If he claims EP, he is admitting guilt - the records are official, and belong at the Archives. No matter what the Master investigator finds in those documents that doesn’t change the fact that he is not allowed to have those documents with him ….he already broke the law by having those documents.

Whether or not the documents are classified is a “if a tree falls in the woods…” argument. Evidence of any declassification must by definition, exist within the government, or it didn’t happen. Furthermore, it has to be dated prior to 1/20/21.
🤔 How much do you want to bet that, IF they use "Trump declassified the documents" as their defense, they will "produce" a document as "proof". I think that's why they asked the judge if they could have access to the classified documents, so they'll know which documents need to be declared on that document that they held on to as "proof."
Sounds wonky, but their client drew on a weather map to "prove" a point rather than just admitting that he was wrong, and showed it to the world!

I just finished watching today’s Deadline show with Nicole Wallace including this segment . I just can’t say enough about Nicole. She is such an incredible interviewer, she listens so effectively and is able to ask such great follow up questions to her guests. She’s always so prepared and I am always impressed with the caliber and quality of guests she is able to get to appear on her show. She is my go to person to watch because I know I am going to get relevant information. I feel such a comfort level watching and listening to her show. I trust her because she knows her stuff, is so intelligent, and professional. I have had the same respect for Rachel Maddow but now we don’t have her to be able to watch as often. I continue to watch Lawrence O’Donnell on Last Word and Chris Hayes as often as I can . I am also a huge fan of Meidas Touch on You Tube who are phenomenal. I just feel a strong need to keep as informed as I can and these people help so much👏. I am a senior citizen and am grateful I have more opportunities to be able to watch and listen as often as I can but am concerned so many people have so many other things to do just to be able to take care of their families and try to have a sustainable job and so many daily stressful concerns 😞 Just keep trying and do whatever you are able to do. @@samueldejulio If he wrote on them, that makes them presidential records, so they belong to the Archives. And executive privilege does not apply to the executive branch of the government itself. Like a classified document prepared by the military, or a spy agency, can't be kept from the agency that created it.

Love Andrew Weissmann! Judge Dearie isn’t playing politics and it’s wonderful to watch the law take trump down. trump insidiously mistreats politics but when the letter of the law is followed, he has no chance.

That's worst case scenario. If they don't tell the judge they were declassified, then he's going to dismiss the proceedings. He might even find the Trump team in contempt if they don't give him an official statement. So, it could be by the end of the week, depending on what timetable Judge Dearie gave them to respond.
It's already over, Trump can't give official notice of his declassification of these papers. He'd be committing a crime if he did, lying to a Federal judge is dangerous territory. So he'll refuse and whine on the internet like a big baby and Dearie will automatically side with the DOJ. This whole thing has blown up in his face like never before!
They aren't declassified, and there is no attorney-client privilege. These are stolen documents!
