  • The plaintiff hired the defendant to sand and restain the stairs. However, her stairs looked exactly the same after the job, so the plaintiff is suing. The defendant insists he did a great job, but the stairs need to be fully replaced.

    Greedy, although work wasnt done properly, he did so much more to make up for it,She still wanted all the money back

    Larry seems like a decent guy. He tried to rectify the situation. He did a lot for her. She was greedy.

    You can't put a price tag on friendship. She acknowledged all of the things he DID do, small or big, and yet she's still suing him over $600? SMH

    As the defendant is listing all the other jobs he's completed for the plaintiff, she's disagreeing, shaking her head from side to side. Then Judge asks her "is that true?" and she reluctantly aquiesces and nods "yes, that's true". Body language says a lot... it's always very telling.

      Nothing was in writing, the defendant admitted that in the beginning. His word against the plaintiff and vice versa.

    One of the few times I don't agree with the judgement. The defendant seems like a good guy who worked off the money she spent, she just seems greedy.

    Yea, those steps can be redone, but not for $600.00. Don’t understand why the judge has a had time grasp that.

    $600 is inexpensive to remove decades and decades of paint and stain. Hand sanding is also very hard work. It is very surprising that the stairs are mixture of pine and oak from the 1920s. That makes me think it was messed with beforehand. How can you fix mixed grains? I don't think the judgement was very fair considering all the other work he's also done for her after the fact. Just replace the stairs and the landing, or repaint it.

      Yea, I agree the stairs didn't look good but I wouldn't put that on the defendant. It looks like there's been decades of past fixes done on the cheap. All that woodfiller around the railing? Weird patches of mixed grain? Dude did all he could but he's right, the only way to fix things would be a brand new set of stairs.

    She was trying to get something for nothing, She should have hired a licensed contractor for that specific work. NEVER HIRE A FRIEND. Friendship is worth more.

    He really shouldn't have owed anything. They settled it by him doing other work, which apparently she didn't complain about. If the stairs cost at least a 1000 dollars or more to do, then I could understand him having to return a small part, but they only cost 600 and he had to give back a third of it.

    The plaintiff wants a new staircase for a dime. She's unreasonable. I feel bad for the defendant who seems to have tried every way from Sunday to make her happy.

      If the job costed more, i could maybe see why she'd deserve a small fraction of it back, but he had to give back a third of what he was paid after all that hard work. Normally I agree with Judge Milian but this is an exception. Granted, I've seen worse rulings from her occasionally, like the one with the lady who was awarded all her money back from a gutter replacement guy even though the guy did a ton of work.

    I think she’s never going to be happy no matter what because she’s old and is expecting a perfect job on 100 yr old stairs. His first mistake was agreeing to do it.

    You all forget, put everything that is agreed upon in writing, like a contract. That way you know what was being done and for how much.

    The area around the spindles looked a bit eh... He claimed it was due to glue and poly over it... It looked more like white paint from the spindles... Couldn't that have been sanded off also??? Like with a dremel to get in the small spaces??? The treads themselves looked okay, especially being mixed woods... His work was definitely worth something... The Plaintiff didn't deserve the entire $600 she was suing for... That would've been a free job!!! So in the end she paid $400 plus all of the extra things he did...

    I've personally done the exact same work as she had him do on her steps. I bought a house that had carpet and several layers of of paint under it on the stairs. There's no way he should've had to give her back any money, she should've been paying him a lot more. It took me days to strip all of the paint off and sand the steps down. It was exhausting work and she never would've found anyone who works in the flooring industry to do what he did for $600.00. All I did was stain around the spindles and about 2 inches of the stair and seal it extremely well to seal the wood before I put carpet back on them. It took forever and I hurt like hell by the time I was finished. This lady should be begging his forgiveness for taking him to court over something that she couldn't have done herself. The defendant did her a favor by covering it up with the luan board that I'm sure he paid for. Her son should be thanking him also.
    Unfortunately, I guess entitlement doesn't end as people get older.

    I'm redoing my floors at my house. I've lived there for 7 years. I finally pulled up the carpet and the hardwood underneath is horrible. I've been sanding and it still doesn't look great after years of carpet. I'm putting a dark stain to help cover and will poly. afterwards. JM wood can't be made to look nice after 40 years.

    Call me crazy, but when I have work done in my house, I define what I want to be done, ask for a price, and put it in writing. But that's just me. Some wood in very old homes is unattractive, of lesser quality, and mismatched, and was meant to be painted and never stained. Impossible to make it look good.

    He most likely would of won the case had he taken pictures of the stairs once the carpet was removed and pictures after the work.
    I dont think I could have a 40yrs friendship with someone who doesnt value another person's effort to make things right.
    Edit: The more I thought about it and because of the response the lady gave to the judge about how much it would cost, I think she wanted it done for free, just like everything else he did for her free of charge. Also would love an update to see if she did refinish those stairs or just wanted her money back lol

    She wanted brand new looking wood stairs that probably only looked semi-decent when they were new. They got covered with carpet for a reason. And she probably expected to pay $50 - $75 for the job. I’d like to have seen an estimate for carpet removal, sanding off 40+ years of paint, and the repairs he did and adding wood veneer to the stair risers. Poor guy~ he did numerous odd jobs to try and make her happy. He needed estimates for getting her garage door to open and the other things he did. Apparently her son doesn’t help around the house when he visits his mother.

    If time was taken it could have turned out nice. The price was way too low to commit to that type of restoration. For 600 i would have sanded and recoated with a good oil based acrylic paint. Or stain very dark to cover up defects.

    Luan plywood is not designed or graded as a "structural plywood", but an interior panel. Therefore it should not be your first choice for a structural, laminated stair carriage or stringer.

    He still did a lot of work and made the stairs look the best he could. You can only do so much with the materials you are given. Plus, he did a sh1tload of work for free in order to make up for what he couldn't do with the stairs.

    I would not have given her a penny. The judge said the keyword earlier in the case, settlement. She accepted the additional work at no extra charge in compensation for the poor work on the stairs, so as far as I am concerned that constitutes and accorded satisfaction and she isn't entitled to any further compensation.

    WHAT? The judge is wrong, if he did lots of other work around her house to compensate for the stairs he did, then that was the 'SETTLEMENT', so why did the judge order him to return $200. The plaintiff is just being VERY greedy wanting all her money back, she shouldn't have got anything back!...

    Shes a classic “Karen” The stairs could have been re-sanded & stained a darker color. The sanding itself was worth the $600 & she should’ve gotten anything back in my opinion.
