The Supreme Court has decided not to hear a case challenging Hawaii’s strict gun licensing requirements, leaving the controversial “spirit of Aloha” laws intact-for now.
“The spirit of Aloha clashes with a federally-mandated lifestyle that lets citizens walk around with deadly weapons during day-to-day activities,” Hawaii Supreme Court Justice Todd Eddins wrote, defending the state’s long history of regulating deadly weapons.
“The thing about the old days, they the old days,” Eddins also wrote, borrowing a line from the HBO series “The Wire” to warn against an overreliance on the culture and laws at the time the nation was founded.
This decision has reignited the national conversation about Second Amendment rights and the lengths some states will go to restrict them.
In this video, I break down the Supreme Court’s move, the original case that sparked this debate, and how Hawaii’s unique justification for these laws-the “spirit of Aloha”-clashes with the U.S. Constitution.

The Supreme Court’s refusal to hear the Hawaii gun case
Hawaii’s controversial use of the “spirit of Aloha” to defend strict gun control
How this decision fits into the broader fight for gun rights across the country
Why the anti-gun lobby continues to push unconstitutional laws
This isn’t just about Hawaii. It’s part of a larger pattern of states passing restrictive laws that take years to challenge in court, leaving law-abiding citizens caught in the middle.

Murdock vs Pensilvania 1943
It'd be one thing Hawai'i had no crime and no need to defend yourself against violent criminals, then maybe they could make the case that guns aren't needed. However, Hawai'i, just like all other disarmed populations (UK, Australia, France, etc) have tons of violent crime, including with guns. As always, it's not about public safety, it's about preventing people from being able to defend themselves against violent criminals, including the government itself, forcing people to be dependent on the government for their safety, thereby keeping those criminals in power. It's extortion and slavery but with extra steps.
It’s concerning how some states justify restricting basic freedoms with cultural rhetoric. The Constitution doesn’t take a backseat to feel-good policies.
It’s called Bolshevism and it’s by no means new.
Cultural rhetoric is exactly that. The law is quite clear, the Second Amendment is law, and is a Right of every American.
I find it weird how a state like Hawaii, where one of the most historic events happened before it wasn't even a state (Pearl Harbor) can justify against a basic constitutional right ironically protecting citizens from FOREIGN or domestic threats. Kinda strange.
Bad vibes.
I vote we repeal Hawaii’s statehood and put it back as a territory. There are more deserving territories of stateship.
I’m born & raised in Hawai’i. It’s now an insane clown show.
Because you let the rich and us government come in and take over.
It's because they think the Democrat party is the "intellectual" party but really it's the clown party
All the younger generation has moved to the mainland leaving elders dependent on govt programs which typically come from the left.
New York isn't no better. Glad I'm in the Ozarks 🌄. Go President Trump🇺🇸🏁
I guess Magnum can't own a gun anymore.
Hawaii is a state of the union, in order for Hawaii to join the union they agreed to obey the constitution of the United States.
You might want to read just how they were forced to "join the US".
Here's a hint they didn't want to but we're forced to
Doesn’t matter. They must follow the constitution which is the supreme law of the land. Nothing above it. All states are bound by it, no matter how they joined the union.
@@jst2708there was literally 132k votes for becoming a state and only 7k votes not to…. If more people opposing becoming a state didn’t vote then that’s their fault. They’re a state and will be until America falls and then Hawaii will belong to another foreign entity.
Legally speaking technically they're not part of the United States @@jst2708
So is California, New York, Michigan, Colorado, etc. These liberals don't give a crap because there are no real consequences to what they are doing. Look at what happened in New Mexico. The governor there banned guns through executive order claiming it was a health issue. It has been overturned, but it doesn't stop them. I personally think we need to put in place a law that says that multiple attempts to infringe on the Constitution by those who take an oath of office are acts of treason.
FEELING'S DO NOT CANCEL OUT THE BILL OF RIGHTS.
Thank you for the news.
Their fear might be a result of not knowing or communicating with anyone who might have a different perspective. That is worst than an echo chamber, that is an intellectual ghetto.
Leftists don't love the Constitution. They're constantly trying to chip away at the second and first ammendments.
Hawaii isn't real America tho.
Well put!!!
I remember going to Basic Training a few years back with a few guys from Hawaii. One of them fell in love with the M4A1. He'd never shot before. Just when we were finishing up training, he said he was going to buy himself an AR-15 when he returned home for Christmas.
Two other guys and I had to explain to him why that wouldn't happen. He wasn't aware of how strict his state was with gun control.
He was very pissed.
