I lived in a ski resort for 10 years and skied and boarded almost every day in the season. The number of times I've been hit by people and rogue equipment is astounding. If I sued every single person I'd be a gazillionaire.
She was perpaexlingly absurd and clownish. It's hard to fathom such a person exists actually. And in great contrast to the elegance of GP. It's almost like a staged comedy. And that suit is too big as she storms around in clunky shoes. What is going on!?? LOL
If you’re being sued by someone who you clearly say was their fault and have to pay a lawyer to defend yourself then you would obviously want that person to pay your lawyer fees if you win.

I’m not with the commenters stating their admiration for this judge’s decisions. It seems to me that while he sustained nearly every objection Shoulder Pads made, he overruled just about everything Paltrow’s attorney (and to me those were the credible and appropriate objections, many of them directly aligned with the ones that had been let through for Shoulder Pads; why did he see fit to force Paltrow to answer all the ridiculously irrelevant nonsensical unrelated questions posed by Attorney as Incompetent Fool/Shoulder Pads, while aligning his decisions on all Paltrow’s lawyer’s objections with favoring Shoulder Pads herself, which seemed to me to be blatant favoritism of Sanderson and his team and unjust suppression of the very legitimate objections thrown up by Paltrow’s increasingly frustrated legal counsel - understandable he’d feel that way, imho. Anyone would! Seeing incompetence praised and revered and seeing actual relevant and just objections overruled time and time and time and TIME AGAIN would frustrate - infuriate, rather - even the most easygoing and nonchalant and pleasant attorneys in existence. He maintained his composure very well. Shoulder Pads is a nightmarish b!tch of a lawyer and so ineffective and terrible a lawyer that I think it ridiculous that she even passed the bar in the first place - wouldn’t surprise me had she cheated.

Life long skier here....do you believe that driving is a "drive at your own risk activity"??? Responsible people ski and drive responsibly....when one party does not and hits/injures another party there is accountability on the roads. Why would there not be on a ski run??? "Ski at your own risk" refers to trees, lift towers, boulders.....all immovable objects.

Agree. I don't know if I could stomach admitting to the entire world, that I ended up spooning with this man a complete stranger. The when encounter, with him grunting and pressed up against her back, is mortifying, and imo there's zero chance she would put herself thru all that, just to avoid paying out a hefty sum of $, taking responsibility for an accident, and risk the chance of being caught in a big lie if someone had witnessed the accident and saw me hit this elderly man and now testifying the opposite.......imagine how bad it would have make her look to the entire world, to her kids, new husband, etc...were she to be caught lying to the court? The awkward details of the accident, combined with all those other factors,are the reasons why I believe she is innocent.

Quite an easy questionable outcome from this. The lawyer is asking her to determine her behavior around the kids that day as safe and responsible as with all days together, but they likely had additional info on instances where she wouldn't have been safe around the children. That would be contradictory and set her up as lying. Nothing unusual.

Whereas, the people who were closest to the accident right after it happened saw the positions of the bodies on the hill. It was said that she was farther down the hill than he was. We'll see if those people testify.

I find it hard to believe they could tell what happened even if they're going by the shape/height of their bodies from that distance too. Unless they have "ski detectives" that could go back and recreate the scene like the police at a car crash, idk how they're going to figure out who's at fault. Especially if they only have 1 witness.

@@MegaSunshineyday I live in vermont and I snowboard quite regularly.... anytime there has been an accident where two individuals run into one another, and it happens more than you think (even serious injury sometimes) almost every time nobody asks for information unless it was a deliberate attack. If it was an accident, everyone around just helps everyone. It's what I've SEEN everytime I've been out and I go on runs at least 30 times a season.

After hearing the doctors report, I disagree. His Injuries don’t match up with her getting hit. His were extensive to the head and side of the body. He went down with her on top of him. Hers were nowhere near the extent of his because she was cushioned by him.

