Aliens, whether individuals or corporations, have been disqualified from acquiring lands of the public domain. Hence, by virtue of the aforecited constitutional provision, they are also disqualified from acquiring private lands. The primary purpose of this constitutional provision is the conservation of the national patrimony. Our fundamental law cannot be any clearer. The right to acquire lands of the public domain is reserved only to Filipino citizens or corporations at least sixty percent of the capital of which is owned by Filipinos.” The Supreme Court went on saying, “In light of the foregoing jurisprudence, we find and so hold that Benjamin has no right to nullify the Agreement of Lease between Joselyn and petitioner. Benjamin, being an alien, is absolutely prohibited from acquiring private and public lands in the Philippines. Considering that Joselyn appeared to be the designated "vendee" in the Deed of Sale of said property, she acquired sole ownership thereto. This is true even if we sustain Benjamin’s claim that he provided the funds for such acquisition. By entering into such contract knowing that it was illegal, no implied trust was created in his favor; no reimbursement for his expenses can be allowed; and no declaration can be made that the subject property was part of the conjugal/community property of the spouses. In any event, he had and has no capacity or personality to question the subsequent lease of the Boracay property by his wife on the theory that in so doing, he was merely exercising the prerogative of a husband in respect of conjugal property. To sustain such a theory would countenance indirect controversion of the constitutional prohibition.“

    If the filipino spouse died how long does the foreign spouse have to do something about the property.

    Good day po atty. not more than 2 lots din po ba ang pwede po ma-avail na property kung may court-approved na Last Will ang namatay na magulang ng isang former filipino na australian citizen pero hindi po dual-citizen?

    My Aunt sold her house and lot to her granddaughter and they have Deed of sale. This granddaughter is foreign born but the granddaughter parents were both born in the Philippines before they acquire citizenship in United States. Was the transaction between grandma and her granddaughter legal? Can the granddaughter transfer the title on her name? My Aunt has two daughter in the Philippines when the transaction was made. My Aunt passed away in The U.S. in 2013, the house and lot title was still on her name. What procedure does my niece do in order to transfer the property on her name? Please advise. I would appreciate your immediate attention regarding on this matter.Thank you.

    My aunt has dual citizenship and owns our family home. She’s unable to maintain the house and needs to sell. Her stepdaughter is a foreigner and would like to buy the property. Would she be able to?

    What if I am born in the Philippines, relocated in the united state and became a us citizen, my mother inherited properties and land from her parents in the Philippines, she passed away leaving a will stating her shared inheritance goes to my son and I. My grandfather passed away away in the Philippines and my grandmother passed away in the United States. My mother has 7 living siblings and 2 siblings passed away. Out of the 2 that passed away one has no children and the other has 3, my grandparents had a total of 11 children. My son and I reside in the United States.

    My brother and I are US citizens and the only heirs to our Filipino parents (Dual Citizens). The 1st scenario you mentioned is similar to ours, but what if our parents have a will that does state their properties in the Philippines will go to us equally. Would that be allowed? It seems like it is always emphasized that we could inherit as foreigners if there is NO will, but what if there is and we would have inherited through intestate succession anyway? Should they get rid of their will?

    What if the filipina wife had a children before marrying the foreigner husband? Then they bought a land during their marriage.
    The wife die and leave no last will and testament, is the husband can have a portion of inheritance? Is he one of the heirs?

    With this information, I will now put the houses and lots up for sale! I will no longer assist her family because what I see is a lose-lose situation being a foreigner here! Let the Philippine government help them from now on! I love my wife and her family but will no longer risk losing thousands of dollars helping someone when their government says I can't own it! Today, I saw a RUclips video that said I cannot own the land my wife and I bought and built our homes on.
    My Filipina wife has developed a cancer problem. If she dies, I cannot own the land according to the video I saw., because I'm a foreigner. I've helped her family for 43 years and no one ever said anything about this before. I'm upset! I'm selling the property! They will have to leave! I'm not interested in leaving this property to them, because they will just sell it themselves. I am going to just find a small place to rent until my wife dies! And her family? I don't know where they will go or what they are going to do. And I don't care!

      Easy cowboy! I think you need to rewatch the video starting at 4:16 example 2. If you are married to a Filippina and the land is in your wife's name, in the uneventful day she dies, you inherit the land by intestate succession. BTW, you can't put the houses and lots up for sale. You don't own them. Foreigners can't initially own properties under their name. The properties all belong to your wife. Lastly, my opinion, if you haven't done so already, tell your wife what you think about her family. It seems to me, the day she dies, you will kick them off the property and let them fend for themselves. She deserves the curtesy after 43 years of marriage, before she dies, that you just don't care enough to help her family after she passes.

      @@CeasarBergonia I will not be able to help them anyway, because if I'm not with my wife, immigration will not accept my 13A visa anymore! Which means, I would have to marry a different Filipina or be deported! I am 78 years old and I'm slightly disabled by a stroke.
      And have a hearing loss! Being with another family would rush me to my death! It took many years to get her family to understand the limits between them and myself! And my wife already knows this! Having a different Filipina in my life would only bring her and her families problems for me to deal with!

      @@theodethomasa6358 what was the point of saying “I will put the houses and lots up for sale!, I will no longer assist her family….” Even if you do own the properties after your wife dies, you can’t use them because you can’t enter the Philippines. If you are really thinking about marrying another Filipino after your wife dies, I ask you to rethink that option. As a Filipino, I resent you for believing you and people like you are the only hope for Filipinos to get out of poverty. I hope you find peace in your life.

    Hi Atty. I’m a former pilipino citizen and now i’m a US citizen. I wanted to buy a small land in the Philippines but my husband is foreigner. I don't want to put my husband name in the property because he can't own it. Can my half pilipino children get my land if something happened to me?I’m not a dual citizen yet. Thanks for your time.

      Foreigners are allowed to inherit land by intestate succession (by operation of law). Philippine dual citizens can inherit and even purchase and own land in the Philippines.

      Easy to solve. If I inherited the land, I will order the house owner to move out and bring his home with him.
