Civil Rights Orgs Challenge Racist "Insular Cases" Used to Legally Discriminate Against Puerto Rico

  • Civil rights groups are challenging a series of racist U.S. Supreme Court rulings that have been used for over a century to legally justify discrimination against people in Puerto Rico and other U.S.-occupied territories. The rulings are known as the Insular Cases and have allowed the federal government to deny Puerto Ricans living on the island voting rights, access to public social programs like Medicaid and food stamps, and other equal protections guaranteed to those residing on the mainland. The renewed effort to overturn the Insular Cases comes after the Supreme Court sided with the Biden administration to continue denying Supplemental Security Income benefits to seniors and people with disabilities living in Puerto Rico. We speak with Lía Fiol-Matta, senior counsel for LatinoJustice PRLDEF, which is helping to lead the new campaign, and with Democracy Now! co-host Juan González, who has long reported on this issue. "The Insular Cases established a doctrine that has no constitutional basis," says Fiol-Matta.

    Okay so now billions to Ukraine and supporting them but these people can't get what they are entitled to as a citizen of these United States... Come on now. They have to go register for military but they can't vote, that should not sound right to anybody. This is craziness... SMH

    This is all true, Congress owns Puerto Rico, like property. Govern by the Treaty of Paris. It inhabitants subject to the whims and laws of congress, the only way to overcome that delema, is to either become a state, or an independent nation. We have done nether, so this where we are

    Has anyone read "A People's History of the Supreme Court" by Peter Irons? I wanna start reading it, if it's good. I read "A People's History of the United States" by Howard Zinn and it's excellent.

      I studied Constitutional History with the now deceased Prof. Russ Galloway (Univ. of Santa Clara School of Law) during the early 1980s. He was the one of the few law school professors that i could relate to. His classes were outstanding and he was also a SCOTUS observer. TY Russ and RIP

      Puerto Rico is not a US State, they're not US citizens. They shouldn't receive any US benefits. They're already a huge welfare state. New laws should be passed to insure they don't get any more benefits than what they already receive.

      America is a continent. I assume you mean The the United States of north America. The now on days American Spanish speaking countries inhabitants, in particular of those who were the children of the Spaniards who settled in those new territories were called Americanos or in the Anglo language Americans.Those were the first Americans, they were part of a once mighty super power which many colloquially call now on days an empire to anything in the Histoy channel and other lessen academic TV programs from certain countries. That empire was the heir of the Roman empire since it was one of its children,Hispania or Spain, a nation who ruled over 2/ 3 of the world once upon a time. Who had to defend its dominiums from other rivals such as France, England, Dutchs, Ottomans, etc...who had to fight ALONE with less resources in many occasions against those other mentioned kingdoms because of their jealousness/ resents of its back then achievements in different fronts At the same time, and Who were the rulers/masters of the European continent.... for almost 2 centuries, without mentioning almost 5 centuries around different parts of the world. Puerto Rico didn't had to go through all this dilemma for the past 120 + yrs if
      A foreign power had not interfere. Not to brag but the old San Juan is an example of many other cities in Hispanic America of its European influence and there is no city or town in the US that can boast of an equal. The current state of affair is a Mess and I hope it could be resolved soon. There will be a light at the end of the tunnel sooner or later. A statehood doesn't mean progress neither a warranty of a better status, an independence? Well, the 13 colonies without the help of the European powers Spain and France probably wouldn't become an independent country by the late 1700's and we have to remind that back then it wasn't a power as some ingenious promulgate and broadcast.

    I had no idea about this issue. I am sure i am not alone in this. How can the Government hold countries they took as colonies prisoner to old bigoted rules . To deny statehood OR independence AND all the benefits given to others Americans . I hope something can be done to restore some fairness.

    It is such a shocker that of all people Justice Neil Gorsuch wrote a 10 page very detailed opinion including the history behind it to dismiss and remove the Insular Cases. 🤯

      Tbh Neil Gorsuch is definitely the best conservative on the Bench. He's remarkably consistent even when it's not in favor of the most conservative outcome. For example, he's been a steadfast supporters of Native American rights in almost every single Native case that has come up to the court.

