Dave gets all riled up but he should remember that he's only hearing one side of the "story". Lesson to be learned: don't make hand shake deals involving considerable sums of money. They should all be in writing. Even with a written agreement, there's no guarantee that the transaction won't turn sour.
You don’t need any other side of the story to spit the complete ignorance. She knowingly agreed to a deal with an ex, and now it is taking this much of a mishap for her to even understand the troubles. The rule of thumb stands that the only ship that doesn’t sail is a partnership. Kids do not change the facts. Hopefully she wakes up.

Not sure on this one that there is any info from the other side of the story that would really change much. If the deal was to sell the house after march 23rd then her side of the story makes complete sense.

kinda makes senese since they are going to sell the house in the spring and the Heloc is going to be like 1/4th of the equity of the house.
Yeah I think so. It sort of makes sense in this case because she doesn't have the liquid assets to settle with him now. If she had cash on hand she wouldn't need to. He didn't ask her if she had any non-retirement investments (that could be another way to settle up... but it's really just about risk management for her at this point)

Yeah, that was something Dave didn't hear - he couldn't even put his name on it since his credit was so bad! That's another red flag.
Dave mentioned it at least once, she has all the leverage here. All she has to do is reason with him, and if he is really insistent on having cash now, he should be more than happy to take it at a discount. If I were in her shoes I'd say to him just what Dave was saying at the end there: "This was not the arrangement we had, you want to deviate which is entirely detrimental to me so I don't agree and you don't have the power to unilaterally make this happen, if you are lawyering up that is your right but it will not get your money sooner and will cost you a large amount, I'm willing to retain an attorney but we can settle this now if you want to negotiate a mutually beneficial alternative to the deal"
Maybe he is very desperate for the money or maybe she is not easy to work with and he wants out. Hard to really know.
Dave is right, taking it to court won't get him the money any faster, plus he gobbled up more money along the way. What a tool.
This why it’s important to have signed agreements, ex husbands fault for not doing it and her fault as well. But since it’s under her name she’s in the drivers seat.

Because it is fairly sound advice in this instance - so long as she actually intends to follow through with selling the home in March. A few thousand dollars in interest vs many tens of thousands in taxes. Only thing Dave hates more than handing money to the banks is giving money to the gov't.

Why does Dave automatically hate the ex husband? All we know is that he wants his money a little earlier because he’s having a pretty serious surgery. Even the caller seemed uncomfortable with the insults that Dave was hurling at him. She just wanted to fix the financial issue lol.
Because the ex is being messy and manipulative. Needing a kidney does not mean he’s going to die anytime soon. His financial issues are not her problem because he agreed to the terms. He wouldn’t try this with anyone else but her because he thinks he can get away with it.
Because Dave can´t go home to his wife if he says anything negative about the women or holds her accountable. He is a simp.

If he decides to lawyer up she will need legal representation, or at least a placeholder to draw this out until March 2023. She doesn't need to lawyer up just yet but she should set aside some funds for it as well as reach out to a few good contract lawyers in her area (the more the better before he has a chance to)
This is why Dave shouldn’t give legal advice without a law license. As an attorney, He has a claim. You don’t have to have a partnership in writing to have a partnership. And she’s admitted they had one. He can then dispute the verbal arrangement in terms of timing but it’s his word against hers. But he could win

You had a (dumb, weird, unwritten) deal. That’s the deal. It’s to be sold in March. If he needs his money now, he could offer to cover the entire tax burden. Otherwise, pound sand indeed, the deal is the deal.

If you carefully listen to how she describes the situation in the beginning, she is clearly presenting the situation in the best light for her and omitting some key facts regarding the "business" aspect of this. She says that she bought a house for $600k leading you to believe that she paid for it, but then says the plan was to do a few flips in order to later be mortgage free - so there is likely a mortgage on this property. She then says that she did a $200k remodel and the husband paid $157k, and later says that she is considering a HELOC to pay the $157k - so the husband wasn't taking any interest or profit? She also says their "intention" was to wait until March to sell, but she didn't say our "agreement" was to do that. It's possible her intention was different than his intention. My guess is that if you asked the husband he would say that they bought it and were going to flip it immediately after the remodel, and she decided to live there and now won't sell it.
Unfortunately, if she is not knowledgeable of the law, she will have to hire an attorney too and both will lose/waste money.
At worst she just needs to hire a mediocre attorney that is able to draw this out until March, then she can settle up without either of them going to court.
Take the heloc like Dave said and give the ex husband the HELOC money

It’s is going to get worse, but there’s the tax problem if she doesn’t qualify for the primary residence capital gains exclusion. HELOC is the band-aid that provides a bridge to spring 2023.

Your ex husband gave you 157k to help you for the house you both lived in at one point and it just so happened that he is not on deed because he couldn't get qualified .also it sounds like his health is failing and needs the money for surgery...You have no legal obligation but I think you have an ethical obligation.
ex husband is worried that if he dies on the operating table and wants to make sure his one child gets his portion of the deal and not the ex wife. I imagine there's probably a reason or two for his worry. And somehow Dave and Ken infer that he's in financial trouble because of this.
Naw, when you co-parent you put your faith in the other parent to do what is best for the child. If he was concerned for his child he would have already lawyered up and gone to family court. It's pretty obvious the guy needs and wants money now and is being obtuse to try to get it out of her with no regard to for the long term interests of his own child (i.e. also the financial well being of the other co-parent).

What terrible advice! Go and get a Heloc? What happens if he wants more money? What happens if he wants the entire house. With no paper trail you will be paying crazy lawyer fees. Also, we need to hear his side of the story.

With her lawyer she cannot put the original deal on paper and admit to that being the original deal. The judge will hold her to that. If nothing is on paper it's only potentially a gift so gift taxes are involved?

Dave, usually your advice is good except when it comes to men in divorce striations. He owned the house with her and she used the equity for her business. She owes him the money and has to pay up. Yeah they should have drafted an agreement, but this does not change the fact that she owes him his share. If the situation were reversed, you would tell the man to pay up. Well, tell the woman to pay up just the same.
The agreement is to sell the house at a certain date and he wants to change it up. Nope. If that's true, he is wrong and that's it.
@@misterr2359 The problem is that there is no clear agreement legally and because of that, it is fluid. She owes him the money, bottom line. If she were to not pay him, wood you be calling her out on that? They should sell the property now while it can be sold higher.