Well the issue here is that Sanderson says he was the downhill skier. Paltrow says she was the downhill skier. It’s he said she said and the case is attempting to sort out the truth and fault.
Yes. I was taught this the first day I skied when I was 9 or 10. I also learned that I was participating in a potentially lethal sport. Unless she came to a quick and unexpected stop in the middle of the slope, it is ALWAYS your responsibility to look out for people in front of you. And hey! Accidents happen and unless someone dies or is paralyzed, most people consider it a byproduct of participating in a dangerous sport. It’s what you sign up for. This case is ridiculous and I think this man’s cognitive health was already in decline when he was on the mountain that day.

I don't understand the hateful comments towards GP. She is articulate and gorgeous and doing her best to be respectful. Court proceedings are boring and arduous and I'm sure it's annoying to have someone wasting your time and trying to take your money for something that happened seven years ago.

Old age & prior injuries makes a huge difference. If you put a healthy younger person with no prior injuries up against a much older person who has had prior injuries, the outcome is typically be very different in this type of accident. It's just a fact that our bodies don't hold up as well as we get older. Trust me, it sucks but it's just the way it is.
Please explain to me how you’re nearly 70 years old, you’re freaking blind on one eye, and loosing vision on the other, had knee surgery, irregular heart beats and had to go to anger management after the second divorce. Has had 10 girlfriends since and can’t get along with your daughters. And dumped your last girlfriend “because it’s you not her.” Sue for 3m because of your “cognitive decline”. The only thing that should come out of this case is that there needs to be a mental and physical assessment of participants before they put themselves in risky situations.

I’ve listed to several witnesses and I have to say GP did an OUTSTANDING JOB, especially compared to the total creeps that were on the stand before her. I’m not a huge GP fan in general but I think she is telling the truth and standing up for herself here.

Everyone is talking about Paltrows attorney. He's a medical malpractice/injury attorney. That means that 7% of his cases end in a jury trial. Most end in a settlement done in a conference room usually with a mediator. He has about as much experience in front of a jury as that of a 2nd year public defender. Whether she loses because of the strength of the case or because she hired the wrong attorney will be up for debate.
The amount he's asking for is not neglibible. Anyone who's been around rich people knows they are just as greedy (if not more) than people who aren't. Not to mention this is publicity for Gwyneth, not the best but as the saying goes any publicity is good publicity.

I think she just knows that the other side is trying to argue that she was distracted by watching her kids and that played a part in her getting hit (potentially skiing into his path) so she puts her guard up when the conversation heads in that direction. The first time I tried skiing downhill, I lost control and got 1 of my legs in between the legs of a woman in front of me, since I couldn't stop. I yelled "Watch out!" and we almost collided. I totally believe Paltrow's story, since I almost hit someone sort of that way. She is very confident, firm, specific, consistent, and believable. Sanderson's lawyer is making all these ridiculous, unnecessary inferences, overdoing the $1 counterclaim. What don't you understand? Paltrow clearly believes she's the victim and not guilty. She doesn't want any money except her lawyers' fees. But Sanderson initially wanted over $3 million, which the judge may have cut down to $300,000. Who's the greedy one here? Paltrow could easily have paid and settled this case if she really were guilty. But because she's firmly convinced she's innocent, she's suing for $1 on principle. Why is it so hard for that incompetent lawyer to understand?
GP said, today, she did not know the extent of the Plaintiff’s injuries until the trial started. The Plaintiff is totally justified in the $ amount. He was an Optometrist and every aspect of his life has been pretty much ruined because of the closed head injury.

What is wrong with all these lawyers? The first one was accusing GP of lying, then GP's lawyer was running out of questions. I guess I am used to Depp's lawyers or Saul Goodman, but wow.
GP’s attorney cannot frame his objections. The lady attorney blurts out friendly banter to GP that is probably designed to disarm GP, but hurts the man’s case. Also, it is ludicrous that there are so many attorneys for this case. A poor man on trial for murder would only have one attorney, court appointed and stretched thin. I am tired of the two tier justice in my country.