    The power of words to obfuscate. Nations ruled by the US and exploited for their resources aren't "colonies," but 'territories." In these places, there are one set of rules for the territories and another for the mainland.
    The question is, after so many years of acceding sovereignty and becoming a colony, can Puertico Rico now survive as an independent nation?
    If it can, perhaps it's time to claim independence? If it cannot, Puerto Rico may sadly have to bite the bullet and remain a colony, perhaps indefinitely. Puerto Ricans will need to decide...

    I’m from the United States Virgin Islands. I don’t even recognize American sovereignty over the territory. They bought the islands from Denmark, who were nothing but imperialist owners, that should not be considered legal in the first place. My ancestors were forcefully removed from our natural homeland, and as such, should be considered the true owners in the absence of the aboriginal natives that no longer exist in the island. Everything else is moot in my estimation. At this point we require restorative measures from all former colonial holders of the islands, to put us on a path of independence, regardless of what the population feels at this time. Any desire to remain a territory or become a state, is evidence of continued mental slavery!

      Let us not confuse the Boricuas that are born in the island with those American born citizens whose parents are Puertorican which migrated to the states. See, if you are born in the USA you have all the rights that USA citizens enjoy because you are an American and may move to the island and enjoy them all. Those who are born in the island regardless that they are USA citizens will never be considered equal because their citizenship is not guaranteed by the constitution, thus making the island born citizens second class citizens.
      Also, I don't think some of you have visited the island to say is full. Many USA citizens say that the USA is full because of their racist and discriminatory views. Clearly is not.

      @@paull2166 Puerto Ricans are born into U.S. citizenship. In the first half of the twentieth century the American Congress established that people born in Puerto Rico would acquire American citizenship at birth. This took effect in 1941. And in 1952 additional legislation "grandfathered in" people born in Puerto Rico between 1899 and 1941, retroactively granting said group American citizenship at birth.

What we actually need to do is pass a few constitutional amendments to end government corruption and give the people far more civil liberties. The Constitution needs to be absolutely clear about certain things. That way there's no way to misinterpret it.

      Morality doesn't (shouldn't) enter the decisions of the court. One person who constantly injects his own moral compass into his decisions and reasoning is Samuel Alito. He's very obviously acting in his own interest to get his name into history books and be praised by right-wing Christians. He obviously views his work as his God's work and hopes to earn his place in Heaven. That's not the job description though. He should have been an evangelical pastor.

      We want that. However, the US would have to pay for reparations and there needs to be a 40 year transition to develop the economy without the shackles of the Laws of Cabbotage and the hold the US Marchant Marine has had over our economy for the past 124 years. We would also need to audit our debt and incarcerate every single politician and vulture fund executive that used revolving doors to generate an Odious Debt (a debt that is not used in the benefit of infrastructure and essential services). We also need the US Marine to clean up Vieques. This would be getting away easily for commiting a crime against humanity such as colonialism is considered under International Law, fabricating consent of imperial rule by way of gag laws, exploiting the connivance of local colonial administrators to persecute and massacre pro independence puerto ricans for decades, and for turning a population against each other by invading, occupying and intervening in our politics and economy.

    PR needs to vote for statehood. Nobody is stopping them but themselves. Why give anything if you won’t commit to the other 50 states.

      Only congress can grant the territories: PR, guam, virgin islands, etc, statehood. PR had a referendum in 2020 and statehood won 52-to-47. But congress has not granted any territory statehood in decades because they are too corrupt and refuse to reallocate the seats in the House of Representatives because it would cause other states to loose seats.

