In the US, it's possible, but it will likely lead to an investigation and a hearing before the Bar of that person's state.
While accused, yes. After being found guilty of fraud, no. Furthermore, if Mike loses this case, and loses his fraud case, the defendant has a great grounds for the case to be ruled a mistrial or appealed on the grounds of incompetent representation. Gibbs is entirely too bound up in her feelings against what was once Pearson-Hardman, and should be relieved.

In general, the only thing that should truly matter for a given role, is your ability to execute as per the terms of your contract, or your responsibility to a given client. If the client is willing to hire a provider and considers them the best of available options, then so be it.

It's amazing how one secret destroyed so many lives, it destroyed the firm, it destroyed Scottie and Harvey's relationship, Jessica and her boyfriend's relationship, and Sheila and Louis's relationship.

Seeing mike going to jail made me cry. Its very sad. He owned the courts. He is a perfect balance on how a lawyer should be, he finds loop holes to make million dollar deals happen and also fights for the needy.
Harvey might be a better lawyer but mike is a better person.

Anita Gibbs was really an underrated character. She made an appearance with some of the most power pact dialogues that were either savage or pure facts. Try to see through her eyes and you’ll be impressed too

He never could have gone to Harvard, but he easily could have gone to any other law school and become a legit lawyer. He chose not to because cheating and selling drugs was much easier.

She was in this show in the 90s called Early Edition about a guy who got tomorrow's newspaper today and saved lives. She was a reporter trying to uncover his secret. Had the same kind of, no nonsense, "I'm gonna get to the bottom of this", one way or another. But of course much younger and not as powerful in that show.
I loved this part of the series where mike was practically fighting for his freedom. Only thing I hated was the obvious prejudice of Gibbs that any judge would be able to spot out or even juror😂she hated mike despite him being an amazing lawyer regardless of having a masters. Also to be fair all the time he had spent at the firm under Harvey really is all the teaching and mentorship he needed.
I don't think there's any rule requiring the prosecutor to be impartial. That's just the jury.
Fact of the matter is the show made it impossible for Mike to never get caught.
Not only did it say he was caught selling tests, but he was caught selling tests to a dean’s daughter.
If it was just any student it coulda blown over and dude could have attended school later or even attended school in secret while working at Pearson Spector, but the deans daughter thing made it impossible.
and i am sure dean's daughter got off scot- free!
Once he got admitted to the bar, that should have been the series finale
It's a shame though that no law firm worth its salt would hire anyone without a law degree, even though it's very possible to learn on your own and pass the bar exam. But like so many other things, if you don't "buy in" you're not wanted

The way I see it, Mike's main enemy was not Trevor, Logan or even Gallo. It was Gibbs.

People say that Anita Gibbs wasn't up to it, but I think she is fantastic. The hands got tied behind her back so to speak, when Sheila got send to Argentina, she had no star witness, Jessica's boyfriend, Jeff Malone asked Mike to destroy letters before the subpoenas came in.
Anita Gibbs is a fantastic character and this Leslie Hope played her amazingly!

Whatever happened to her? Mike was found out, went to jail, and got released, and he kept practicing law, both in New York and Seattle. Does she still feel the same way, or did she drop her feelings? I'm just curious.
At last she's kinda the reason why Mike is even able to practice law😂
She tried to stop him by the bar but in the end she voted to allow him to practice law in the end because of Jessica Pearson

he passed the character fitness part of the bar by end of season 6 and now is a lawyer with a bar number. not a fraud anymore
Imagine a world where people in power can’t act as gatekeepers to the poor by using a credential system to exclude anyone who cannot afford the degree. Mike is as capable (more so, really) than the attorney going after him, and she readily admits it. The only thing she doesn’t like, is that he isn’t in the club. The state bar association is a joke, especially in New York, where they allow Alvin Bragg to make a joke if their profession.
To be fair he could have passed the bar without harvard and be a practicing attorney in 4 states including california and washington. You can pass the bar by "reading the law". It's just that he wanted to fake his way into an elitist firm who hired only from harvard and which was practicing in new york

Sad thing is Mike IS a criminal. He repeatedly was committing crimes before and even during being a lawyer, along with that part itself. He was the protagonist but his regular criminal activity wasn't exactly a great endearment.
He was a better lawyer than the ones that have an actual degree. The only people who are actually on his level are Harvey, Louis, and Jessica.

