    This doesn't just affect van dwellers etc., It also affects Wild Campers in England and Wales, If you stray from a path and decide to settle down even for an hour or so you can be classed as a trespasser now, crazy, even If you are sitting on moorland in the middle of nowhere. I have to be honest I could see it coming for a good two years, especially in the Peak District, locals moaning about dog walkers, parking, vans stopping overnight, the list goes on. Yes there are a minority that ruin it for everyone but its been used as an excuse to take away genuine country loving peoples rights. Hence I spend my free time in Scotland now, no hassles and no stress, how long things remain good there though who knows?

    Over the years I’ve lived out of my vans for months at a time chasing the surf for two decades now. I’d find out of the way places and never left any trace I’d been, occasionally hang out with a buddy with his van. Now you mention the ‘Van Lifers’ in Cornwall…. There’s about 30 of them, sizeable rigs, taken over the entire car park on the headland at Little Fistral during peak holiday season. There’s open fires, bbqs on the road side. None of the locals can even park up there for a quick surf or bbq on the beach themselves. Saw the parliamentary act 77 notices on the vans last week. It’s not their place of residence, it is a public facility for everyone. I used to be able to park up there for a night every now and again for a dawn surf. Now I can’t even take my van to park at the beach in the mornings at Pentire headland as all vans get a ticket on the suspicion that it’s been parked overnight. That’s because the last bunch of ‘van lifers’ ruined it for the rest of us with washing lines, trash, party’s etc.
    If you’re a ‘van lifer’ don’t take the piss and ruin everyone else’s fun. Most of you will only live this for a year or two anyway, but for others like me it’s something I’d like to be able to do for the next couple of decades.

    As full time van lifers who free-camp every night, we would definitely appreciate being allowed to stay a night before moving on and finding another spot (especially if it's late).
    I think other full time van lifers must have seen this information also and gave them more understanding, and that's why you aren't seeing more videos about it maybe.

    Trespass as a civil law was always a joke. As a landowner, it's about time that the law is finally protecting the landowner's rights, for their own property. A minority of people thought they could do what they wanted and leave the landowner to deal with the aftermath, at the landowner's expense. This law could actually be a good thing, as councils and landowners can now allow use of their car parks etc for overnight parking stays (for a small fee no doubt). Knowing that moving any undesirables on, will be backed up by the law. There should no longer be a need to have height barriers etc, blocking parking entrances anymore. In my opinion, If people respect the landowner's rights, then there shouldn't be any major issues moving forward.

As a direct result, several rescue organisations had to carry letters signed by the relevant Chief Constable declaring that their need to exercise in case of needing to rescue others was essential. Identification as a rescue member was insufficient. I can see further problems in future for everyone

  • @Pabz2030
    @Pabz2030 2 года назад +22

    I can see both sides of this. The problem is People are often irresponsible morons without a thought for others.
    On the one hand there are plenty of people who just want to potter around in their van, unassumedly living "free" and seeing the countryside causing no bother to anyone and this is making it difficult for them for sure. On the other hand there are plenty of irresponsible idiots that think nothing of pulling up on someones land, setting up a noisy, smelly, camp, leaving litter and generally being nuisance neighbours, and causing people who OWN the land or live nearby to be severly inconvenienced. These people have brought this law change upon the entire van life community.
    Also its no different in Spain, where I live. Here you can stop overnight on public land outside of a designated campsite ONLY if you do not appear to be camping and ONLY if its one night. That means no tables and chairs outside your van, no BBQ no campfires etc, and definitely no littering. You absolutely CANNOT camp on private land - even an empty field in the middle of nowhere - unless the landowner has given you permission. Big fines for those that transgress and the Police Local often go along beaches etc ticketing everyone in sight.
    Here we also get the added "pleasure" of idiots who are on holiday "forgetting" that those of us who live here are not. And I live up in the mountains no where near the tourist areas and we still get all night partying holiday makers renting AirBnB's etc keeping us awake into the night when we have to get up for work the next day. Not fun.
    Not everyone is "living the life", and many have to do the usual 8-6 routine and having noisy temporary neighbours partying all night is not fun, whether they are in a B+B or a van.

