Dear Najeeb, You are a great teacher. Blessings to you. I need help to solve two questions, I hope, you can help.:
1. A mails a bank draft of INR 50000 to B, his son as gift. B in return writes a letter to A accepting the gift. Before B posts it he dies. Whether the gift is valid? Would it make any difference if A dies instead?
2. A is the owner of land of which B is wrongfully in possession. A assigns his right to sue for mesne profits to C. Is the transfer valid? Can a right to sue be transferred?
The answer of first question will be according to Section 122 of TOP Act. Acceptance when to be made.-Such acceptance must be made during the lifetime of the donor and while he is still capable of giving. If the donee dies before acceptance, the gift is void.
Answer to the 2nd question is Right to sue cannot be transferred. Refer Section 6 of TOP Act.
