      You missed an opportunity here you should have swapped clothes stayed where you were the double with the pink hat clearly goes to McDonald’s to purchase some nuggets. Then the fun comes. You get the parking fine and refuse to pay. With the fine going up and up and the court date looming. You have evidence in court that you didn’t break the parking fine thus the greedy company has to pay the court costs.

      Feel like a a large number of GDPR data subject access requests are in order (Request a copy of all personal data they hold). It's free since GDPR rules changed, and they can be fined if they don't do it within a month.

    Used to work in the McDonalds as a student - did the night shift there and always had to clean up the car park - had to do litter picking for both car parks, not just McDonalds - they never even suggested it was two car parks and Starbucks didn’t provide anyone to clean up the area 🤷🏼‍♂️🤷🏼‍♂️

      I moved here 12 years ago and this kind of stealth tax stills riles me. Honestly, look at the cameras and signage all designed to extract money from the normal everyday hardworking people. How is this allowed? The thing to do is highlight it as Joe has done and boycott these establishments.

      They are not valid in the UK, but they can send you a begging letter for £100. it's up to you whether you respond or not. Private companies cannot 'fine' you. They can ask you to pay for material loss, but it's not in any way in the region of £60, let alone £100!

      Typically southern gold digging this behaviour. Northerners won’t tolerate it. I’d ignore any charge and wait for a court date. Force your accuser to come face to face and make them explain to the actual court’s satisfaction not POPLA’s how an open space has a non descript boundary. Judges will chuck this out in seconds and it only takes a couple of cases to get a precedent set. Problem is most are too scared to go to court.

    My biggest concern, how does a private firm issue fines? Who enforces that? If I refused to pay who would be the court I go to?

      You get invoiced. If you don't pay that's a breach of contract and you can be taken to the small claims court. There's a test case where someone did get properly fined by the court for refusing to engage with the parking company so you can't just ignore it completely. Equally it is definitely an invoice not a fine.

      They probably won't bring it to small claims since it won't be worth their while. I suggest writing them a letter asking for full printed documentation of the incident including physical copies of any CCTV in question and proof of their identity. Don't be too shocked when they don't write you back. If you get another letter, refer to that one. Just because someone says you owe them doesn't mean you do. If you're going to pay at least take up 100 pounds of someone's time and toner

      It’s a SCAM which the law allows, wonder which politicians benefit? If your going to McDonald’s then technically they have allowed you on site to do business , it’s not listed as a fine, it’s a parking charge.. as they would not be allowed to fine you. Say you have driven on and not looked at signs, you are unaware and in law can’t be liable for a penny.

    This infuriates me! How can people be comfortable with themselves when the are quite simply crooks? This should absolutely be illegal, and both McDonalds and Starbucks should take responsibility too as it’s their customers who are being ripped off. It’s not good enough to simply say it’s down to the landlord. Well done Joe Lycett - keep the good work!

    they're not legal parking fines; they're privately issued invoices and are unenforceable. if you get one, bin it and ignore the followup letters. eventually they give up. if you get one on the actual roads though... pay up.

      Yeah, only the Government can issue a fine. Private companies can *charge* you and you absolutely can ignore the odd one, I've done it three times now, over the last few years. If you were to habitually park without paying in the same place, okay they might take it to court, but all they can do is sue you for their loss of earnings, hence it's only worth it if you've racked up quite a bill in what you didn't pay in the car park (NOT the made up amount they try and charge you by post).

      @L Duncan I get your point but id argue that there is big diffrence between a road sign that is standardized to be readable. Or a single parking sign but to have 6 in different formats with differing infomation is riduclus. Its like saying "hey you've read the first Harry Potter now try Platos Republic and I want a summary of that before you can get a happy meal. I hope you trust im arguing in good faith, and also have a nice day.

      You can safely ignore these fines on private property. And, on no account respond or you have entered into a contract and they can pursue you for monies.

      @L Duncan Unpless the issue of comprehensive reading to this level is needed to pass a driving test it is a good point. Your subjective opinion regarding skills needed to be a proficient driver may obviously differ. More importantly this show acknowledges the use of deception ie. Overly complicated jargon and small font. This show is here to highlight often 'legal' yet morally dubious attempts at taking advantage of people. Some of which may be more vulnerable than others as with the commenter with which you disagree. The law is frequently changing based upon societies moral values shifting... This show helps to highlight these changes.

    Why not bring it to Starbucks and Mc Donalds. They hire the firm. Do they get a procentage of the fines? It is bad PR for them that their customers get scammed.

