless of their frustration is pathetic.
    They should all be thrown in jail for what took place.

    I am a veteran and work for the VA. The treatmemt of this fellow veteran makes my blood boil. The VA should represent the veteran that was mistreated, abused, and assaulted.

      Sadly the VA doesn't help when these things happen to us Vets. I use to work for a contracting company of the VA and was assaulted, denied ADA accommodations to do my job, and was terrorized and physically attacked to the point where I ended up losing consciousness for several hours. The whole time this was happening I reported it to the VA and they told me to quit and deal with it. Also most lawyers I have tried to get help wont represent us because they doubt they could win, or ask for more money then the veteran has.

    You neglected to mention that the arresting officer (the guy who donned gloves) never identified himself when he spoke to and when he put hands on Mr. Nelson. Mr. Nelson repeatedly screams who are you, who are you, as he's being attacked by this officer. This was omitted from your video. Mr. Nelson was treated throughout this entire interaction as though he were sighted. His disability was ignored by everyone involved. Imagine someone you can't see gives you orders you believe violate your rights then grabs you and assaults you, never deigning to identify himself as a person of authority. This is a travesty and several of these folks should be held accountable, legally and civilly.

      The arresting Officer - Boyce (dubbed officer _creepy_ by subscribers due to an earlier interaction with BJ at the courthouse) did actually identify, though you could hardly hear it over BJ's screams. Consider that BJ suffers from severe PTSD, it is logical that this attack brought on an episode and BJ was likely unable to hear or react to verbal commands given by officer creepy at this time.

    You know what's crazy to me that I've noticed in all these vídeos? Everybody freaks out over being recorded by a civilan auditor but fail to realize that they're recorded literally everywhere the cameras on the streets, buildings,stores,everywhere in all reality we live in an open air prison monitored 24/7 even our phones track our every movement .

This has all happened so fast that I don't think anyone realizes what long-term issues might evolve from capturing peoples' existence and habits every second of the day. Cell phones are the worst, then (ahem) companies that store video and satellite footage of every known location on the planet, [gmail, hotmail, yahoo] email systems that log every keystroke you input into your email, smartphones that know who, what, and when you do things.... and I haven't even gotten into any non-civilian monitoring systems by Homeland Security, etc.

    My mother is completely blind and now in a wheelchair . I take her out all the time , we never ask but people will stop what their doing to help us ( hold a door open , push our shopping cart while I push the wheelchair ect. ) . Acts of kindness from total strangers that really help mom & me out . Then you have uniformed guards and a administrator harassing a blind vet with a body camera thats for his own protection . This is disgusting . Let anyone of them walk 20' in that mans shoes & see how it is to be blind . That pile of dung with the skulls on her shirt should be fired & send the uniforms packing to !!!

The security officers and building management that were involved in this committed serious criminal offenses and should have been charged and every one of them fired...     This guy literally has no idea who these people are. He might as well have been kidnapped by a street gang.
    He can't see the badge, and no one identified themselves as police officers throughout the entire encounter. All he knows is that he was kidnapped, beat to the ground, and sent to the hospital by a group of THUGS.
    If somebody tells me to leave a building, maybe it's just their problem. If I know it's a police officer, I'll know I'm not welcome and leave. This guy literally had no idea these guys were officers AT ALL since it wasn't mentioned once for the entire video, and he never felt their uniform, until he was beaten to the ground with handcuffs. This is horrific.

      When he asked who the guy he was talking to was he just said "you know who I am". Which is not specific at all.
      You can also imagine someone telling you "get out of the building or you'll be arrested" without the person actually being a police officer. For example, it could be a citizen, who then calls the police later trying to make due on their threat.

