You get this a LOT in Small Business. "We won't pay your $4000 bill! Sue us!" Exactly. To successfully sue, you're looking at $10k in legal fees at least. Easier to just let it go.
the cops will get involved and it will be more expensive for Xavier to deal with being arrested and court fees and restitution than just coughing the money back up. plus, not sure what the amount is in NY but could be a felony due to the amount involved. not to mention potential wire fraud.

How convenient! I remember using a similar story when I didn't have enough money on my chequing account to cover my next rent cheque about a decade ago when things were really bad, so I had to extend the time.
I once was accused of stealing something I didn't take , It didn't give me a defensive reaction , what I said was "I can see how you would think that , if I was in your shoes I'd probably think the same thing. What happened , maybe I can figure it out." But I think the biggest tell is in the energy and the reaction. Getting upset and storming out is the classic "I'm guilty" escape route.
I usually give someone the benefit of doubt. But I think you should consider the first stages of prosecution (PI to send a registered letter, small case claims court registration, etc). Not in 30 days .... but within 48 hours. If he can’t string together (borrow/credit card/overdraft) a few hundred, as a token of good faith,.... he certainly won’t be too concerned in 30 days - when his rent/car payment/child support comes out of his account. Unless... he is in fact, a child (
Lots of excons get trained to do car repair. You got to be really careful about these people and their associates. I had one break into my car because he knew what was in my trunk. You know that guy Andrew Kissel from CT who had an exotic car and real estate business got murdered and it's still unsolved. Be very careful dealing with these street people.

I have had situations where after someone agrees to buy, doesn’t show or renegs, and it always amazes me just how many of these individuals either had a tornado drop on their heads, family members died....or they themselves were robbed. Unfortunately it’s examples like yours, these ‘situations’ that ruins it for everyone else who is legit.

WA was scammed for estimate of $500 million (no one knows how much for sure yet) in fake employment claims just recently since the virus. They sent unemployment money out of state, and out of country. Transferred to banks everywhere. I have earlder relatives that have been scammed. Have no mercy.

I had fraudulent charges went to local Sheriff Department made a report with the bank statements, took the case number back to the bank & funds were replaced that business day.
Actually the city police here are refusing to investigate breakins and stolen property, traffic accidents, etc. If no one has been injured, they won't be coming to investigate. One of those instances was family, another a former student I know. I'm guessing they won't do anything (assuming the story is true) unless a large amount of money got stolen.
There are plenty of situations where you need to report the crime right away, if you wait 30 days, the police may not want to take the case. Involve the police first, then wait for him to cough up the money.