Still, regarding your point (you really don't need to be mean), i agree with you, that they are currently investing into the land property, however i also know a number of cases, when they actually didn't own the property, or even we not directly managing it (i can give you a number of examples in Frankfurt).       You mean just like councils and government do when you dont pay your taxes or some arbitrary fee or license? At least with private property it's a civil matter that often goes against the company if challenged, with little legal repercussions.

      @@C.I... I can't find it either...I do recall a guy doing just that,by going into a park it is assumed that you accept the T&Cs,but by disclaiming acceptance you are in fact trespassing,but he wasn't ticketed for that. It was in a UK paper about 2-3 years ago.

      @@elizataylor1726 I'm not 100% sure how it works, but I know you can't be arrested for trespassing as long as you leave when you are asked, so if mcd's or starbucks asked you to leave and you refused you could be arrested for trespassing

      @@TheNeilwiz01uk you can't be arrested but you can be sued. Given they already have your home address and video evidence of your entry to the car park, it would be a rather quick matter in the small claims court to be awarded more damages than the fine itself.

      I would think that the responsibility lay with the driver of the vehicle, rather than both people. So if the driver went to McDonald's, he would be fined. But I'm probably wrong.       In this case, drop the passenger off in the Macdonald's bit, you go to Starbucks and get your stuff. Drive out the Starbucks car park and pick up passenger.
      Even better idea, don't go to Macdonald's/Starbucks in Stansted

      Because Starbucks and McD are all owned by franchises these days. The owners of the site rent out the units to the franchise owner and then the land owner hires out a parking enforcement company to manage the land for them.

      I would say that the parking lot was for cars using that shop only, if you park and leave the premises then you are not going to that shop and thus not allowed to use their carpark. still a dick move but many places will have these signs as they don't want people parking there all day if they aren't spending money at their shop.

      But you WERE a patron of the establishment whose car park it purportedly is,therefore you DID use it as a customer,buying a product from them - whether you also visited another establishment (within the time limits) or not. And they should have made the rules clear on their signage,but of course they don't do that because they're basically pulling a fast one on the customers.

    In Germany, if the print on the sign is too small to read while entering the parking lot, the contract is void and the fine must not be paid. Also, thanks to some of the strictest privacy laws in the world, there is no CCTV to take your registration number or face, or actions.

    McDonalds habitually use very underhanded companies to run their carparks. When you complain, they just fob you off and tell you to take it up with the carpark firm, completely distancing themselves from any responsibility. I got a massive fine after parking at the Gatwick McDonalds, just because I ate in the restaurant for more than the maximum allowed 20 minutes. Completely unreasonable to expect customers to wolf down a meal in 20 minutes just to avoid being fined. Again, apparently nothing to do with McDonalds, it's apparently a policy of the carpark firm. This was a few years ago, I wish Joe had been doing his programme back then!

      Jack Smith Yes, I did that at the time, and just got a snotty generic letter back about them not being able to get involved in disputes concerning individual franchises. They were totally uninterested. If I’d had more time I would have taken it to the press, but couldn’t risk being faced with an even bigger fine or CCJs etc.

    My partner got caught out in this car park scam. She took a group of friends for a coffee only at the last minute they changed their minds and went for a Macdonalds instead. She parked in the Starbucks car park as she wanted to buy a coffee from Starbucks and did. But as her friends were in Macdonalds she decided to join them in the outside area at Macdonalds with her Starbucks coffee. She got a fine as she had crossed an invisible line and left the Starbucks car park and over to Macdonalds. As she was a customer of Starbucks having bought a coffee she didn’t think she had breached any car park rules.
    We previously had a fine from the same car park when MET claimed we had parked illegally. When in fact we were stuck in the road by a car doing a 3 point turn. I’m their own photos you could see us finally park in a parking space! They conceded and the fine was removed. On this occasion we did in fact walk to Macdonalds from the Starbucks carpark but this wasn’t an issue on that day.
    It’s all very well having multiple signs with small print, but I assumed the only significant issue was not parking for more than 45 mins seeing as we were so close to STN airport. I thought it was to prevent abuse from taxi drivers and the like and not that there would be in effect 2 separate car parks. I have never come across a similar situation in 25 years of driving.
    There should be 2 separate entrances. Even so, so long as I am a customer in your shop, I wouldn’t expect to be penalised in this way for what is a minor infringement. Jesus, I must owe Waitrose a fortune for all those times I spent £5 and went into town for an hour!

