- Shawn Bresnahan, a resident and local mechanic in Greenbrier, AR had his world turned upside down after taking his newly repaired car for a test drive. Due to a clerical error, Bresnahan had a suspended license at the time. Local cops were all-too-quick to take advantage of this by confronting and arresting Bresnahan in his own driveway. Not satisfied with publicly humiliating Bresnahan and placing him in handcuffs, the police also impounded Bresnahan's $30,000 vehicle, a decision which Bresnahan says has cost him dearly. Stephen Janis and Taya Graham of the Police Accountability Report investigate the case as an illustrative example of the lack of accountability in small town police departments.

10 years ago and further back, we didn't have cops like this here in Greenbrier. There was never this kind of BS here. The clerical error isn't uncommon here either. I had an unknown suspended license due to the clerk at the city hall not recording that I had paid my speeding ticket. Nowadays, they let speeders fly through town but stop someone for their opinion of "loud exhaust".
Cameras on cell phones were not common back then, but I bet police abuse was common.

I dont get the 7000$ what kind of lawyer did the family have that's death, in a lawsuit were theres is clear negligence on the the part of the Employer like Amazon you should see settlements in the millions, 7000$ would be a small down payment for lawyers fee just to take the case. Cases like this render a lot of questions, did the family accept a offer from amazon , did they even have a lawyer, did amazon send council to his home and say this is our offer take it or leave it. Family's that dont have money, live from paycheck to paycheck 7000$ is like hitting the million dollar lottery to them, they never seen those kinds of funds before. Amazon has attorneys that do nothing else but this, they look into your entire life, family, is he the only one working, whats the family income can they afford a lawyer ,many cant and just take whats offered. You can get a lawyer on a pro bono case like this for free because the outcome will be substantial , whats sad is this is a very common thing. The United States Supreme Court has ruled that people can resist an unlawful arrest
Yes but when was the last person reported doing that and did they live?
Resist is the wrong word. They will add a resisting arrest charge. Only a court can decide anything, if you get there later. You can win no arrest argument at the scene; and you would liklely incriminate yourself saying anything in a useless defense. Because a cop is not a judge or a jury,. A useless virtual deaf ear.
By the sounds of that cop he'll shoot you in a heart beat
Yes they can resist but by definition they have been arrested.... which means they have been taken down to the station or jail charged with resisting and booked.... there can be no resisting without an arrest.... also if it was unlawful then the arrest should not have happened and the charges would be dropped no matter what the Supreme Court says..... what needs to be done in my opinion is to hold the officers accountable for their actions without the protection they have afforded to them.... if I did something like that in my state I would be charged with kidnapping which I believe is or can be a life sentence
and survive?

How stupid that they'd tow his car despite having proper docs!
Thank the SCOTUS
it dont matter what docs he has. he has to go by what their system tells him. it tells him suspended. end of story
@@peterthegreat996: What did they supposedly do or say to mess up a situation like this?
@@johndonovan7018: Yes it _does_ matter, copper. We shouldn't have to be at the mercy of someone's incorrect information, at least when we can prove that we have the correct information, DUH.
anybody can print anything. there is no way to verify if its real or forgery. the only source that can be used during a live stop are the official databases. again, it is up to the court to inform the entities managing those of updates and changes. so sit a little and put on your thinking cap. @@HelloKittyFanMan

Thank goodness, I will never live in this country. This is sickening
Wait…..where is the victim?
When the cop decided to make contact, who/where was the victim that this man allegedly victimized? Or is there none…..?
It’s absolutely disgusting that our public servants pursue victimless crimes. Unless someone is harmed, unalived, or their property is stolen or damaged, there should never be gov intervention (especially cops).
Ironically, his property was stolen by the police.
Watching these videos I've got the impression that cops only detain you for one reason.to do whatever is necessary to make an arrest on a. real or imaginary crime
That, and to use the loophole that they can all questions all they want without any Miranda Rights.
same in russia
that cop needs to be fired 10 years ago
Wrongfully treated! Unbelievable wrong.
They need better hiring procedures to ensure you don't hire idiots. The cop's ego gets in the way. Talking to the police is mind-numbing. These cops are just worse than the criminals they arrest.
There's a psyc test that was given to cops in up state NY most failed, so there...
Seems to have vanished, about collusion and sanctioned stupidity , maybe something Utube refuses to hear . Guy smokes too much .
My dad was a MP and even he said "once the cuffs go on your are officially under arrest "
These are the kind of cops that do not have any business in this type of work
Being detained is being underrest!

