      If there is proof that they deliberately waited until after season passes renewed to make the announcement when they likely already knew, then there should definitely be some legal consequence for that. It's manipulative and scummy.

      @@KyleJPie10 i disagree. i think rides being open or closed for safety is a valid reason, and prior knowledge does not negate the validity of a season ticket. it's about safety, not about duping customers. they could have known since the park itself opened, it doesn't matter legally. if it was the only ride in the park then yes. the seasonal ticket grants u entry into the park for the season...if a ride is closed, or going to be closed for maintenance there can't be any legal recourse...

    I've never seen an amusement park pass that didn't say "not all rides and attractions may be available" somewhere in the fine print. I see this getting thrown out of court rather quickly...

      I lived in Pittsburgh for 7 years and frequented this park several times a year in the '90s and early 2000s it was okay. It was very historic and nostalgic. I enjoyed the old wooden coasters and the racers. But I don't put it on the same scale as large parks. It's a quaint historic amusement park. But it's far from great at the time I was there it was the steel phantom I wasn't very impressed. And that was their flagship coaster. I would say it's more for young kids than amusement park enthusiasts. They just don't have the scale of rides that most amusement parks do. Most of their coasters would be considered the coaster you hit last at any other park. Other than the thunderbolt really nothing impressive there. I actually enjoyed the indoor coaster the most of everything there.​@@PhillipJames-pw1sz

      Not to be argumentative but technically you are incorrect. The basis of the lawsuit is that indefinite closures are the point of discrepancy. It has nothing to do with the fine print of the pass, it has everything to do with the timing of the announcement. This is a suspected "bait and switch" scenario. The lawsuit will uncover the paper trail and will likely be a judgment based upon the lapse between determination of resolve and announcement to the public.
      In layman's terms, if there's a paper trail showing the park knew months ago, they could be liable for the cost of passes to anyone that fall under that window of a bait-and-switch scam.
      The only reason I am confident in this is because I have seen this exact situation play out about 10 years ago or so with a local "waterpark" that is more akin to a public pool, so take that for what it's worth.

      What about the time you wasted buying the ticket
      The interest accrued in your credit card
      Electricity used to run your computer or phone while purchasing the tickets
      Cost of food to cover the calories used while operating theme park website to type in username credit card # etc.
      Upon visiting the park, the time, food/calories and risk of injury that is wasted walking past/around the non-functional ride in order to reach a functional one.

    I'm a season pass holder and have been going to Kennywood for over 50 years. This is a BS lawsuit. Even without this attraction, the Kennywood season passes are a very great value. I buy season passes from many of the parks in the country and Kennywood has the best deal on season passes. This is nothing more than a money grab from greedy people.

      Also, there's other Flagship coasters and rides in the park that shouldn't lead to them suing. I mean, you got Phantom's Revenge, Thunderbolt, Racer and Jackrabbit then you have Turtle, Kangaroo, Spinvasion and Aero 360. I went last year knowing Steel Curtain wouldn't be open, I was disappointed, but still had an amazing time at the park.

    Come on people. It’s only 109. 00 for a season pass. And compensation can award 900 per pass holder? So in essence, the season pass holders can financially damage or bankrupt the park and a huge loss to Pittsburgh if it would close down and disappear. Let Geauga Lake be the example

      It causes nothing but problems for the neighborhood never used to till it went corporate!!
      Now they push the shootings and fights out to us yes us that live around the park. And we deal with it so you won't find much agreeing in west Mifflin! They do nothing for us .

      Well, maybe Kennywood should have thought about that before selling season passes at full price. They should have been proactive and offered the holders a discount... But as it is, Kennywood is not worth $75.00 for a single day visit... the park is 96 acres total, parks 2-3x that size charge the same price and you get more attractions.
      word is they knew Steel Curtain would not open this year back int he fall of 2023... but they led people on like it would be, and only dropped the bombshell after season pass sales surpassed previous season records... so in essence it was a rug pull.
      Kennywood chose to build that ride and spent way less than it would have cost for a reliable B&M that could have been configured the same way... this is what happens when you go cheap the builder is known for problematic rollercoasters. When they owned lake compounce in Bristol, CT they spent money to build Boulder Dash but never spent money to maintain it, instead selling the park and letting the next sucker inherit the problems of roughness.
      Kennywood has had poor management for over a decade and unless they replace people it will continue to go downhill.