Obviously, you don't follow any murder trials, why don't you head on over to the Dephi and Moscow cases and check out the state-provided well qualified multiple attorneys and staff for the murder defendants. The case you are commenting on is a civil lawsuit, they are entitled to as many attorneys as they want to hire.
As a Skier earlier in life I can tell anyone who has not skied that the exact scenario GP is describing happens all the time from both sides . ( You are waiting for the chair lift on a slight incline and the person behind you puts their skis parallel and slides right between your legs from behind and bumps you ( OR You put your skis parallel slide forward with your skis sliding between theirs and you bump them . I hope Sanderson does not get away with this and his legal fees clock him upside his head .
So you’re saying he’s lying yet he’s the one with the serious injuries and she was able to ski away almost immediately after? No two accidents are the same and I can totally see it from his perspective. What he mainly wanted was for the medical bills to be paid. She claims he hit her from behind yet the injuries he sustained say otherwise, they literally contradict what she’s claiming. The head injury alone says otherwise.

He's terrible. He actually objected to the plaintiff's attorney asking three questions when she said she only had one more. Where did GP find this guy??
She is not guilty of leaving the scene of the accident. It was just a terrible accident. She paid highly trained skiing instructors $8000 for skiing lessons for herself and her children. It's the responsibility of the instructors to safely conduct the lessons and in an event of an accident, she was instructed by her skiing instructor to go down the hill as it's the instructor's responsibility in event of an accident to take care and instruct both parties as what they should do and she was entrusted with her instructor's instructions to go down the hill and he would take care of the accident. Gwyneth Paltrow was just obeying a fully qualified skiing instructor's accident procedures and trusted in his decisions.
Regardless of whether the procedures that are in place for recording an accident, can be coordinated by an instructor such as, seeking the form , collecting the form etc ; it is down to each individuals involved / impacted by the accident to record their own testimony. Particularly where there is any possibility of opinions being contested. How can an instructor who is being paid ( substancialy ) be completely objective when reporting on behalf of a party who (a) has employed them and (b) relied on them for instruction - particularly when there is a chance they may also be implicated ..they can't !

I’m not with the commenters stating their admiration for this judge’s decisions. It seems to me that while he sustained nearly every objection Shoulder Pads made, he overruled just about everything Paltrow’s attorney (and to me those were the credible and appropriate objections, many of them directly aligned with the ones that had been let through for Shoulder Pads; why did he see fit to force Paltrow to answer all the ridiculously irrelevant nonsensical unrelated questions posed by Attorney as Incompetent Fool/Shoulder Pads, while aligning his decisions on all Paltrow’s lawyer’s objections with favoring Shoulder Pads herself, which seemed to me to be blatant favoritism of Sanderson and his team and unjust suppression of the very legitimate objections thrown up by Paltrow’s increasingly frustrated legal counsel - understandable he’d feel that way, imho. The lawyer is asking her to determine her behavior around the kids that day as safe and responsible as with all days together, but they likely had additional info on instances where she wouldn't have been safe around the children. That would be contradictory and set her up as lying. Nothing unusual.

Whereas, the people who were closest to the accident right after it happened saw the positions of the bodies on the hill. It was said that she was farther down the hill than he was. We'll see if those people testify.

I find it hard to believe they could tell what happened even if they're going by the shape/height of their bodies from that distance too. Unless they have "ski detectives" that could go back and recreate the scene like the police at a car crash, idk how they're going to figure out who's at fault. Especially if they only have 1 witness.

@@MegaSunshineyday I live in vermont and I snowboard quite regularly.... anytime there has been an accident where two individuals run into one another, and it happens more than you think (even serious injury sometimes) almost every time nobody asks for information unless it was a deliberate attack. If it was an accident, everyone around just helps everyone. It's what I've SEEN everytime I've been out and I go on runs at least 30 times a season.

