quick question branigan, i know this may go against what you are preaching but i am in a situation where i am debating whether I should apply for edd once again. quick background of my business is that I opened up a retail shop back in september 2019 (pre-covid) and was kicked in the butt because retail business has been gone down the drain ever since this pandemic started. my store was closed almost 2 months and i had trouble paying my rent. although i do make some income through my online sales, it is safe to say my business plan did not go as planned. ive been getting my unemployment check since march because i didnt want to miss out on the $600 weekly federal check, but now I am wandering whether I should still continue receiving my unemployment. my retail store is still open, although there are no customers and i havent made a single sale for many months at my store. my online sales is doing okay so its not like im making zero income. do you think i should still apply for edd?

California EDD says the max benefit is 450 per week. However you mentioned 1252. Under what circumstances can one claim 1252?

Hello, my husband was fired from WESTCOAST cold storage Riverside California in June 2023.
He applied for unemployment and was sent an award letter with his approval and weekly amount. He has not received any money. He certifies and no money is being put on his edd card.
Also someone is EMBEZZLED $1,000,000.00 from the employer through a fraudulent wage garnishment that was processed in December 2022.
If I was fired and the unemployment appellate judge ruled that there was no proven basis for my termination and my unemployment benefits were granted and paid out. Is the judges decision enough for me to file a wrongful termination suit?
No. But if your termination was highly suspicious I would call a lawyer for a consultation.
I am currently on PFL and my boss contacts me saying that im on the verge of losing my job because he hired new employees. Then continues to say that my pay will be reduced and will be jobless by the end of the year. Do I still qualify for EDD if I decide to quit due to these circumstances? Unfortunately I do not Qualify for CFRA to back me up because there are less than 5 employees working in this small business.

Hello I filed to do a backdate on my claim and I got an email back from edd saying "Thank you for your inquiry. Our records indicate that your request to backdate your claim is completed. Therefore, no action will be taken at this time". Does this mean I got approved

You can certainly apply online for job, make phone calls, submit resumes, post on jobs forums, etc. You need to keep a record of all this effort so you can prove to the Labor Dept that you are actively working for work.

I leave in France and it'very intresting to see how employment Law work in California and in the US. Due to the famous " employment at will" we tend to thinks that employment Law in the US is non existent or so.( As "umployement at will" does not exist in France and no one is ever fired on the spot ).

I been suspended from work cause I didn't report what happened at work. So they suspend me but never called me back to come work? Can I still apply EDD cause I do have a lot of bills to pay off.

I got terminated because I told my supervisor if I could come in early because I had an interview they fired me the next day an told the agency I worked for said I was terminated for attendance due to attendance

I don’t know. But I seriously doubt it.
My paperwork from EDD is completely messed up. They have the wrong SSN and the Notice of Unemployment Insurance award is section is all zeroes and shows no employee name and no employer name. I can't even go online because they never sent the number I need to login to my online account.
Should I cancel this claim and start over?

Been trying to file from my phone now, for ca ui benefits and on there site they say there's a mobile friendly version which is a lie, i just keep getting sent around in circles after i click one thing that tells me this is for applying, it just takes me back to a different page, its crazy, someone needs to change their website, they are making it difficult for people to file online and i don't understand why they are allowed to get away with that.
For new applicants you need to use the UI online version, instead of the UI mobile. So make sure to click on UI online (if you haven't done yet) anyway you will be able to use any mobile device. Once you are fiiling your application make sure to be saving every page or changes that you get done, because since there is a huge demand on their website it will quick you out for not reason, and you have to log in again. You cannot recover anything that you did not save last. Once you are ready to claim your week benefits then you want to click on UI mobile which is simpler and easier to use than the UI online version.
I have a question; I got laid off due to COVID 19. I work full-time self-employed. (i get paid in cash and get a1099 at the ends of the year I always file my taxes too.) I work at angels stadium, but due to yo MLB not playing this season, I am technically out of work until maybe next year. Here are my conflicts and would like to see how I should go about my claim. I already applied for unemployment the first we were on lockdown. March 13. I am a single full-time father to my 5-year-old son and have legal documents stating I have full custody of my son. from my awareness, I believe kids are out of school until next year. Therefore i don't have anyone to watch my son at the moment. Since this social distance, no one is working at daycare.. how can I go about my case? Any recommendations or advice? If you are on unemployment pay and you decide to open a small business, when in the process to open your small business you stop the unemployment pay? Considering that many times before to get your business license and have the business for real, you need to rent a small place, buy equipment, pass some inspections, and then have your business license.
In this case, when is the time to stop the unemployment benefits?

Hi Mr Branigan, I did not collect UNEMPLOYMENT when I was wrongfully terminated in 2014 as I was working part_time at a lower paying job, while looking for work in my field. So for 4 years I did not have salary/ benefits from my employer. Should I get back pay (which I included interest) and not just wages when I was reinstated in 2018.?

No, you only has to pay IF you didn't have taxes removed out of your unemployment check. Your unempolyment check IS taxable.
Your unemployment check IS taxable but every 2 weeks you have to manually check mark the box that you want taxes taken out for those 2 weeks. But you have to put that check mark every two weeks it will ask you. If not, you will be taxed on your unemployment money when you do your taxes.

I did everything right and a year later the employer signed up for trial and I was not in the state at the time so they won the case. I had to leave because they were forcing me to hit kids with disabilities.
The link in the description about calculating unemployment benefits is about disability, not unemployment. Unless they're the same method. I'm confused.
All very good...but I read that on the website. You say that someone could possibly get $1250 per week. I received $450 for unemployment after a $50k job and the same amount after a $85k job - all within a two year period...does one have to break the $100k barrier for the$1250?
Yes higher earning put you in different bracket. Lower income = lower amount per week depending several factors

Why is it so hard to get this money ... I talked to a person from the unemployment one day and he was asking why im barely filing I also called my old bose and he asking me questions about why my filing barely now and trying to get my W2FORMS AS WELL....im giving these people from the state my ccs my information and i live in a small town were i got to travel 45 minutes to get to a unemployment office and dont have a care ... Im giving them all my information and they alway say why am i just filing now i worked for this money and i didn't need it then but i hit hard times and now i need it ... Every time i call a state are loco office they never no why do they give me these numbers and forward me to these people to talk to ... I did my half of my paper work and these people are paid to finish and answer questions ... Why dont they no and why cant they help me now i got there attention they can get my information and processes it then a there... I filled out the paperwork and spoke to a representative and now i got to refill it out again and i paid money to fax my information and its money i dont have i dont have a car to travel 45 min and lost my drivers license.. Im in need of this money now and i the question on the paperwork i was sent was not asked .... So i got suspicious i got all documentation .... So i don't see why am i paying for something i cant get when i do need it and help ...
