That's a great idea if being drunk causes crashes. But it's carelessness that sometimes manifests as drunk and sometimes distraction of various sorts. It's about not taking one's responsibility as seriously as required to prevent killing or maiming others. We should stop deflecting and punish the individual whose action has harmed others -- in the same proportion to the harm they caused. That's how it would go if we were truly serious about making people more responsible and really reducing senseless accidents. But we won't because we're afraid it could happen to us and we don't want to have to pay the price. But we can control our drinking and driving so we'll just pretend we're serious by focusing on that.

For example: Someone gets rear ended but has been drinking. The offender is sober. The person rear ended is at fault. I don’t make the law. I’m just asking if the “victim” was intoxicated and if she was not, is there a possibility that this accident might have been avoided?
I think laws like that are because if someone is over the limit they are not supposed to be on the road. The same way with driving without insurance puts them at fault.
