- Back in the 1980s Nintendo found themselves in some trouble. After a bad call to manufacture 3000 Radar Scope Arcade Units, Nintendo of America found itself in dire straights. Donkey Kong thankfully came to save the day. Unfortunately Universal Studios felt that the game was infringing on their King Kong Copyrights. So they went to war in court.
Thanks to a Lawyer named Kirby, everything turned out all right for Nintendo.

I had no idea that King Kong was public domain, that is so cool.
Kinda. There are three entities that have legitimate copyright claims over certain renditions and depictions of King Kong but the story itself is public domain.

And now 40 years later Nintendo seemed to have patched things up with Universal with both the construction of the Nintendo world at their amusement parks and producing the Mario movie
They were burned by Hollywood Pictures 1993 live action Super Mario Bros. movie. Which was owned by Disney so Disney was a no go to partner with for them.

If Universal had won their lawsuit, Donkey Kong would only exist today in bootleg form and Mario wouldn't exist because the lawsuit would have bankrupted Nintendo.
Had Nintendo gone bankrupt, the entire video game market may have collapsed entirely. The fact that this *one* lawsuit determined the fate of an entire industry is crazy to think about.
So does this mean... I can make my own Donkey Kong game!?
No. Donkey King IS protected under copyright. King Kong is not. As long as it doesn’t infringe on elements or scenes from the movies and their remakes and sequels.
