Let me help the people that need some help understanding.. Rent is very expensive and it’s hard to find apartments and it might be close to stores drs and why can’t we just live in an apartment that doesn’t have mice/ rats like people with money do!! Even if it’s rent controlled !!
There is no doubt about the rodent problem in the apartment, but it is clear that the plaintiff’s case was filed in retaliation against their landlord…
She's full of crapola, but moving is expensive when first, last and security deposit is a huge expense to secure a new place on top of the actual moving expenses. To be clear, I do not agree with the plantiff/renter in this case, but my reply is in reply to why someone wouldn't just move out immediately.
If the apartment was horrible, and there was a continuous rodent problem. Why didn't the plaintiff move out, when her roommates left ? If there's a 🐁 problem. Why is she leaving food and juice🥤on the counter ? If it's that awful, Why she fighting to stay living there ? It wasn't an illegal lockout. They was suppose to be gone by the end of the month. Her lease was over and it didn't get renewed. She wanted 5000 buck for an old, raggedy, broken futon. 🤦🥴
Clearly there was a problem. I think the landlord tried and trusted the pest control people. But after 2 visits and there is still a problem. Not 4 visits. It'll can be hard to move. It costs a lot BUT she says I'm not loving on the day she is supposed to move out. No
This was definitely a retaliatory money grab. Yes, there was a nasty rat infestation, but the tenant continued to live there and pay rent, then when the lease was up, tried to back out and stay longer, which is ridiculous if you’re concerned about a rat infestation. She should’ve withheld rent, until the problem was resolved, and/or used that money to move. The landlord probably lost money on September rent, since she decided that day before, she wasn’t leaving. A zero-zero outcome is best for both. The landlord doesn’t deserve a dime for those conditions.
Plaintiff left stuff all over the apartment, showing that she was a messy person and that adds to the roach infestation. Yuck. And if there was a rat infestation, clean the place up, no food out and report the infestation to the health department and housing codes.
Rats are very clean animals, but, as we know, human beings sure aren't! throwing their trash onto the street, takeaway places not disposing of food waste responsibly, fly tipping - all humans 🧐

Mice are sometimes just inevitably there. I live in a 100+ year old farm house and we put up aluminum flashing and steel wool in every crack/crevice and hole we find but those little monsters still find a way in. We have even caught one climbing the chimney to get in a crack at the top of the house! We have cats and traps and it's almost a constant battle in the fall/winter once it snows outside. But we've only had rat issues once. They were getting into the chicken food out in the shed. Traps didn't work and we tried poison which just made them stagger sick around the yard and I had to dispatch them with a shovel. I hate hurting things. Finally we got galvanized feed buckets that they could not break into and I had an area where we left tge one set of shed doors open and quickly saw a big merlin hawk take up residence. He took care of the rats. Didn't bother the chickens at all. But it's a constant battle against rodents. I'm sure it's even worse in the city.

In Ontario, it's illegal for a tenant to withhold rent for issues you believe aren't being dealt with by your landlords. Your remedy is to go to court and get all the rent money BACK from the time you reported the problem and it was never solved. I thought the same was said in the states ?
Why continue to live somewhere and refuse to leave if it was that bad. Now wants to have lived for free. As per usual people using and abusing the system. This is why I stopped renting.

He got stuck to something in the sink (syrup maybe?) so I took him outside and rinsed him off. Then he slowly went back into the forest. I had mice coming in through my bathroom wall behind the toilet and the landlord did nothing. Complained for months and the landlord told me I should come in everyday complaining and not twice a month.. like what? Ended up going month to month after the lease was done and eventually moved out. Not only did I have nice, I also had roaches and again nothing was done. They promised new appliances at the beginning of move in and didn’t get them until 2 years later.. place was a joke and glad to be out.
The landlords are slums. Its an investment property...we "try"...try harder. The tenant is a mess. All of that going on and she wanted to stay? Then had the nerve to sue