    As a former police officer I applaud that you bring to the attention of others that this legislation has passed and is now enforceable, but comes with it great responsibility to qualify things so as not to cause undue panic or fear. Every law passed has a “spirit of the act”. That it to say, it has a clear purpose and is there to solve an identifiable problem. This piece of legalisation has the obvious intent to deal with travellers, who more frequently than not, will trespass on land and not confine themselves to the highway or public land. Firstly, all police officers will receive training on the new legislation and I know from friends who are serving officers, that the training is very much focused on who it was intended for - travellers. Everyone must understand that travellers are often in groups - and it is the group behaviour that leads to unwanted public nuisance. But, there will be unintended consequences. For van lifers in one van, who are not trespassing, the likelihood of coming into contact with the police will be slim. It will happen, but not to any significant amount. But, the legislation is untested and prosecution will only follow if you are asked to move and do not. Even then, a court will have to find someone guilty and that is where, in time, stated cases will emerge that more clearly define what level of evidence is needed to prove more of the obscure offences. There are full time van dwellers and there are people in camper vans travelling for the weekend who are wild camping. This act was not aimed at them. So, cooking a curry in a camper van by someone wild camping will not automatically qualify for a prosecution. What is more relevant - and something that has been in place for decades - is that should a “local” not like the fact you’re parked on public land cooking and they call the police, any police officer could have attended and simply asked you to move, regardless of whether they had any power to enforce it. And for the most part, people will! Anything for a quieter life. The only thing that people really need to know is what they intend to do if they are asked to move at any point. If you are going to obey the request, do so. Move. Simples. If you are not, are going to stand your ground, then ensure you video your interaction and be prepared to state your case in court. The NIMBY crew are in every village, town and city up and down the country. The only thing that has changed is potentially, if asked by the police to move, they may now have more substance to enforce a prosecution upon you if you refuse to do so. I have no doubts there will be those in the van dwelling community who will indeed refuse to move and it is from those we will learn what the courts actually think is enough to prove or disprove each of these offences. As an believer and advocate of van life, make no mistake - most van lifers live quiet, unobtrusive lives. Most weekend campers do the same. But not everyone does! The reality is, there are morons in every walk of life who spoil it for the rest. There are van lifers who leave mess behind. Watching a van life video at the weekend of a car park that the local authorities allowed people to sleep in their vans overnight - well, everyone had awnings out, tables, camping chairs - it wasn’t being treated like a car park, but a camp site. Well, no disrespect intended to anyone, is it any wonder why legislation like this gets passed!? Finally, you are entirely WRONG about how you describe these offences and the important points to prove. A NIMBY walking past your van, who doesn’t like what you are cooking, does not mean you have committed the offence. You have grossly oversimplified this. In time the courts will decide what amounts to a genuine annoyance and problem for the community. I have no doubts that will require multiple complaints and evidence from the officers attending about what was actually happening when they arrived i.e. it will require there to be real evidence of a real problem to the community caused by your presence. 10 travellers vans all parked up at the same spot - not difficult at all! You are innocent until proven guilty. If you are summonsed to court under this new legislation, it has to be PROVEN in court. It does not mean you are guilty whatsoever. I remember when the harassment act was passed - what a joke piece of legislation that was! Poorly worded. Full of flaws. And this one is no different. It will take substantially more than you think to get prosecutions through a court for those who plead not guilty should they actually be charged. And let’s be honest - for those who are going to be charged, they will have chosen to go down that path because if you simply move off if asked to do so, you will be just fine.

    • @Roadshome
      @Roadshome  2 года назад +1

      I agree I am saying how easy it can be to use the new laws, and you are also saying how difficult it will be to get a prosecution. There are 2 sides. But on closer research have found these people are groups of vanlife/party goers that have taken over a large area. I will be doing a follow up to my video. Thanks for your input 👍

      @@steveclark.. Because the leaders have chosen a new breed of officer to train - so the animal has changed and so too has the training. The district training centres have gone and they have broadly changed every aspect of training so they are robotic and cannot think for themselves. Literally. They cannot think for themselves. It is no wonder the public do not hold them in high regard. The most laughable thing I ever witnessed was my wife & daughter seeing a road rage incident involving a knife, which they recorded on their phone. 999 dialled. Reported. Nothing heard for a year. Suddenly they need a statement. Officer attends, watches the video, records the video on his mobile phone and promptly says to my wife she may need to attend an identification parade when she has the video on her phone in her possession clearly showing the individual involved. I took great pleasure in educating the moron on the rules of identification and how it would be impossible for an ID parade to go ahead. He was clueless. Welcome to modern policing !

    Firstly, thanks for the great video. If you've been driving for some time and pull up and "rest" to have a break then it's not going to that black and white in terms of getting fined. It's in the highway code that you must rest if your tired. I can see more and more camper vans proactively going stealth and trying not to draw any unnecessary attention. Motorhomes with all the graphics etc will be a red hot target for complaints and fines, but they can have a rest too from driving so it's going to be very difficult to enforce. I agree something needs to be done to tackle the mayhem and mess the travelling gypsies/ travellers leave behind (not all, but some have no respect for the land and local community). Also, we really need to get more Aires sorted in the UK with the massive growth of campervans / motor homes in the last 2 or 3 years.

    • @Roadshome
      @Roadshome  2 года назад +3

    This is to prevent you travelling and being independant. That's why the airports train services etc are in turmoil because its all part of a system being implimented to remove your rights to travel.
    And let's think about what other distractions the government have been using to do their naughties.
    The change of park up areas is to prevent people camping in areas such as national trust areas and areas of natural beauty. However those with money and power will have nice places to stay.

    I've just spent 2 months in Wales and England for the sole reason of using up non-Schengen days.
    First they change the law to stop me living in Europe so I have to go the the UK to the most unfriendly to van lifers in the whole of Europe and when I get there, they want to steal my home for trying to park somewhere for less than £20 a night. I hate politicians.
    At 75, could I just jack it in and add my name to the housing list. Maybe I could live in a 3 star hotel like refugees do? As a last resort, I could become a guest of HM and get 3 free meals a day and full medication for my heart problem, something I have difficulty with right now. At least I'd have a proper address C/O HMP.
    All I want to do is live in my van on my meagre pension and be a burden to no one but it seems the government are making new laws without thinking them through. Let's face it, who in the House of Lords goes camping, full time or otherwise?