    Oh please. 🙄 What a total waste of any court’s time. If you’re buying a season pass to Kennywood just for one ride, you’ve got problems. I was there for the first time in mid-2021, and Steel Curtain was down. I was disappointed, but it’s just a ride. Also, I live in Orlando and have an annual pass to the Disney parks, and it costs nearly 7 times what Kennywood’s does. And that’s for a discounted Florida resident pass too. So don’t complain to me about an entire season pass for around $100. That’s a total bargain, and you have tons of other incredible rides at the park for that. I think people have been mindlessly buying into legal billboards along the freeway in PA.

      It really is a waist of time. I agree $100 is reasonable for a season pass. You go to the park 2 times throughout the season and that pretty much covers the pass price. I don't have a season pass because I can only go to Kennywood once a year, if I lived closer I'd definitely have a season pass.

      Something tells me Parques Reunidos (owner of Palace Entertainment, who themselves own Kennywood) can handle the cost, seeing as they run 17 amusement parks internationally, not including the zoos and water parks. This isn't some small family owned business like Knoebels, a lawsuit over season passes isn't the end of the world for a corporation like Parques Reunidos, they would never shut down the park for something like this, lol

    This is a fine example of why everything cost so much. Kennywood will probably lose out on this lawsuit, but they will just jack up the future season pass rates so no one really wins. In America when you don’t get your own way, you just try to sue people. I find it hard to believe that people bought a season pass for one ride.

      And unfortunately, if they loose, Palace Entertainment is already on shaky financial ground. And they bought my neighboring Amusement park in Iowa, Adventureland, a couple of years ago. All these parks will be in danger of closing because there's no operator who is in the shape to buy them all post-COVID just yet.

    If the Steel Curtin closure was announced, would you still have bought the pass? Why go to court if you don’t want the pass because it is closed, just get the pass refunded. No need for court to handle.

    I understand it's not fair if they knew that this season it's gonna be shut down but on the other hand giving people way more than they paid for their passes is not the answer either $900 is ridiculous when you only paid the $106 for the lowest tier pass up to the 239 platinum pass they should just get their passes refunded and get a free season pass because giving them more money than they paid cause financial strain on the park and wind up closing the park and no one will ever write it ever again!

    No, this is stupid. There's plenty of attractions, and $100 for a season pass is a very fair price. Rides often are closed for maintenance and repairs, and the pass isn't for just one ride. It states on the website, the ride is closed. The question then would seem when that was posted online as the benchmark of when they decided what to do with the ride, either open as is, close for minor repairs, or close for a long term reimagining. Disney doesn't give refunds if space mountain is closed. Get real. This is such an instant gratification, sue happy world these days! Go enjoy the dang park, and I'm sure you'll get your money's worth! Jimminy Christmas!

    Yall mad over one roller coaster. Me and my family drove 6 hours to Kennywood in 2020 after checking their website and saying everything was open (I’m from NY State and at the time Pennsylvania had the Lowest Covid rates and restrictions) and when we got there almost half of the rides were closed, every time people got off the ride the sprayed it down then ran it again with no one on it to dry it off so that made lines almost wrapped around the whole ride. The black widow was closed, and people had to sit in every other seat on rides which meant that the ride couldn’t operate at full capacity and that made lines even longer. I was a kid at the time so I mean I still found fun in the experience but looking back I didn’t even get to experience about 25% of the park😂

    That should be a quick case. When you buy a season pass you get the whole dang park! There's dozens more rides in the park than just Steel Curtain! That pass also has food and merch perks too, so when you buy that pass you're getting your money's worth even if 1 coaster is down the whole season yet again. I love Steel Curtain, yes, I am disappointed it will be closed again, but will that stop me from visiting Kennywood this year? Nope, with it being closed I'll go ride Phantom 2 times as make up. This case should be dismissed.

    The people suing will actually regret this, if they win it will push up prices around the park and next year, entrance tickets and season passes prices will increase as well to compensate for the losses which will sadly effect everyone all for the pathetic reason that ONE ride is down all season
    Surely this will be thrown out of court anyway, they always state rides and attractions can be unavailable at anytime so surely this will be covered in their terms and conditions of the pass,also it’s ONE bloody ride, YES I would be massively disappointed but I wouldn’t be pathetic to try and sue, there is still lots of other great rides to enjoy at the park

    I mean customers are paying $109 for a season pass to enter the park and enjoy everything available, not just ONE ride. This is why Canada calls the U.S. "sue happy". Ridiculous. I could see if this were the ONLY ride in the park. Surely it's not the only attraction or activity to enjoy at Kennywood.

