I've went from watching Johnny Depp's legal team to Gwyneth Paltrow's legal team and it is like night and day. It goes to show, some people are good at their job and some are not.

@Common Sense : I am sorry to hear that, Meningitis of any cause is a very nasty infection. (Not in the sense of "yikes", but in the sense of "this is really, really very serious shi*e" of course...) I hope you are doing ok and the struggles of the BI get easier to handle or respond to treatment. I wish you the best ! As a former nurse I can to a small part imagine how easy it is to miss it at first- GP's aren't always used to think of something highly contagious and fast progressing ( like the real influenza can also cause tiny spotted skin haematoma as it can meningitis) , but then it is already time to take cultuees and send the one to a hospital ... And when it's obvious , it's time to call in all specialties to work together, because at one point it can progress so fast. (I am sorry , as soon as I read medical histories or symptoms , my experience and fitst of all interest to learn and research kicks in and my brain goes on autopilot and I go down another rabbithole...)

My dramatic family likes to say that they were burning linens and mattresses out front while the cdc came in and built tents over the house like in ET.. but they love to add nonsense drama to the actual drama otherwise ick life is way to hard! 😁 The one silver lining I’m looking so forward to is that this year I’ll be getting my mobility support service dog and I’m SOO hopeful that with his/her(dunno yet)help I want to get stronger and walk more. Thank you for being a healer. One time I relapsed and had to be shipped back to hospital from rehab I don’t know exactly what happened but I do know that there was a nurse who held me as I cried I was in such agony and fear and I completely thought she was my mom. I found out later it wasn’t her and over time I finally went back to rehab and found her. She said “oh yes you did call me mom. It was my privilege “ ⛅️ she said. Honest to God angels set upon this earth with the rest of us🥰
I would have loved to have seen Gwyneth's body language whilst her lawyer was doing the opening statement because I couldn't believe how messy he presented the case

It's so bizarre. If I was being sued for 3 million I'd get the best possible. She has money to get good ones. I don't understand why she picked him. All the lawyers are weird. Like they all just dropped acid. Strange
I immediately became a better person and communicator after I heard the saying “two things can be true at once”. It opened my opens. So simple but so important.
Well yes but do not confuse differing views as being differing truths because there often is one true thing. For example as proved by the verdict, Gwyneth was truthful where as Sanderson was fabricating nonsense over and over. He may have felt that was what was the truth or maybe just wanted money or maybe is suffering from such severe brain mass loss that he no longer has any perception of reality. But there is only one true way the accident happened and the consequences to his life due to the accident are minimal but due to age
of all the televised trials in the last few years . . . I've never seen a group of more incompetent legal reps than both sides of this case. Really makes you think about how important it is to obtain competent, effective counsel. It can arguably make or break your case. Thanks so much for putting this together . . and including Rob. I was curious at several points in the trial what you would say about 'this' or 'that'. Anxious to see your next episode once the defendant has concluded her testimony.
They aren't experienced trial lawyers. They usually settle out of court and are used to taking depositions not cross-examination or making objections. Civil not criminal.

