    my supplemental claim was adjudicated in 6 days thanks to my VSO's help and advice. my primary care doctor filled out appropriate DBQ's

    Since I was denied sleep apnea can I open a supplemental claim/ and use it as a secondary to tinnitus. Though my research tinnitus can cause insomnia what is a mental health issues and sleep apnea can also be secondary to tinnitus

      Sleep apnea claims are very difficult. Whatever route for service connection you use, make sure you have solid medical evidence to support it.

    Your videos are great. My sleep apnea secondary to hypertension was denied in 2014. Only new and relevant evidence is my VA doctor statement that he put in his medical notes that " he uses his CPAP on regular basis thought he continues to have severe subjective sleepiness. head sx of sleep apnea while on active duty as well." this and the new medical technical on sleep apnea & hypertension. any thoughts? thanks

      Sleep apnea secondary to anything is a tough claim these days and I'd have to go through your c-file to comment on your case. But the VA should recognize a new medical opinion as a new and relevant evidence.

    Is there a special form to use when making your argument? I have 2 buddy statements and I am going to argue that my injury IS service connected ( that's why they denied me.)

      There's no special form for the argument. Writing in on the lay statement form is fine. On a higher-level review the VA might balk at it if they think it's evidence instead of argument. I use letterhead when I write an argument for a veteran for that reason and because I specifically don't want the VA to think I'm writing a lay statement.

    Great videos. What about if you were granted a rating and a rating increase after a Higher Level Review, but believe it's still lower than it should be, is the Supplemental Claim still the way to address vs filing a new claim?

      Generally yes, especially if you are withing one year of the Higher Level Review Decision. But if you are at the point where there is no new evidence for you to add, you may have to take it to the Board of Veterans Appeals but that's at least a three year wait at this point.

    I've always been a fan of Strunk and White, I apply their style guide to virtually all my written communication, especially my most recent Supplemental claim.
    *Vigorous writing is concise. A sentence should contain no unnecessary words, a paragraph no unnecessary sentences, for the same reason that a drawing should have no unnecessary lines and a machine no unnecessary parts. This requires not that the writer make all his sentences short, or that he avoid all detail and treat his subjects only in outline, but that he MAKE EVERY WORD TELL.*

      I couldn't agree more. The hard part is putting into practice. And the Elements of Style is a great book for all types of writing.