Update: I just found out that's no longer the case. I wasn't aware they allowed them as "long guns." However, the restrictions are still freaking harsh. You have to get a permit to purchase one, and it's only good for a year.
Guess its time for him to head to the 9th Island now
How can he not own an AR-15? There's no assault weapon bans or magazine restrictions except for handguns.
@seangilbert7365 I just looked at it, and I stand corrected. I wasn't aware they allowed "long guns", though looking at its restrictions, still freaking harsh.
He's welcome to move to a beautiful red state.
All gun control is unconstitutional and rooted in racism. Jim Crow era laws. Gun control ultimately violates the bruen decision as well as the 2nd Amendment. The beauty of the gun laws is that because of bruen they’re expanding like crazy. We just had Chevron Deference struck down. In a matter of years we are going to the ATF and NFA completely abolished in regards to guns. I’m hoping we see a reversal on the 86’ full auto ban. That way they can modernize systems like the Mac 10/11. A modern day 45 ACP Mac 10 is my dream backpack gun. Fun switch, whisper pickle, spare mags, pic rails, IR laser setup, Primary arms 2x prism scope…. That’s heaven for me.
They're following California's lead and expecting different results... There's a name for that...
AH JUST SAY IT: ‘INSANITY!’
Or tyranny
@FormerMPSGT yes but the result is exactly what they want
Communism
TREASON
What’s the point of the Supreme Court if they’re just going to ignore them?
A waste of time is a waste of tax payers dollars.
@SoftWareWolf91 Income taxes are illegal. How can the government waste something it did not legally acquire?
to give you the illusion of freedom, while they legislate new laws to delete them in real time
Federal Law Enforcement Agencies are *supposed* hold these political activists in contempt of court and arrest them, but until President Trump is sworn in, and Kash Patel is heading the FBI that won't happen.
It's procedural bullshit, it wasn't unexpected.
Aloha from Hawaii's 2A community 🤙and trust me, we need more challenges to our 2A laws.
2A is the only law we need to know when it comes to arms
2A is the only law when it comes to arms.
2A Is a right, not a law.
Take the case through the state courts first, before trying to go all the way to SCOTUS. That's why they refused to hear the case right now- so it could go through the proper channels
So the court renders people defenseless out of "love and kindness".
If a state violates the Constitution do they even get to vote anymore?
Hawaii's presidential votes have never come into play for the presidential election as far as I know.
There are countless penalties for the common citizen that violate these unconstitutional laws and like you said, no penalties for the politicians or government for violating our rights. There need to be penalties for those that are violating our rights.
We can always enforce the law ourselves.
Start voting responsibly comes to mind.
Insurrection
Hawaii politics is the reason I moved. Born and raised, lived there my whole life. Tired of getting my rights trampled on and dems saying its law "because i said so". Its turning into LA and Seattle with all the homelessness and druggies, because of the democrap policies.
Seattle actually has communists/socialists on their city council. The results speak for themselves.
an island of garbage in the Pacific, and I don't mean from overflowing landfills...
Justice delayed is Justice denied...
The Supreme Court's specialty.
As a long time Hawaii resident not by choice, thank you for highlighting our state. Apart from the fact that we are seen as America's number 1 tourism location, apart from that. we are just straight up forgotten by the mainland and its residents. They think that because we are so far away, that the 2nd Amendment can be forcibly suppressed in this state heavily. And they get away with it.
Sadly, islands are the easiest places to enforce arm bans as well. keep fighting!!
@@RoseNZieg So long as we are part of the Union, we will.
Id honestly love to live there. But the blue wall and unconstitutional laws just turn me off. Oklahoma right now.
Not just in that arena. I was shocked to learn over there it is illegal to modify a moped to exceed 30mph. That is just awful!
Insane.
A state can flip off the supreme court and the supreme court ignores it?
seems to be working for Illinois for some reason 🤯
"The Supreme Court has made their decision, now let them enforce it," -Andrew Jackson, slightly modified. The Supreme Court has no ability to force states to comply. They can't send the Marshals out to arrest everyone disobeying their rulings.
technically they aren't ignoring it, they are waiting for it to cook a bit more, they want to be able to see most of the case on paper instead of in front of them in the courtroom... it's still bullshit though
This is in the top three reasons my brother left Hawaii. Our home since 1982. It’s insane over there.
Never been there but when I finally had to leave California, the only things I miss are the weather and some friends.
No!!!!!! No FIREARM BANS!!!!!!
It's illegal due to constitutional law.
Gubmint no care
That sucks to hear the Supreme Court didn’t slap this one down !