Out of nearly every textbook of witness' testimony: "I heard a bang, I turned my head and saw the crash". The crash occurred BEFORE they turned their head. They report what they think had happened or what they were told had happend.
Actually, no he said he heard a yell. Perhaps meaning Gwyneth was yelling at the last moment BEFORE the actual crash. I think most of us would instinctively yell something to warn a person if we realized we were about to crash into them at any speed. Or if we realized that someone was about to crash into us. So very possible for him to hear a yell from someone, look over and then see the actual crash. The problem is while he may have seen who it was that slammed into whom, by what that implied is that he didn't see what lead up to that. Perhaps was the Dr. at fault for somehow trying to pass Gwyneth thinking he was going faster and could take her "lane"? Or was perhaps Gwyneth at fault for not paying attention to any other skiers as implied? The thing is just based on their attitude towards everything, Gwyneth, the Dr., and even the witness, I tend to find Gwyneth's attitude the most troubling. Like this mess, including any injuries that the Dr. might have had, have NOTHING to do with her. Yet she was there and undoubtedly involved in some way. If she skis with the same attitude, I can well understand that she would cause an accident, and that anybody involved would be upset with her enough to sue.
When GP lawyer cross examined her, he seemed so unprepared, almost like he had no idea what to ask her. It’s weird because he’s probably getting paid the big bucks.
It might be understandable if he was a young lawyer, and this was his first trial, but he has to have had some experience. It's bizarre that he's having so much trouble.
I LOVED Rob's analysis of the Depp v Heard trial and evidence. There was a lot I wished his lawyers would have used in the trial but Johnny's case was strong
Super glad to see you and Rob did this analysis! This case has been a bit annoying for me to watch. His legal team doesn’t seem up to par and it’s painful to see their disorganization. I have never cared her, I feel she’s very pompous, so I recognize my bias. Her lead attorney just rubs me the wrong way and it’s not because of just one or two things. He’s rude and arrogant. I think it makes sense why she chose this legal team.

This is the best analysis the two of you have made so far, and that is saying a lot! What a power house combo! The way you can play off each other and all the combined expertise is a dream situation for 99,9999% of behavior analysts on RUclips! (Who the exception might be beats me, I have never yet come across them!) In the movie anatomy of a murder, there's a scene where James Stewart makes a subjective statement and the judge objects it and then turns to the jury and tells them to disregard that statement. And James Stewart goes back to his seat next to the defendant and the defendant asks "how is the jury supposed to disregard what they've already heard?" and James Stewart says "they can't..... they can't"
I was thinking the same thing and my first assumption was that he knew what he was doing and tried to play dumb or innocent. He wanted the jury to hear what he really thinks because they can’t unhear it now going forward.
Very true. My lawyer submitted pictures to the judge that she knew weren’t going to be allowed but she said the same thing, the judge will open the file and see those pictures and then say that he isn’t allowing them but he had already seen them. We won the case.

There’s a lot about GP’s lawyer that I don’t trust or appreciate. He’s looking down his nose and believing he’s smarter than the rest. Smarmy worked for me. He doesn’t do Gwyneth any favors, even if he had good points at the heart of all the needless commenting and sarcasm. Another great team up with Rob, Spidey!👍

I tried to wait until I could watch it on a big screen, to catch all the details, but ended up just taking off my glasses and holding my phone right in front of my face. My ability to keep paying attention and be content to just passively watch instead of indulging my ADHD habit of physically engaging with something else to enable full attention on listening. The low frequency of such experiences in my decades of life is a testament to the extreme quality of this video.

6:18 I also noticed there wasn’t as much room around Paltrow once everyone was standing and she’s shoved next to all those boxes. It could’ve been she didn’t feel comfortable getting up, but I agree it could’ve been oblivious too. The judge did say to introduce the attorneys. Her attorney should have told her to stand prior to going in.
I've also seen her take heat for stretching out her legs during court on side of desk. As a 5'10 woman I can attest it is extremely uncomfortable sitting at these low desks. This wasn't boredom, I garuntee it was avoiding pain.
I think it’s more of a weirdness on the lawyers part than on hers. I wouldn’t know to stand up or not…her lawyer either told her not to stand, or neglected to tell her that she should. If he forgot to instruct her beforehand, he could have said “This is my client, Gwyneth Paltrow. Stand up here with us, Gwyneth” I cannot imagine a scenario where he told her she should stand up with the rest of them and she said “No, I refuse to stand, regardless of how disrespectful it might seem” She may be privileged and out of touch with regular people, but she’s not stupid. She’s not gonna tank her case deliberately. The lawyers on both sides are like law students in their first mock trial, it’s freaking weird.

