Imagine that these police are dumb enough to actually show just how idiotic and ignorant, both of the law and personally they are. On video that educates tens of thousands of viewers on just how idiotic and prone to time wasting they are. “No issue” so why not buzz off and catch criminals.
Let me be clear ... there are NO RULES AND REGULATIONS CONCERNING FILMING. That's it. We do not live in a country like North Korea, where camera ownership is strictly controlled. We do not live in the sort of country where EVERYTHING is unlawful unless a specific law allows you to do something. We live in a country where NOTHING is unlawful unless there is a specific law forbidding it. This subtle but critical point is the basis of all law and citizen rights in this country. It's also amazing how many cops seem to think the former.
Meanwhile this PCSO is the sort of Old Skool Idiot who was brought up to "Never Question, Just Obey", so he probably thinks that he has managed to make it to the top of the pile where he can ignore all of those 'imagined laws' that he spent a lifetime obeying and now he can do as he wants. That's why he is wrong person for the job. Most PCSOs are thick as mince and best ignored if they try to start a conversation with you in the street.
They couldn't care less about the state of officers now. There useless bosses. The government want our police service to be in this state. And the senior ranks just tow the line & accept their unacceptable pay packets each month.

That footage should be used in PCSO Training under the “how not to interact with the public” section. What a tool. I’m betting he makes up all sorts of rules and regulations of his own design to force his own implied sense of authority on people who he’s dealing with. This PCSO is 'confidently incorrect' or otherwise known as a gobsh**e. Not doing what this clown says is "being obstructive". This fool is dumb enough to arrest someone for not incriminating themselves.
So the moral of this story is don't ever assume that just because someone is wearing a police uniform, that they know the law, will give you accurate information or will act within the law. These auditors do a great job not only exposing the woeful incompetence of some police staff but also by demonstrating knowledge truly is power.
Sad thing is most and I would say 95% of the police had no idea of the law, they spout laws, without fully understanding them, painfully unaware of rules and regulations, many are just on a power trip, and using the uniform as a means to bully people, these and many others videos showing the bullying tactics and lack of knowledge and in some case really vindictive attitude towards the people they are supposed to serve.

There is NO rank of officer in the British police, that rank is for serving military, merchant marine and passenger ships.

RIPA stands for Regulation of Investigatory Powers Act. It was introduced to provide guidance for the Police, Government Agencies, Local Authorities etc who undertake surveillance of individuals / suspects /criminals. In general it requires those who are undertaking surveillance to justify why they doing so and requires authorisation by a senior officer in the respective organisations. It definitely does not apply to individual members of the public. The PCSO was talking bollocks.

I suspect that he absolutely believed what he was saying was correct. It is not his fault that he has been grossly misinformed. He displayed the body language of somone who knew he was wrong but wasn't wanting to esculate to the highest level. He just wanted to stand his ground with the information he had. Still, he didn't want to check his beliefs of the situation before calling for a police constable. In my opinion he should not be in that job because he was dictating incorrect laws to members of the public.

It seems a rule that Police have extreme low general knowledge of how a democracy is organized and their own place in it:
1. Police is a legal enforcer of the state monopoly of violence.
2. The violence monopoly can only be enforced within the law. Deleting private films would be a breach of Human Rights - if not ordered by a court. The same is the case of using force for “seeing the film”.
The Police is evidently out of control and hence reality reflects what’s called a Police State, wherein the violence threat is abused.

The ICO can only fine a company or a business (trading styles) or a organisation. Its upto 4% of annual turnover to a maximim of a million £GBP.

I'm always amazed when they turn up. I can get only guess that these companies lie about the situation because I can't imagine they despatch for reports of a person filming and flying a drone 😂

I think if you keep your expectations at an appropriate level (e.g. reasonably low) and you see yourself more as a school teacher (say maybe at a school for children with special needs) it would be a very rewarding experience. Of course there’s always going to be those days when you get a biter.

