It's rare for police to shoot innocent people, and when they do, they do everything in their power to make it up. There are VERY few dirty cops in the U.S. Police Force, and I've known dozens of cops who were FANTASTIC people. Most police go into the career with the intent to protect and help, not to kill and steal drugs. The few that do, are idiots, since that is FAR easier to do in a gang. Police really are good people. You're right. I should have said it was not premeditated. It was not planned far ahead of time. And I am somewhat thinking that he had intent to get him killed based on the call that was made and how it all played out with the guy walking right up to the door.
KfC it depends on if they charge the initial act of swatting as a felony. If so he will get charged with felony murder which is a law that states if you commit a felony and some one is killed regardless of intent it’s murder. Felony murder is the same as first degree murder in most states. I’m pretty sure Kansas has a felony murder law on the books. If they charge the call itself as a dangerous felony any resulting deaths can be charged as felony murder. This case may in fact go to the Supreme Court and set precedents on swatting resulting in death. He could also be charged as felony murder under federal law as the act of calling was interstate.
KfC that’s not true at all. If you commit a felony and as a result somebody dies that is felony murder. For example if you lead police on a high speed chase and as a result of that the cops run over a pedestrian that is felony murder. If you are robbing a house and the owner shoots your buddy and kills him that is felony murder. That’s the law it happens all the time. Look at the Blake Layman case or the Elizabeth Rodriquez case. These laws basically are under the premise that when you commit a felony you are responsible for the outcome regardless of intent. They started out as a way to punish everyone in say a armed robbery where one subject kills somebody but the way they are written has allowed them to be used in cases where any death occurs regardless of intent. The convictions have been upheld multiple times by appeals courts all over the country and in 47 states including Kansas and California that is the law. That’s why doing something stupid can cost you the rest of your life behind bars even though you never actually committed an act that directly caused death.

50 year MINMUM even if there isn't any casualties. Things like this should not be taken lightly. It's a waste of government resources (officers, vehicles, weapons) and attempted murder. Swatters deserve to learn their consequences in the hardest way possible. It could also prevent future swattings.

It could even be something as simple as making a database of all current streamers especially verified streamers and send their phone numbers to their local department and whenever a call comes the police can contact the streamer to see what he’s doing

You're right. I should have said it was not premeditated. It was not planned far ahead of time. And I am somewhat thinking that he had intent to get him killed based on the call that was made and how it all played out with the guy walking right up to the door.

KfC it depends on if they charge the initial act of swatting as a felony. If so he will get charged with felony murder which is a law that states if you commit a felony and some one is killed regardless of intent it’s murder. Felony murder is the same as first degree murder in most states. I’m pretty sure Kansas has a felony murder law on the books. If they charge the call itself as a dangerous felony any resulting deaths can be charged as felony murder. This case may in fact go to the Supreme Court and set precedents on swatting resulting in death. He could also be charged as felony murder under federal law as the act of calling was interstate.
KfC that’s not true at all. If you commit a felony and as a result somebody dies that is felony murder. For example if you lead police on a high speed chase and as a result of that the cops run over a pedestrian that is felony murder. If you are robbing a house and the owner shoots your buddy and kills him that is felony murder. That’s the law it happens all the time. Look at the Blake Layman case or the Elizabeth Rodriquez case. These laws basically are under the premise that when you commit a felony you are responsible for the outcome regardless of intent. They started out as a way to punish everyone in say a armed robbery where one subject kills somebody but the way they are written has allowed them to be used in cases where any death occurs regardless of intent. The convictions have been upheld multiple times by appeals courts all over the country and in 47 states including Kansas and California that is the law. That’s why doing something stupid can cost you the rest of your life behind bars even though you never actually committed an act that directly caused death.

They don’t realize the impact it has on people. I think the change has to be awareness and punishment. Some people just need to know, but others don’t care.