I watched over & over because neither your nor Rob mentioned it so I thought I was wrong. @41:52 he says they were "going down the bend" glanced at counsel and quickly changed it to "down the run." I think that's why he stumbled and kept saying this, this, this. There's something he's omitted . Also, he heard A scream and THEN looked over and saw the slam. I'd like to know who screamed? 🤔
She GP screamed when she realized she was going to crash into the guy. She was looking uphill at her kid and then when she reoriented her head forward she screamed which (TS) said “ she roared”. A scream proceeds the crash because she knew she couldn’t stop or avoid him.

To add, I considered their behavior to be nervousness &/or they are attempting to give the media & viewers a good show.

Can't you see how injured she is from the skiing accident? She isn't standing because she CAN'T! In addition to the loss of functioning in her legs, I heard she sustained permanent paralysis to her face! Poor, poor dear thing 😢

It would be great to have a physics expert where they can address the two scenarios explaining the type of collision, the motion of bodies and possible injuries that can be caused due to that collision taking into account the mass and possible velocity of the bodies.
The plaintiff had one expert, the bald guy with the green screen behind him. He seems like he had the goods until he stated that he used Terry's Witnesses account of the accident to reconstruct it. Then he talked about Force (Lawyer), "That's a physics term. yuck yuck" Then he admitted he didn't know the slope of the Run they were on... ( slope also being a physics term) Then the lawyer put a scrap of paper on the screen with fancy equations on it that nobody explained. I'd be more interested in finding that GoPro footage.

I was completely on the plaintiffs side... Till his 2 daughters testified. Now I'm not so sure. Also the attorneys are just bad; I think one of them gave their closing as an opening...
That is the part that makes me think he was downhill and she hit him, but testimony so far has shifted my opinion from thinking she's at fault to I have no idea
@@LawNerdAmber It's a puzzle to be sure. I still think if they hit that hard, for him to have the injuries he claims, she should have had some injuries as well. This just doesn't add up.
@@LawNerdAmber agreed. Taking all personalities out of it, basic physics would seem to indicate the person on the bottom (underneath) was the buffer from the person who hit them from behind. Hitting the ground first wld give one broken ribs, so it makes sense HE was downhill & she hit him (& he hit the ground). I think she wasn't hurt because his body buffered her from the ground.

@@CrazyMomma007 "Basic physics" should take into account rotational motion. Two things could have happened. The person being hit could have flinched and tucked inward, changing the position. Or it was a weird angle of impact and the two started spinning. This is to say that the person hitting could still end up at the bottom. He was also heavier than her. I've seen other commentators suggest that the skis could have impacted the collision.
This was so impressive! You guys helped me understand what I was seeing so much better. Seeing you together is so fabulous, I love it! I feel this was a no fault accident...they most likely ran into each other more laterally.

Ironically, if I recall correctly, Camille Vasquez read a script for Depp's closing arguments. However, she did it quite well. Not stumbling or seemingly losing attention of the audience; she was more engaging and displayed emotions. It was also well-written.
I learned in high school to use just bullet points for a presentation. It flows much better and you can look at the audience . How is that so difficult?

The defense attorney at this point is detrimental to his clients case. With all his off putting remarks and creepy body language/movements he could quickly loose this case. I suspect Owens, GP lawyer, has more experience out-of-court than he does in court. It shows. My overall impression of Owen is that he's a Schnauzer... a Schnauzer that smells a rat.
This is a civil case, therefore these attorneys were selected and hired by each party. It is only for criminal cases that you are entitled to be "appointed" an attorney (public defender) to defend you if you can't afford one.
@@dianad3080 It's possible that the insurance companies that are paying for these lawyers had some input in who was selected. "J. D. - a Lawyer Explains" speculated that the plaintiffs 'lady lawyer' was most likely hired by his insurance Co to defend him.
Not to mention her clothing choice. It's perfect for running errands, but not very professional or respectful looking for court. Everyone else is dressed in business attire , she looks like she's on her way to coffee at Starbucks. More importantly she's saying with her clothing choice that this is a trivial matter to her. I would never show up to court like that.
Yes, I agree. With her cash, her attorney's likely have some good jury consultants on retainer, and one of the first things they look at is how the defendant is 'presented'. Meaning the power of the right wardrobe and affect. Geesh, you'd think an actress would get that.