    Is no one else disturbed by the fact that they are using their cctv technology, I'm assuming someone watching paying customers coming and going and number plate reading tech to monitor their customers? Mac d and starbucks must also be aware that this is going on. This is the sign of what's to come. Boycott any companies that engage in this kind of thing.

      Indeed, CCTV ovrlooking neighbouring property is possibly infringing the GDPR rules. I would imagine the sign small print says your personal details are being recorded when on their property, but that doesn't waive rights to anonymity on other property.

    If we’re talking absurd ways to park and go into both stores
    Cut a small, lightweight car in half
    Join the halves with a long, accordion like material and structure
    Put a door in the middle
    Park each end in a space in each car park
    Exit the car through the accordion centre
    You now have your car parked in both spaces at the same time
    Easy solution

      A bailiff will only attempt to collect if it goes to court. Most of the time they won't bother with that because they don't want the risk, cost and hassle when 90% of people pay without having to resort to legal means.

    Absolutely criminal. They should be thrown in jail, not being allowed to go to one fast food chain to the other when you are already parked. There should be a complete boycott no one should pay fake fines let them take you to court they will soon go bankrupt with all the court fees.

    I know this carpark well. It fined my dad, grandma. My mum and my brother. My friend, I'd also seen something on Facebook yesterday about it getting somebody else.

    Well done for exposing what is in reality, a scam. If fast food companies have so little respect for their customers, perhaps they don't deserve the business. There are lovely villages and town near Stanstead (eg Dunmow), with cafes and restaurants; detour and give them the business. Enjoy the experience of the beautiful countryside.     I think Joe should get a team together each with a car. Then they each should spend the maximum allowable time to purchase the cheapest available item. Then they should drive to the other car park and do the same again. Keep repeating this for a whole day. Neither company will have made very much money at all and all other potential customers won’t have been able to find anywhere to park. Money talks!!

      Salvadori Popadillo in this case a boycott won't hurt the bottom line , weeks and weeks of people swapping car parks and buying the least amount in product and using even minute of the allowable time prevents people not involved in the boycott from buying and saves them the grief of maybe getting a fine . When the businesses start loosing money they will then take an active involvement in how the car park is managed .

      @Keith Panton Unfortunately in the UK, criminal damage can apply to any action (regardless of whether or not the damage is permanent), which costs money to fix or reduces the use of an object. As much as I agree that these tactics are morally reprehensible, and that the piece of cardboard solution would be a much lesser fine than the spray paint, it would still get you a fine regardless. Look into the case of Morphitis v Salmon [1990] for evidence.

    Just appeal it and go through the independent authority. You'd lose but by law you can demand to see all evidence, proof of signage, the contract that proves they are responsible for the land etc etc. Just be a massive pain in the arse and they'll drop it

      There is no independent authority. They all opted out of it years ago and set up their own ran by Gladstone Brookes... so, no conflict of interest there then. And since Beavis lost the high court case they essentially now have permission to takes our pants down however they’d like.

    Joe, there is nothing unlawful or illegal about covering your front and rear number plate with something like newspaper before you drive into the site and removing it after you leave the site.
    That way the ANPR cannot record your details. Beat these shysters at their own game.
    This land is private land so the best thing is to cover the number plate when you've pulled off the public highway and before you enter the car park where the ANPR camera can record your number plate then uncover it when you've left the site before yoh reenter the public highway.
    Absolutely no law against driving on private land with a number plate covered up.

      @@DVSPDC perfectly lawful to cover it whilst driving past an ANPR camera that's on private land. This specific site is private land therefore if the number plate is covered over on private land then there's no law been broken.
      The public highway is up the road so if the number plate is uncovered before re-entering the public highway no law has been broken

      @mike A mike, this is 100% private land within Stansted Airport owned by a private land owner. The public can use the car park but it is absolutely private land.
      Check UK land registry and you will see the site is privately owned.
      I live in this area and know this site very well.
      Met parking only operate on private land, not public land and their contracts are always with the owner of the land to operate their scams.
      Also Mike its a bit of a give away that these shysters have an appeals process called POPLA which stands for parking on PRIVATE land appeals!!!! 😊👍👍😂.

    I visited the UK from Australia and on my return found I'd got a parking ticket. The car park was one I'd driven into, couldn't find a space and so drove straight out. I emailed the car hire company explained I wouldn't be paying but they still took a fee for administration costs for dealing with the Car Park company.