Yes he is. And remember criminality is objective to the society. If you are competent but you are not up to standard of the society, you are excluded. It's like you are a lawyer in your country, but come to mine where the law is different, you are not a lawyer at all. It's subjective. throughout American History no never needed a law degree to be a lawyer, pass the bar and you're allowed to argue in court, but if you don't ever go to court you don't even need that. How much you learn in school where you can't learn by reading up in a library, or apprenticing for a veteran attorney.

At this point in the show, he never even sat for the bar exam. And it would have been impossible anyway, since the state of New York requires you to have demonstrably gone to law school in order to sit for it.

The whole premise of this show is hypocritical. Mike's supposed to be this compassionate, never back-down, always fighting for the little guy character, but the only reason he isn't a real lawyer to begin with is because the second it got tough (when he got kicked out of college during his bachelor's), he quit. He could have gone back to school at a different university, applyed for more scholarships, taken out loans, whatever necessary to finish and actually get into law school so he could be a lawyer, but he didn't do anything. He just got high and committed fraud.
It's not illegal to practice law without a degree. Anywhere in the US. Period.
In some jurisdictions a bar certification is required to practice law, and in most cases, previous education does not preclude a bar certification. One can easily obtain bar certification without a degree in almost ALL jurisdictions. In this particular case, the character is already bar certified in this scene (assumed from the line "my bar number is still valid"). That makes him a legally practicing lawyer in that state and jurisdiction.
In any case, not having bar certification would still not spark a criminal case against him, even for fraud. For that, someone has to press charges. The show has gone out of it's way to indicate his clients would never press charges. So the only case that woman could bring against him is a civil one and it would have no bearing on any other case he was working, even if she won.
This show is terrible.

You can’t take the Bar without requirements being met.
So Mike is smart enough to pass the Bar. He’s actually passed it many many times as he was charging people to pass it under their identity.

Actually new york does actually require you to have gone to law school not necessaruly have graduated since they allow "reading the law" but you still need to have gone

This is a crime called "Unlicensed Practice of a Profession." In the state of New York, it is NY ED Law 6512, a Class E Felony punishable by up to 4 years in prison. You unbelievable mook...

I dont get it, law school is supposed to prepare you for the bar, if you pass the bar without it why cant you be a lawyer? Passing law school without a passing the bar means you cant practice law so its obviously more important...
Law school is not the same thing as the bar. Law school just provides you with the education. The Bar Exam is where you are actually issued a license which allows you to legally practice the law in a given state. It certifies that not only are you competent, but that you also have registered with the state as a professional and agreed to be bound by certain ethical and professional standards. The general idea behind it is that way, you don't have random fraudsters and conmen claiming to be legal professionals in order to scam people or provide sub-par legal services. It's the same logic behind licensing people to be doctors, so as to avoid the general public being defrauded and hurt by two-bit snake-oil salesmen claiming to possess legitimate medical knowledge...
He is not licensed as an attorney yet he is practicing. All the comments below are incorrect or half-correct. No judge or authority would ever allow Mike Ross to continue practicing law under these circumstances.

OK maybe I missed something from the writers point of view. Mike has passed the bar so therefore he is a lawyer. Mike did not go to Harvard which may mean something for the firm he works at, but means nothing to being a lawyer. Have I missed something?

He has NOT passed the bar at this point. He doesn't pass the bar until season 6 (which takes place about 2 years after this episode). He is committing a felony referred to as "Unlicensed Practice of a Profession."

He has actually sat for the test and passed it....multiple times. He used to help people cheat so they would pay him to pretend to be them and take the test.
But he himself has never legally taken it, nor is he eligible to take it.

I'm slow, but I though if you pass the bar exam you're legally a lawyer. Not going to Harvard isn't a crime. This show didn't make any sense to me.