    Puerto Rico has never been more than a profit center for the US. And a strategic strong hold in the Atlantic Ocean.
    During the Spanish American war in 1898 the United States promised to liberate the inhabitants of Puerto Rico from
    Spain's colonial rule but, had a change of heart when they ended up wining the war against Spain, instead of liberating the island of Puerto Rico they ended up invading it instead. On July 25 1898 16,000 heavily armed U.S. troops arrived and occupied Guánica, stripping away any self-rule or autonomy that Puerto Rico recently gained from Spain unfortunately the people living on Puerto Rico became victims yet again to a new colonial master in America, the U.S. government has controlled the island militarily, politically and economically ever since. In the early 20th century, the Puerto Rican independence movement was picking up steam on the island it was growing rapidly and embraced by multiple political parties in Puerto Rico. For example In 1914, the entire Puerto Rican House of Delegates demanded independence from the U.S. Instead, the U.S. responded by imposing the Jones Act of 1917, which mandated U.S. citizenship for more than one million Puerto Ricans . It wasn’t exactly a gift or a blessing either, because one month later, on April 2, President Woodrow Wilson asked Congress for a declaration of war on Germany. The point of extending citizenship to Puerto Ricans was to get about 20,000 more bodies into World War 1 and to stop the growing independence movement that was taking root and flourishing on the island. The sad truth is Puerto Ricans are both citizens and colonial subjects of the United States. Here's another example the Resident commissioner serves in the House of representatives but does not have any voting powers it can only talk and advocate for Puerto Ricans but is not allowed to vote on any final passing of Bills (not even those related to Puerto Rico) nor for election of the Speaker of the house or other officials. They also have a legislature whose will can be vetoed by Congress anytime.They have been conscripted to take up arms and die on foreign shores for the United States, but yet they are not allowed to vote for its president while living on the island. After the 1898 Spanish American war, Puerto Rico suffered an immediate barrage of economic disasters. In 1899 a hurricane leveled the island, destroying thousands of farms and an estimated $7 million worth of the year’s coffee crop. Rather than send relief, the United States government devalued the island’s currency by 40 percent with just a congressional wave of the pen every Puerto Rican lost nearly half their net worth over night and again, in 1901, Congress imposed an unprecedented assortment of land and property taxes that crippled it's economy even further, with 40 percent less cash than they had before, and higher taxes. Puerto Rican farmers soon lost their land and by 1928, 80 percent of Puerto Rico’s sugar cane farms were US-owned. The railroad systems, trolleys, and the San Juan seaport were also US-owned, along with much of the island’s infrastructure. In the past Congress has excluded or limited Puerto Ricans from access to federally funded programs such as Medicare, Supplemental Security Income and the Supplemental Nutrition Assistance Program (Snap). Or Earned Income Tax Credit, the island also receives half the rate of federal healthcare funding even tho the residents living in Puerto Rico pay the same amount of Medicare tax as do other U S. Citizens living in the other 50 states and it does not qualify for federal bankruptcy protection either once again proving that the island inhabitants are colonial subjects being exploited and abused by America. Everything in Puerto Rico is controlled by the U S. Puerto Rico's currency, banking system, international trade, foreign relations, shipping and maritime laws, TV, radio, postal system, immigration, Social Security, customs, transportation, military, import-export regulations, environmental controls, coastal operations, air space, civil and criminal appeals, and judicial code is all controlled by the United States empire. They even changed the name of the island to Porto Rico after the Treaty of Paris of 1898 and ended up changing it back in 1931 to Puerto Rico after a joint resolution from Congress repealed it 33 yrs later lol. They also passed gag laws in 1948 making it illegal to display or own a Puerto Rican flag even in one’s own home. It allowed police and national guardsmen to enter anyone’s home without a warrant and search and seize all property, regardless of probable cause. It also became a crime to speak against the U.S. government; or to sing a patriotic tune, to speak or write of independence, or to meet with anyone or hold any assembly in favor of Puerto Rican independence breaking this law would send you to prison for 10 yrs. It was eventually repealed 9 yrs later in 1957. But as you can see the desire for independence hasn't faded away in the hearts of Puerto Ricans yearning to be free. The United States cannot pretend to be a model of democracy for the world while it discriminates against 3.5 million of its own citizens in Puerto Rico, depriving them of their right to political, social, and economic equality under the U.S. flag and under the U.S. constitution.