I am a military person here in UK. I am required to attend annual security "training" as we live and work on a military site, and are potentially targets for all sorts of reasons.
I am also a very keen drone operator in my personal time. I am fully legal, with regards to operator ID and competency certification, as required by CAA, I'm also insured for public liability and accidenta damage that may potentially occur during my drone activities. I'm fully aware of the laws and regulations surrounding my personal hobby.
It upsets me to see the so called "training" that our military establishments give to my colleagues, with regards to drones. This is because they talk total nonsense, they teach opinion as if it is fact. They do not even touch on the actual law during training. Military sites are indeed protected airspace, that's all that needs to be said regarding my work site... but they continue on to spread misinformation, often fearmongering as well.
Unfortunately, I fear that the misinformation this particular PCSO was spouting, was indeed "taught" to him by some institution during "training" and that's the main problem here... public awareness and perception is bad because too many people spread wrong information.
I also fear that the "training" the security guards have received is also full of incorrect information regarding drones, privacy laws and so on, so can't really blame those people either, they have been failed by their employer.
Best comment on here. As a CAA registered drone operator who also employed by a UK police force I can confirm that certainly in my area the "knowledge" around this matter is poor at best, really winds me up

i agree. Also, give a human the tiniest bit of authority and they think they're a god. What makes this so very sad... is that the guy goddam knows for a fact, that he's making it up as he goes along. He is assuming that because he is a wannabe cop, and he's been given the responsibility of finding out what's going on with this guy who's been reported, he can say anything and he'll be believed. The way some police talk to citizens is disgusting, they're so condescending, it's like being told off by a teacher or something.

Some are, some aren't For example if you are in MATZ, then its protected.
@@Nickle314 Yes, but the unfortunate truth is that the training these people provide ends up being used outside of these zones. For example, a pen pusher, administrative type person... is forced once per year, to be "trained" about drones, because she works on a military base and drones are indeed a security concern.
The way the training is delivered and the opinions that are spouted as fact and true, will be taken in by the admin person and lets say they're out in the countryside one day with their family... and see you or I operating a drone, completely legally, in a perfectly acceptable location... they will still have that deep seated negative opinion of drones based upon the ONLY training and knowledge that they've been given about drones.
This is the shame I'm talking about, the training is provided by people who hate drones, not by people who KNOW ABOUT drones.

This is actually incorrect, individuals are only exempt from complying with GDPR if it is "processing carried out by individuals purely for personal/household activities." You are not inherently exempt, and I think you could easily argue this footage is not purely for personal use, since it has been posted publicly for 100k people to watch (although the officer could not have known this at the time).

Yep, ripa's apply to government bodies like police and councils to ensure that when they are proposing to film they FIRST get a ripa to ensure they are doing it for legitimate reasons with good cause, keeping footage in secure manner and using it for really good reason.

@@grahamwalker9193 to cut a long story short, an NHS manager unlawfully accessed my medical records. The NHS discovered the data breach and sacked her. They're paying me £5000 in compensation. Here's the fun part, I reported her to the police and they've refused to prosecute her. The reason, absolutely nothing to do with her husband being a serving police officer of course. The IOPC are currently investigating.
Watching this PCSO talk nonsense so confidently was hilarious but very concerning. Most people don’t know the law so could easily fall victim to the unlawful demands made by this clueless man. The female talked more sense than him.
My dad liked a phrase, "a wise man knows when he does not know". The police officer who turned up was such a man. He knew a bit on drone laws but recognised through listening / investigating that you knew more. Good work by him. The PCSO though was brave considering its clearly his first day. 🤔 his arrogance was based on perceived authority not actual authority. He needs to reconsider the position he is in, if he is unwilling to carry out actual study before venturing outside. But maybe on his second day he can do better?

Well said, but I would say at his age that it is his baked in character to perceive authority and wisdom. He is a liability to his employer. Telling members of the public such rubbish, as he did, could lead to someone harming themselves or worse. Its akin to bullying.

You would only imagine that any large UK based company who valued it's staff would ensure that they were all adequately versed in the law surrounding photography and the flying of drones in the public arena.

It is unacceptable policing to make up laws or twist their meaning. The police need to know the laws and act by them, when they are trying to enforce law. The training and monitoring of police practice, needs to improve. This standard is not good enough and potentially puts the public at risk.

Those pink thinks are actually for putting into drink bottles along with a straw to prevent spiking. They are given out by police around pubs etc. For some unknown reason some people decide to put them in their radio aerials.

I'm glad he was on public land when the other guy approached him. Makes it look much better. The ideal outcome is that only the subject makes a fool of themselves, and not the person filming. In as many ways as possible, it is good for the reputation of the video creator not to be seen making a fool of anyone, since they were the one who started recording.
@@benm5345 the police always say why didn't you speak to them first, so if I walk on to tell them and they ask me to leave, I always see if I can quickly persuade them otherwise but if it's a firm leave then I leave. Thanks for the watch

This gets a reasonable reaction from the plod, rather than being confrontational which gets their back up and arrests are made for that rather than the drone. Well done.