From us pro-2nd Amendment locals, we thank you CN for covering this ridiculousness in our state!
Criminals who seek to harm decent people don't exactly possess love and kindness. Why do people not understand this? They are so naive.
They understand it full well. They just know there is no accountability for violation of their oaths. People used to be tarred and feathered and run out of town or hung in public back in the days. Not anymore and thats why we keep having these same topic discussions. 'Shall not means shall not'.
@@c_lo01Nowadays speaking common sense gets you treated as the villain and in turn ostracized and attacked.
Snowflakes.
Can we trade Hawaii for Poland, or as I like to call them " a little European Texas"

Trade Hawaii for the Philippines..I get to go and buy property for family there, and you guys get 100 million more firearm loving red blooded Catholics to bolster the conservative vote 😂
@@dchiznit209 This please!! our carry law sucks ass!
Banning the legal - empowers the criminal.
Don't forget the REAL spirit of Aloha...
(You receive the same as you give)
These warriors were some of the most feared of the native peoples of the Pacific Ocean... Just like the Maori from New Zealand.🤗
Fun fact, the Maori are *not* native to New Zealand, they only showed up on the island 2-3 centuries before Europeans, and promptly destroyed all the actual natives.
Love and kindness doesn't seem to work as good as some other things.
Love and kindness only works among people who are loving and kind. The firearms are in case we encounter someone who isn't loving and kind.
Gun rights ARE love and kindness.
Love of life
Protection is love ❤️
Damn right! 🙌🏻
Amen!!! … Biggest reason I want to leave , born and raised here and can’t stand our government here!
Spirit of aloha was a beautiful thing in most of my 45 years on this planet as a native Hawaiian. It referred to everyone's Hawaii style of kindness and hospitality, like in the South it's called southern hospitality. Every once in awhile you would hear someone say aloha is dying and I feel like all of our Hawaii politicians put the final nail in the coffin of aloha when they took the term and made it into a law purely to circumvent and undermined the second amendment. Aloha is not something that can be enforced, you either have it or you don't. Now something that was so beautiful to grow up with is now being scoffed at and laughed at with eye rolls. Even locals don't treat each other the same like they used to, everyone's grumpy nowadays. Colion noir I wish you could have experienced what it used to be. True Aloha🤙🏽
My hope is that SCOTUS is gonna settle this in another case once and for all.
We keep hoping and hoping, and they keep disappointing us
Wish in one hand and ...
There will never be a “once and for all”. We already have those, the 2nd Amendment, Heller, Bruen, etc. etc. etc. and these communists just keep ignoring and defying them.
And yet even then these states double down on their nonsense and pass more restrictive laws.
Their decision means nothing if the states can just keep passing a new law without consequences
A state should not be able to appeal a decision, only the citizen should be able to.
Maybe the politician’s security details can carry flowers and lollipops to stop crime.
Love and kindness is important, but not at the expense of self-defense.
States that ignore scotus rulings should have their Fed funding pulled. And SCOTUS should get off their asses and do thier dam job, same with congress only working 3 months of the dam year and becoming millionaires
They are trying to avoid setting a precedent.
Feeling does not convince the bad guy to lay down they're weapons.
The constitution of Hawaii guarantees and protects the right of the citizens to keep and bear arms ! People need to read their own states constitution !
As a Hawaii resident, I DESPISE the state government. They’re sucking our hard-earned money out of us for a monorail system no one wants. Voting them out is not enough anymore.
And the fact of how they responded to the Lahaina wildfire was horrendous. Hawai’i has been taken over by bureaucrats that have no clue of what they’re doing to the point that there is little to no Mālama and Aloha anymore.
If they no can or no care to protect the lives of Hawai’i’s people, why should we continue relying on others to assume responsibility on saving us? It’s time to save ourselves. We may have culture, but culture no reduce crime. Only influences it.
MONORAIL!
That is the problem you DON'T vote them out.
@@inJuStice808 They know what they are doing, they are lining their pockets at the expense of taxpayers. The voters don't know what *they* are doing as voters, by continuing to elect these criminals.
kicked out new York and California and Hawaii from Union for being anti second amendment
What is that going to solve 😂
What does it solve? They’ll lose federal funding and immediately beg for forgiveness
Maryland, don't forget MD.
@@Mr_Bones. You don't need to kick them out of the union to withhold federal funding...
Love & Kindness Does Not Protect From Evil & Darkness In Criminal Hearts & Minds.
Living in Hawai’i for more than 25 years , I can tell you , living Aloha, does not mean weakness !!!
The Hawaiian government for some reason keeps forgetting that they're a US STATE.