Well the issue here is that Sanderson says he was the downhill skier. Paltrow says she was the downhill skier. It’s he said she said and the case is attempting to sort out the truth and fault.

Yes. I was taught this the first day I skied when I was 9 or 10. I also learned that I was participating in a potentially lethal sport. Unless she came to a quick and unexpected stop in the middle of the slope, it is ALWAYS your responsibility to look out for people in front of you. And hey! Accidents happen and unless someone dies or is paralyzed, most people consider it a byproduct of participating in a dangerous sport. It’s what you sign up for. This case is ridiculous and I think this man’s cognitive health was already in decline when he was on the mountain that day.

Old age & prior injuries makes a huge difference. If you put a healthy younger person with no prior injuries up against a much older person who has had prior injuries, the outcome is typically be very different in this type of accident. It's just a fact that our bodies don't hold up as well as we get older. Trust me, it sucks but it's just the way it is.

Everyone is talking about Paltrows attorney. He's a medical malpractice/injury attorney. That means that 7% of his cases end in a jury trial. Most end in a settlement done in a conference room usually with a mediator. He has about as much experience in front of a jury as that of a 2nd year public defender. Whether she loses because of the strength of the case or because she hired the wrong attorney will be up for debate.

I think she just knows that the other side is trying to argue that she was distracted by watching her kids and that played a part in her getting hit (potentially skiing into his path) so she puts her guard up when the conversation heads in that direction. I'm all for strong mama instincts but GP seems more interested in herself and defending her version of events than in being mama bear. She seems very narcissistic and self-absorbed.

The first time I tried skiing downhill, I lost control and got 1 of my legs in between the legs of a woman in front of me, since I couldn't stop. I yelled "Watch out!" and we almost collided. I totally believe Paltrow's story, since I almost hit someone sort of that way. She is very confident, firm, specific, consistent, and believable.
Sanderson's lawyer is making all these ridiculous, unnecessary inferences, overdoing the $1 counterclaim. What don't you understand? Paltrow clearly believes she's the victim and not guilty. She doesn't want any money except her lawyers' fees. But Sanderson initially wanted over $3 million, which the judge may have cut down to $300,000.
Who's the greedy one here? Paltrow could easily have paid and settled this case if she really were guilty. But because she's firmly convinced she's innocent, she's suing for $1 on principle. Why is it so hard for that incompetent lawyer to understand?
GP said, today, she did not know the extent of the Plaintiff’s injuries until the trial started. The Plaintiff is totally justified in the $ amount. He was an Optometrist and every aspect of his life has been pretty much ruined because of the closed head injury.

( You are waiting for the chair lift on a slight incline and the person behind you puts their skis parallel and slides right between your legs from behind and bumps you ( OR You put your skis parallel slide forward with your skis sliding between theirs and you bump them . I hope Sanderson does not get away with this and his legal fees clock him upside his head .

She is not guilty of leaving the scene of the accident. It was just a terrible accident. She paid highly trained skiing instructors $8000 for skiing lessons for herself and her children. It's the responsibility of the instructors to safely conduct the lessons and in an event of an accident, she was instructed by her skiing instructor to go down the hill as it's the instructor's responsibility in event of an accident to take care and instruct both parties as what they should do and she was entrusted with her instructor's instructions to go down the hill and he would take care of the accident. Gwyneth Paltrow was just obeying a fully qualified skiing instructor's accident procedures and trusted in his decisions.
Regardless of whether the procedures that are in place for recording an accident, can be coordinated by an instructor such as, seeking the form , collecting the form etc ; it is down to each individuals involved / impacted by the accident to record their own testimony. Particularly where there is any possibility of opinions being contested. How can an instructor who is being paid ( substancialy ) be completely objective when reporting on behalf of a party who (a) has employed them and (b) relied on them for instruction - particularly when there is a chance they may also be implicated ..they can't !