    It's a very sad day when we need to protect ourselves with a CCTV system with audio recording, to prove you didn't drop litter (that was there when your arrived) and to protect yourself from false accusations from locals. The CCTV needs to cover 360 degrees around the van and record 24/7 with at least 7 days back up recordings. From what I can tell there is still a legal process the police have to follow but that legal process could take less than 24 hours to process before they turn up to take the vehicle away. So the safest thing to do it move ASAP when asked to. I know this is already being enforce because a single gypsy caravan that parked at the end of a dead end street overnight was moved on the following morning, within 15 minutes by the police without the gypsy's making a single argument. The moment the police turned up they started securing everything inside the caravan ready to move. Within 10 minutes a gypsy van turned up to move the caravan and five minutes later they were gone. I grew up in that street and the gated off football field was constantly being used as a gypsy camp sites by different groups. They always waited weeks until the eviction paperwork and court bailiffs turned up and kicked off before they went. Then left a huge mess. The whole system in the UK is set up to have people in the workforce. Schools are nothing more than a babysitting service so people go to work. That's why they are trying to stop homeschooling, with the new Education Bill. The same way they are trying to make everything cashless so you can't even live partially outside the system.

      @@Roadshome People with their eyes closed think I'm talking conspiracy theory. The facts is I literally had the school and the local educational authority tell me the government guidelines are children need to be at school so parents can go to work. I told them I was disabled and will never be able to return to work. Suddenly their attitude changed about my home schooling. I even had the same chat with the education department that enforces schools to provide additional help to individual children with extra needs and they confirmed that's the official government stance. It's not my first time homeschooling and my oldest has gone on to have a very high paid job in computer programming in the financial sector. My youngest is very bright but struggles badly with sensory overload. Fingers crossed the new education bill is ammended to allow homeschooling without the risk/threat of a criminal record and possible imprisonment for the parents.

    I don't think the law should be anything to worry about for most people in a van. Just respect the environment and area and be nice to anybody you see. If parking on private land then that's wrong anyway. Nobody should be littering or leaving rubbish on land they do not own. There are many laws which many of us break to a small degree, as long as police implement sensibly all will be fine. Some travellers really did need to be dealt with and unfortunately as with most laws, the good majority suffer for a minority who ruin it. A group of travellers at present are causing havoc in my local town with their dogs attacking other dogs and dog walkers, rubbish being left when leaving etc, this needed to be dealt with.

    Interesting development that will of course be abused. And of course, our self-appointed shepherds can't have the herd wandering off doing as they like.
    No idea how old I was when first encountering "trespass" but I only came up to my dad's knee so not very, maybe 3 or less. Walking on a public footpath over a farmer's field. Said farmer stood a few yards away with a shotgun over his arm and ordered my dad to walk around the field. My dad told him no, the footpath goes across the field which you shouldn't have ploughed. The farmer then cocked and aimed his gun at us, ordering again. My dad pushed me behind him and kept walking sideways to keep me covered, kicking the crop in the middle of the already worn footpath, it was that well used, as he went until the dick gave up and lowered his gun. Still have a bit of a gun phobia to this day.
    Next was just before NVQs came in and I was working at a training facility, first ever job, that was testing it's implementation. One of the courses we offered was general MAFF stuff as well as a couple of specifics and the trainer needed his lessons plan typed up and printed. No clue himself, older bloke who went like a rabbit in headlights just looking at a computer, but he was a nice guy so I did it for him. Learned a lot about trespass copy pasting all that.
    The last time, place I now live has a green over the road, few trees dotted and pretty big area of grass. Looked out to see half a dozen vans arriving during the day and people start camping. Weird, camp site round the corner but meh, they were quiet and not bothering anyone, unlike the idiot on the motorbike revving it at a million decibels 20x a day or the lesbian couple over the way who decide to have a screeching match with each other after midnight at least once a month, until they finally moved. Certainly not as bad as one neighbour in my building who would ring my bell in the wee small hours, despite my kids sleeping, asking for me to buzz her into the building because she forget her key, again. Thank god she moved eventually too. When the vans left, however, they also left a massive pile of rubbish where they stayed. Wouldn't mind but we have external bins round back they could have used. Never complained about any of the above though. If I complained about annoyances I'd do nothing but. I just get on with it and react only when someone gets in my face, all personal.
    Know who does complain? 'Karens' and assorted other perpetually indignant people who think they're better or more entitled than everyone else. Not that legit concerns never happen because it's the very same sort of people who spoil it for everyone else from the other end. Wish they'd all just eff off and leave the rest of us alone, maybe have a thought in their tiny minds now and then that doesn't revolve around themselves. Still, gives the cops something else easy to do aside from policing social media for words that hurt feefees cuz that exact same sort spend their time looking for virtual trouble when they aren't literally curtain twitching in self-induced outrage.