      ​@Jason Delp Well initially he was having a consensual conversation, and asking somebody for their name in a consensual conversation is common place. He then asked the officer ""who are you again" when he started getting into an argument and the guy said "you know who I am" and he responded "no I really don't". Any normal person would then identify themselves as an officer at that point, but he kept his cards to his chest. Later, the officer kept moving the mans camera away, which was absolutely uncalled for and rude. He hadn't even communicated about the issue of him recording in a public building yet, he just started man handling the camera, which was used as an assistive device.
      .
      It's not a technicality, it's what happened.
      Also, it's a public building, and trespassing laws are different in public facilities, especially if you have business there. If he didn't have business there, maybe the lady would have authority to kick him out, but getting forcefully removed from a building randomly by a swarm of people that you just realized weren't civilians the second their body is on top of you is NOT how that was suppose to go down, and threats from civilians are not the same as threats from police officers.
      He was also trying to get into contact with the ADA coordinator and was trying to communicate that the reason he has the recording equipment he has is because of his disability.

      it makes the pacing and escalation of the issue seem more fluid. In truth, the tackling was very abrupt and the conversational nature of the cops made it seem like he was talking to just an average joe, until it all came crashing down on him.
      In fact, this was cut to show the important sound bites of a 30 minute interaction. Him and the first cop were just having a chat. Unless you could see his uniform the interaction and conversation with the first officer made it feel like he is just talking with another guy in the waiting room.

      Dude had a fucking brain hemorrhage. Not exactly the same, but there's something I believe called "eggshell skull" which basically means, if someone has some kind of condition that, for example, makes their bones very brittle and easy to break, and you accidentally cause a ton of excessive harm to them unexpectedly, because the person just assumes everyone is the same and can take some degree of roughness or whatever, but that shit isn't always the case. But back to eggshell skull, the offender remains completely responsible for any injuries caused, regardless of if it was unexpected or however easily it happened.
      Another example I've heard of is someone having a weak heart, and being roughed up, or even merely scared/startled, that person is fully responsible for the other having a heart attack or even dying, or whatever is the case. I don't feel like enough people know this, and REALLY, REALLY should.
      Dossnr apply/fit 100% here, but just reminded me of it. People need to be careful, never know how fragile someone may be.

      The officers need to be held individually accountable for his damages here, not the city where they'll just get a slap on the wrist and continue their business.
      Robertson should be fired immediately for abuse of power from saying that a citizen was violating "his law", as well as attempting to turn the camera around hoping that blind justice wouldn't notice (thereby taking advantage of a disabled individual's handicap), as well as refusal to identify. That's 3 strikes in just one encounter. Who knows how many other times he's abused his authority if he will do it when he thinks he can take advantage of a disabled person.
      Blind justice has had interactions with the captain before, and as I understood it, it went positive. Here however, captain daugherty and the other officer both should be put on unpaid leave at the very least. They assaulted a blind man by pushing him to the ground in order to arrest him. The human body has only 3 ways of comprehending distance - sound (which wouldn't be applicable here), vision, and touch. With blind justices vision being impaired, he would only be able to rely on touch to tell the distance to the ground as the officers forced him down, and even then that is unreliable as the head will still continue its motion even if he were able to successfully find the ground with his hand in time to lessen the impact (an event that is unlikely considering the officers were attempting to control him to the ground). This was absolute negligence at the very least on the officers part. At the BARE minimum they should be forced onto unpaid leave while they are trained on proper interactions with the disabled.

    The burden of “sensitive information” that could be video recorded falls on the office, organization, staff that has the responsibility of keeping the info from being able to be recorded.
    They can’t leave someone’s info on a counter out in the open to be viewed or it is them that should be penalized or prosecuted , not the person with the camera walking in a public access area.
    I was a NC DMV dealer and we were trained that it is a $10k fine if a persons personal info is left in a manner that it can be viewed by another customer.
    I couldn’t threaten the customer with video recording where there was “sensitive info”..... it’s ridiculous and it’s more of the same, laws only apply to the citizens.......... I’d sue and I’d win!!!

    Recording devices are permitted in the common or public areas of medical facilities. HIPAA prohibits recording devices in the exam rooms/treatment rooms/bathrooms/changing rooms, where there is a reasonable expectation of privacy. There is no expectation of privacy in a hallway or foyer (which is where this encounter transpired.)

    That is a true monster and the officer by law has to identify himself. I've been upset over some behavior but kept saying when the gentlemen would ask his badge number no well you can't see. This was actually a disgrace to make his disability used against him.