As a former nurse I can to a small part imagine how easy it is to miss it at first-
GP's aren't always used to think of something highly contagious and fast progressing ( like the real influenza can also cause tiny spotted skin haematoma as it can meningitis) , but then it is already time to take cultuees and send the one to a hospital ...
And when it's obvious , it's time to call in all specialties to work together, because at one point it can progress so fast.
(I am sorry , as soon as I read medical histories or symptoms , my experience and fitst of all interest to learn and research kicks in and my brain goes on autopilot and I go down another rabbithole...)

Yes it’s a batbleep crazy thing to have had. My dramatic family likes to say that they were burning linens and mattresses out front while the cdc came in and built tents over the house like in ET.. but they love to add nonsense drama to the actual drama otherwise ick life is way to hard! 😁
The one silver lining I’m looking so forward to is that this year I’ll be getting my mobility support service dog and I’m SOO hopeful that with his/her(dunno yet)help I want to get stronger and walk more.
Thank you for being a healer. One time I relapsed and had to be shipped back to hospital from rehab I don’t know exactly what happened but I do know that there was a nurse who held me as I cried I was in such agony and fear and I completely thought she was my mom. I found out later it wasn’t her and over time I finally went back to rehab and found her. She said “oh yes you did call me mom. It was my privilege “ ⛅️ she said.
Honest to God angels set upon this earth with the rest of us🥰

Well yes but do not confuse differing views as being differing truths because there often is one true thing. For example as proved by the verdict, Gwyneth was truthful where as Sanderson was fabricating nonsense over and over. He may have felt that was what was the truth or maybe just wanted money or maybe is suffering from such severe brain mass loss that he no longer has any perception of reality.
But there is only one true way the accident happened and the consequences to his life due to the accident are minimal but due to age
of all the televised trials in the last few years . . . I've never seen a group of more incompetent legal reps than both sides of this case. Really makes you think about how important it is to obtain competent, effective counsel. It can arguably make or break your case. Thanks so much for putting this together . . and including Rob. I was curious at several points in the trial what you would say about 'this' or 'that'. Anxious to see your next episode once the defendant has concluded her testimony.

They aren't experienced trial lawyers. They usually settle out of court and are used to
taking depositions not cross-examination or making objections. Civil not criminal.

Out of nearly every textbook of witness' testimony: "I heard a bang, I turned my head and saw the crash". The crash occurred BEFORE they turned their head. They report what they think had happened or what they were told had happend.

Yup, exactly. There were a number of things that we're off about this guy's testimony. I just didn't buy it the way he was selling it.

Actually, no he said he heard a yell. Perhaps meaning Gwyneth was yelling at the last moment BEFORE the actual crash. I think most of us would instinctively yell something to warn a person if we realized we were about to crash into them at any speed. Or if we realized that someone was about to crash into us. So very possible for him to hear a yell from someone, look over and then see the actual crash. The problem is while he may have seen who it was that slammed into whom, by what that implied is that he didn't see what lead up to that. Perhaps was the Dr. at fault for somehow trying to pass Gwyneth thinking he was going faster and could take her "lane"? Or was perhaps Gwyneth at fault for not paying attention to any other skiers as implied?
The thing is just based on their attitude towards everything, Gwyneth, the Dr., and even the witness, I tend to find Gwyneth's attitude the most troubling. Like this mess, including any injuries that the Dr. might have had, have NOTHING to do with her. Yet she was there and undoubtedly involved in some way. If she skis with the same attitude, I can well understand that she would cause an accident, and that anybody involved would be upset with her enough to sue.