How is there no punishment for defying the Supreme court?!?!
That's the problem, there are no consequences for all these illegal laws and decisions.
Just another state I will never visit. My money ONLY goes to 2A friendly locations.
"Love and kindness" is always nonexistent in the political world.
It is not love and kindness to disarm innocent people. It is evil.
Actually, there is a law to jail government employees for the denial of rights, USC 242, the COLOR of law. Problem is, it is not enforced.
Right the same state that told you to wait for police while actively getting gunned down instead of retaliating... Insanity
rights > aloha
They don’t think they are a state. They think they are a separate country.
Maybe Hawaii can explain to us how love and kindness protect you from someone trying to NYC subway you.
Yes! After the Maui fire they got nothing but love and kindness from Joe B.
Preventing my neighbour from protecting her life, and that of her loved ones, is neither loving nor kind!
It is vicious and dastardly!
Rights vs privileges big difference
Feeling vs. Facts.
Text, history and tradition.
Drivers license is a privilege, gun ownership & carry is a right.
Thanks Colion yes we need to Stand strong being a Hawaiian Native we need to prtect our right blessings Brother 😊
What makes this amusing is that the native Hawaiian culture was a warrior culture with a huge inventory of clubs and spears. They were no stranger to death and carnage.
The SCOTUS has long been a source of continual frustration for not ruling against plainly unconstitutional laws, regulations, mandates etc....
Life, Liberty and the "PURSUIT" of happiness. We must continue to pursue ....
You make a great point. Under regular circumstances, people would vote these state legislators out of office for their overreach. However in states like the People's Republic of California and Hawaii the majority of people simply are willing to give up their rights in favor of state power.
Incorrect its the tyranny of LA & SF. The rest of the state hates this crap!
There is no love or kindness in being victims.
The Hawaiian government is afraid to let people carry, because they don't want the people to retaliate about Lahaina (sp?).
I like how "the spirit of aloha" worked well for the continuance of the Kingdom of Hawaii...
Craziness. Like you said, they know it takes time to strike these laws down.
I wonder if the criminals will switch over to love and kindness?
There is no love or kindness in a group using organized violence to take away your property.
Would "love & kindness" be preferred? Sure.
Is it at all realistic?
Absolutely NOT.
So, all the crime in that terrible state is just love and kindness?
To quote Spicoli from Fast Times at Ridgemont High, "Dude, that's really bogus"....
The Supreme Court’s job is to prevent government from ignoring every citizen’s constitutional rights. Do your job.
Hawaii will ignore SCOTUS until SCOTUS puts its foot down.
everyone will
I born and raised Maui and nowdays Hawaii becoming more crazy with violence, we definitely need the right to protect ourselves
This is why the Supreme Court needs to be forced to hear every case and rule in them within 90 days..
The citizens should ignore it too.
Good Evening from Central Illinois and thanks for the update. 🎄Merry Christmas 🎄
Thanks to Colion for providing the full story!
Love and Kindness do matter. That's why an armed society is a polite society.
I am quite surprised these people can find their way home at night.
About 25 years ago a Hawaiian deputy sheriff with a letter from his chief authorizing it, bought My S&W 5906 and paid about $60 FedEx overnight from TX back then, because he couldn't get one on the island.
Side note:
Remember, those who did not obey lived.
I carry with love and kindness every day. Pretty easy
For sure 😊
What says love and kindness more than being able to protect human life from those that wish to do evil?
This smacks of the Mexican President running on "Hugs not Bullets" regarding the Cartels and how Mexico basically fought and lost a War with the Cartels. They're still extremely violent...
Exactly 💯%!
What better way to keep the peace than to own and carry a peace maker!
It has worked just fine for me since 1980.
Do I get to sue if I pull a Love and Kindness card the criminals don't stop?
Any state court that defies the order of the Supreme Court should be disbanded and replaced with individuals who will do their job in accordance with the Constitution and the laws of the United States.
Yeah, you can't cure stupid
I lived there for three years. As a LEOSA card holder, I was still unable to conceal carry unless I had approval from the DA’s office, and had a medical and psychological evaluation (even though I had to do all of that to get my license). No wonder there’s so much violence there.
It's also against the law in Hawaii to laugh out loud in public.... You can only give a low ha
The incoming Administration needs to hold every state to account if they violate the rights of the citizens.

Here's the new law: "Any paid security details for either state public officials or celebrities in Hawaii are not authorized to go armed."
Can we all agree on this?

How can a state supreme court overrule the SCOTUS? The government has no authority to make any laws or regulations against arms per the Constitution of the United States.
