Honestly this scares me, happened to my dad's friend where he lost his house and paid his wife monthly plus child support.

@@boston312 Not just that. The court can throw it out because the judge thinks it's unfair and "unconscionable." There are cases in CA and NV where a prenup was tossed simply because it let the man keep all of the assets he brought to the marriage and the wife could keep hers - but she didn't have much and he did, so it was "unconscionable."

If a couple married for 5 years, both has a previous marriage, husband has to pay 1st wife alimony plus child support, husband doesn’t have kids with 2nd wife and only married for 5 years, husband has been paying spousal support for 2 years now, but the divorce still hasn’t finalized, now 2nd wife filed to increase of spousal support. How long does husband has to pay? Will it become permanent spousal support?

    • @bradmichaelmicklin234

Not in New Jersey absent extraordinary circumstances. Alimony in New Jersey cannot last longer than the term of the marriage and the time that you pay during the divorce litigation is included in the timetable. I hope that helps.

Who says it's the man. My ex-husband refused to work. I supported us on $30k. I was tired of him not working. He tried getting it but it was determined I didn't earn enough and he could earn an income. He also, at the age of 56 moved in with his mommy.

Alimony shouldn't be nomore then 2 years tops. When the relationship is over everything should be over. When you get let go from a job they give a package for six months. Marriage should be the same way.

Question I live in NY. My partner has been legally married for 10 years. (And he has a daughter with her) They seperated about 2 years into their marriage due to Infidelity on her part, shortly before he met me. Now after so long she finally wants an official divorce. Now he doesn’t make a lot of money and has been on unemployment since covid . We have a child and currently are financing 2 cars that are under my name with her a co-signer. Is she entitled to anything? I hope not but I’m just making sure.

That’s really difficult to answer. First, I am not licensed in New York and do not know anything about New York law. Second, I don’t have any facts about his situation such as assets or debts or needs of the wife or a child. It’s hard to answer question about “get anything“ without this information. He should speak to a New York attorney. There are many that offer free consultations and answer any questions that he has. Sorry I couldn’t be of more assistance. Good luck!