Super glad to see you and Rob did this analysis! This case has been a bit annoying for me to watch. His legal team doesn’t seem up to par and it’s painful to see their disorganization. I have never cared her, I feel she’s very pompous, so I recognize my bias. Her lead attorney just rubs me the wrong way and it’s not because of just one or two things. He’s rude and arrogant. I think it makes sense why she chose this legal team.

My immediate reaction to seeing Ian spelled Jan was: Scandinavian, but the last name flew me to the city where I went through an intensive recruitment session for Hilton Hotels many, many years ago. Didn't get the job and had already cried my way from one end of Schiphol to the extreme opposite in less than 14 minutes, but still harbour no negative feelings towards this corner of three worlds.

In the movie anatomy of a murder, there's a scene where James Stewart makes a subjective statement and the judge objects it and then turns to the jury and tells them to disregard that statement. And James Stewart goes back to his seat next to the defendant and the defendant asks "how is the jury supposed to disregard what they've already heard?" and James Stewart says "they can't..... they can't"

I was thinking the same thing and my first assumption was that he knew what he was doing and tried to play dumb or innocent. He wanted the jury to hear what he really thinks because they can’t unhear it now going forward.
Very true. My lawyer submitted pictures to the judge that she knew weren’t going to be allowed but she said the same thing, the judge will open the file and see those pictures and then say that he isn’t allowing them but he had already seen them.
We won the case.

There’s a lot about GP’s lawyer that I don’t trust or appreciate. He’s looking down his nose and believing he’s smarter than the rest. Smarmy worked for me. I tried to wait until I could watch it on a big screen, to catch all the details, but ended up just taking off my glasses and holding my phone right in front of my face. My ability to keep paying attention and be content to just passively watch instead of indulging my ADHD habit of physically engaging with something else to enable full attention on listening. The low frequency of such experiences in my decades of life is a testament to the extreme quality of this video.

6:18 I also noticed there wasn’t as much room around Paltrow once everyone was standing and she’s shoved next to all those boxes. It could’ve been she didn’t feel comfortable getting up, but I agree it could’ve been oblivious too. The judge did say to introduce the attorneys. Her attorney should have told her to stand prior to going in.
I've also seen her take heat for stretching out her legs during court on side of desk. As a 5'10 woman I can attest it is extremely uncomfortable sitting at these low desks. This wasn't boredom, I garuntee it was avoiding pain.
I think it’s more of a weirdness on the lawyers part than on hers. I wouldn’t know to stand up or not…her lawyer either told her not to stand, or neglected to tell her that she should.
If he forgot to instruct her beforehand, he could have said “This is my client, Gwyneth Paltrow. Stand up here with us, Gwyneth”
I cannot imagine a scenario where he told her she should stand up with the rest of them and she said “No, I refuse to stand, regardless of how disrespectful it might seem”

I watched over & over because neither your nor Rob mentioned it so I thought I was wrong. @41:52 he says they were "going down the bend" glanced at counsel and quickly changed it to "down the run." I think that's why he stumbled and kept saying this, this, this. There's something he's omitted . Also, he heard A scream and THEN looked over and saw the slam. I'd like to know who screamed? 🤔

She GP screamed when she realized she was going to crash into the guy. She was looking uphill at her kid and then when she reoriented her head forward she screamed which (TS) said “ she roared”. A scream proceeds the crash because she knew she couldn’t stop or avoid him.

