Why no case was filed with respect to fundamental right to equality, against the the discriminatory order. This is direct violation of fundamental Rights. DoPT has intentionally issued this order to block the growth of PBORs, since signatories were officers.

You are spreading misinformation......the rule is if you want Pay Protection in your new job then only the component of DA in your defence pension will be stopped(u will continue getting defence basic pension but not the DA on it) and then your new basic pay in your new job will be determined as per your last pay band in defence at the time of retirement...e.g. your last basic pay was 39200 and the rate of DA was 15% at the time of retirement, so 39200+5880(DA)=45080........so now, for say, after 1/2 year u have joined the PSU/central govt job and now the current rate of DA is 30%....so now ur basic pay will be fixed in such a way wherein the basic pay + 30% DA = not less than 45080+ with one additional increament+two additional increament for those Ex-servicemen having completed graduation from any recognised civil University (not that one which is given by military authorities at time of retirement as graduation degree, this one is only valid for applying for group C post and getting selected)...... Note.....once you take pay protection, your DA on basic defence pension will be stopped.....but it's always beneficial to take the pay protection.
