Good evening Ernie, I really enjoy your show, I am a bit late today, my question is my tenants just passed and only his name was on the lease, but his wife and children are in the property and the rent is 3 months late what should I do (HELP) ?
Death is not generally a defense to nonpayment. I'm not sure what state you're in, but you should be able to send written notice to the named Tenant (and probably his Estate) along with notice to the occupants that you intend to evict. Notices are going to look a little different in different states, so you may need to seek out legal counsel. We're in Texas, if that helps.
What if your landlord give you two types of leases one and both husband and wife signs their copy and the landlord white out on his copy one person name is it illegal for him to use it in court or is the that tenant have illegal.

I would need to know more. Which lease was signed, and why was a name removed?