    Phantom's Revenge is better anyway.
    If I was in charge, I would've let people opt to get a full refund for their season pass if they hadn't used it at all because it's good for PR, like how Merlin (Legoland, Alton Towers, Thorpe Park, etc.) refunds people's tickets when their rides are closed for too long, but they have no obligation.

    keep in mind, Steel Curtain is down a lot anyways, because of that the reason you go to Kennywood, is not for Steel Curtain, this will make it a reason. It would be one thing for Lagoon to say Cannibal is down for the season after selling them, that would feel very manipulative because Cannibal is THE reason you go to Lagoon, it's what put it on the map. But for Kennywood, that's Phantom's Revenge, not Steel Curtain because Steel Curtain is down so much.

      It’s an awesome ride. They just need to get the bugs out of it. Likely new electronics and new trains. The electronics that run the ride never worked right and they very often could not run more than one train on it. Glad I got to ride it when I had the opportunity.

    I waited almost an hour to ride the thunderbolt this place is home lots of heritage and a great time, the only problem I had was then the ski lifts stopped for almost two hours while on it

    They're only taking big precautions with always closing it because the park is here in the northeast where the weather puts a lot of stress on the rides , our winters at some point are bone chilling and very cold temperatures like that is very rough on metal....it's always rainy here in western Pennsylvania and rain is very acidic and it eventually leads to rusting of metal which in turns weakens the metal.

      No surprise, but thanks for the reminder. I like to visit Knoebels (have never been to Kennywood but maybe someday). Some comments were saying things like "Why did you post this? It's not even open." I'm a PA resident myself and think it's normal for parks to close in winter -- but not all theme parks do!

    the only thing about this that might put the pass holders in the right is if Kennywood directly advertised Steel Curtain being open during a big season pass push and people buying it thinking SC would be open when it wasn't going to be open.

    I get both sides but i leaj more towards agreeing with the people that bought season passes. I dont have a problem with the ride being closed for the entire season but as a rollercoaster enthusiast if Steel Curtain is my favorite ride there and i buy a season pass specifically for that ride only to find out itll be closed all season id be upset too. Is it worth a lawsuit? No. But communication is important and you cant just throw money away nowadays so yes i do agree that its the parks responsibility as a business to let its customers know that their flagship attraction will be closed all season prior to using the ride as advertisement to sell more tickets. If we held more businesses accountable like this we wouldnt be paying extra for less.

    I'm amazed Kennywood isn't settling out of court here. It would be so easy to just simply refund each season pass holder $30 which I believe is the season pass value of Steel Curtain. This is really stupid on Kennywood Park, especially because of the bad publicity this is already generating now for them. Evidently a bunch of idiots are running this park and they deserve what they lose at this point.

    Looks like a great way to shut down a historical park. Hry guys lets scree the only park thats close to us by taking all their money for repairs upgrades and operating costs andd make it impossible form them to continue to operate.
    If i were kennywood if i won the lawsuit i would put those people on the lawsuit on a list that upcharges them everything 200 percent and ban the lawyer for life.

    They have a point. The park waited almost until opening day to announce it. They probably knew it would be offline long before that. The only reason they would wait is so that the announcement would not have an impact on season ticket sales.

    This lawsuit has merit. They used pictures of this ride to sell passes all the way until days before opening day when they announced it. They knew and planned its fate likely last season when it didn’t stay open.

      If you bought season passes expecting to ride the roller coasters, it's huge. They did not let people know ahead of time that the Steel Curtain would be closed before they purchased their passes

    Seems the park is being proactive! Would you rather have a incident like top thrill had at cedar point? Let them take care of the ride; even if it takes closing it for a year. Have some understanding and save the park some cash, it costs enough bringing you all this entertainment.

    $109…. Is not that much 😂🤣 look at Disney .. they pay $700+ and have major rides down sometimes 6+ months or more…
    cF annual passes are $200+
    Busch gardens $60+ a month
    Other parks are expensive compared to this and it’s not even a big deal..