Law Enforcement’s role is to monetize minor infractions that don’t harm anyone. To treat citizens harshly and vengefully if Law Enforcement feels the populous isn’t subservient to them. To profile and incarcerate especially the poor and/or minority communities to feed the prison industrial complex.
Thank you so much for your comment I think you stated the imperatives of the criminal justice system very well- taya
sorry to say this but driving with an expired tag, suspended drivers license and no insurance is not a "minor infraction" - a Judge will tell you this; an attorney will tell you this; police will tell you this. go drive with an expired tag, suspended drivers license and no insurance and see what happens. the reason why is not to "monetize" the legal system but to help protect the public from motorists who wreck their car, injure people and has no ability to cover the damages. irresponsible people who do this also drive drunk often killing themselves and others.
@@ericmartin2470who is the cop in your family, or is it you?

Yes the powers that be do monetize on financially depleted and minority populous. In other words, push the buttons that are easily pushed.
I wish someone would help people like this get lawyer's or a list that will help them. This is small town corruption.
Exactly right about challenging his authority is why he did what he did.
just tell the cops to get off your property unless they have a warrant?.. DUH!!!!!
They had the legal right to be there, they saw the guy driving onto the property from the roadways so they legally can do a traffic stop. I like where your heart is but its called "hot pursuit".
@@SnarkyMcSnarkles Nope it called trespass, illegal restraint , making threats, stealing property among other charges...

Miller v. Uinited States 357 U.S. 301 1958 “petitioner could not lawfully be arrested in his home by officers breaking in without first giving him notice of their authority and purpose, the arrest was unlawful, the evidence seized was inadmissible, and the conviction is reversed. “
“Since no express announcement was made, and since the evidence in this case was not sufficient to prove that petitioner knew the purpose of the arresting officers, the arrest was unlawful “
“1. A municipal ordinance that makes it unlawful to interrupt a police officer in the performance of his duty is substantially overbroad and therefore invalid on its face under the First Amendment.”
“...the ordinance in question is not limited to such expressions but broadly applies to speech that "in any manner . . . interrupt[s] any policeman" and thereby impermissibly infringes the constitutionally protected freedom of individuals verbally [482 U.S. 451, 452] “
“3. Although the preservation of liberty depends in part upon the maintenance of social order, the First Amendment requires that officers and municipalities respond with restraint in the face of verbal challenges to police action, since a certain amount of expressive disorder is inevitable in a society committed to individual freedom and must be protected if that freedom would survive.” Pp. 471-472.
Today's decision reflects the constitutional requirement that, in the face of verbal challenges to police action, officers and municipalities must respond with restraint. We are [482 U.S. 451, 472] mindful that the preservation of liberty depends in part upon the maintenance of social order. Cf. Terminiello v. Chicago, supra, at 37 (dissenting opinion). But the First Amendment recognizes, wisely we think, that a certain amount of expressive disorder not only is inevitable in a society committed to individual freedom, but must itself be protected if that freedom would survive. We therefore affirm the judgment of the Court of Appeals.

I am staggered at the arrogance of this officer and how the matter was escalated for no justifiable reason.
Acting as he did, this officer is likely to generate hate towards the police and diminish the help that might otherwise be provided to them. In short, he makes the job of policing less safe and more dangerous.
Love this community thank you for everything you do I wish I had the camera footage of my DUI I was sober for yet they destroyed all evidence i still don't have my license back after 2 years and it being changed to a wreckless driving even though i wasnt even driving its frustrating especially because i have a record now and its completely false.
These officers sure do get off on tangents and just keep it up. It used to be at every arrest they yell out “stop resisting” over and over for the body cam benefit. Now they have moved to impeding government operations. They just grab at anything that merely sounds like it is remotely feasible. What is the next phrase going to be?
Thank you for watching and commenting! That's a great question! So far it is "stop resisting" and "you are interfering" I am certain there will be a new phraseology added to the unofficial handbook soon-taya

That is what some of our founders intended, at least in principle. A people more armed or at least equal to and as organized and engaged in regards to their common defense and interests as the central government. The federal government was never supposed to be the all powerful and ubiquitous bureaucracy as it has become. It's made up of departments and interwoven appendages so numerous that they are not easily accounted for by the people they are supposed to serve, so the natural course is tyranny trickling down to all levels. Make no mistake, that is exactly what it is, a culture of trickle down tyranny, because we as Americans have lost all three of the points I listed above. Equality of arms, organization and engagement.
My vehicle was stolen over the summer. I had to pay over $400 to get it out of the impound lot. I felt like I was being fined like I had done something wrong even though I was the victim. I was lucky enough that I could afford the impound fee plus a tow because the fee goes up every day. Great system.
He needs to speak with Civil Rights Lawyer John H. Bryan....
the moment he said he had papers from the court should have been done
LEOs are that smart
We really need to talk about the systematic part of the injustice system. Even if a jury goes into that courtroom and finds the police officer guilty, the judge is the backstop for the police officer. Usually they always get the lower end of sentence and they're always given a second chance no matter to crime the victim or the circumstances.
same they do in russia .
Where do we start?
Every part of the system is rigged against the citizen.
We don't have a justice system.
We don't have a legal system.
We have a conviction syatem
This guy is a good man who didn't deserve this! Watching this video made my blood boil! I hope he gets some justice!