Certainly, it came across as they were aloof & not concerned regarding the jury's perception. Attys in this case crack me up. Kristen Vanorman's demeanor, tone, & choice of words share a lot more than she realizes. To add, I considered their behavior to be nervousness &/or they are attempting to give the media & viewers a good show.
I want your impressions of GP calling the TS female attorney by her first name, being all friendly, then when the atty upsets her, GP calls her “miss”. That spoke volumes to me -

@KarensOpinionsMayDiffer Yes, I'm assuming you mean the second daughter to testify, Shae. Although both of them were a little bizarre. The plaintiff's lawyer, Foghorn Leghorn, had some real bloopers, too. But I can't wait until they get to the 'lady lawyer' that questioned GP. She tops them all!😅
It would be great to have a physics expert where they can address the two scenarios explaining the type of collision, the motion of bodies and possible injuries that can be caused due to that collision taking into account the mass and possible velocity of the bodies.
The plaintiff had one expert, the bald guy with the green screen behind him. He seems like he had the goods until he stated that he used Terry's Witnesses account of the accident to reconstruct it. Then he talked about Force (Lawyer), "That's a physics term. yuck yuck" Then he admitted he didn't know the slope of the Run they were on... ( slope also being a physics term) Then the lawyer put a scrap of paper on the screen with fancy equations on it that nobody explained. I'd be more interested in finding that GoPro footage.

I am still not understanding how he was hurt as badly by their "collision" and she wasn't hurt at all.
That is the part that makes me think he was downhill and she hit him, but testimony so far has shifted my opinion from thinking she's at fault to I have no idea
@@LawNerdAmber It's a puzzle to be sure. I still think if they hit that hard, for him to have the injuries he claims, she should have had some injuries as well. This just doesn't add up.
@@LawNerdAmber agreed. Taking all personalities out of it, basic physics would seem to indicate the person on the bottom (underneath) was the buffer from the person who hit them from behind. Hitting the ground first wld give one broken ribs, so it makes sense HE was downhill & she hit him (& he hit the ground). I think she wasn't hurt because his body buffered her from the ground.
@@CrazyMomma007 Exactly! Spot On! It gets even worse when GP claims in her testimony that she was "hit" ...slowly ...she makes a point of it and likens it to a sexual assault or groping! How would a slow collision knock anyone to the ground ...either one of them?
@@CrazyMomma007 "Basic physics" should take into account rotational motion. Two things could have happened. The person being hit could have flinched and tucked inward, changing the position. Or it was a weird angle of impact and the two started spinning. This is to say that the person hitting could still end up at the bottom. He was also heavier than her.
I've seen other commentators suggest that the skis could have impacted the collision.

Ironically, if I recall correctly, Camille Vasquez read a script for Depp's closing arguments. However, she did it quite well. Not stumbling or seemingly losing attention of the audience; she was more engaging and displayed emotions. It was also well-written.

I learned in high school to use just bullet points for a presentation. It flows much better and you can look at the audience . How is that so difficult?
What a fantastic analysis! You've hooked me with your detailed observations. A new sunsriber. Thank you both Spikey and Rob. This team approach is great. The defense attorney at this point is detrimental to his clients case. With all his off putting remarks and creepy body language/movements he could quickly loose this case. But later videos showed he's better on cross.

This is a civil case, therefore these attorneys were selected and hired by each party. It is only for criminal cases that you are entitled to be "appointed" an attorney (public defender) to defend you if you can't afford one.
@@dianad3080 It's possible that the insurance companies that are paying for these lawyers had some input in who was selected. "J. D. - a Lawyer Explains" speculated that the plaintiffs 'lady lawyer' was most likely hired by his insurance Co to defend him.
I really enjoy watching Rob & Spidey together. It feels very natural and the joint knowledge is so informative. Great video.
Not to mention her clothing choice. It's perfect for running errands, but not very professional or respectful looking for court. Everyone else is dressed in business attire , she looks like she's on her way to coffee at Starbucks. More importantly she's saying with her clothing choice that this is a trivial matter to her. I would never show up to court like that.

Yes, I agree. With her cash, her attorney's likely have some good jury consultants on retainer, and one of the first things they look at is how the defendant is 'presented'. Meaning the power of the right wardrobe and affect. Geesh, you'd think an actress would get that.
