Gcaleka's Phala Phala report opens can of worms

  • A showdown is looming in the courts between the office of the Public Protector and opposition political parties. This follows Acting Public Protector Kholeka Gcaleka finding that President Cyril Ramaphosa didn't violate the Executive Members' Ethics Code regarding the Phala Phala farm scandal. Wits School of Governance's Dr Kagiso Pooe says how the parties argue their case is key.

    Gcaleka has missed an opportunity to be criticized for what's right, and things would be much easier for her if she went the opposite direction, coz the panel had already pronounced something in that direction. That was going to pave a fair way in attaining the position of Public Protector!

      The office was stable and in full functioning order when mkwebane resumed. A lot happened during and thereafter. Hence we must look at the office as well while we judging the pp

      Madonsela would have arrive to this same conclusion, coz she had already defended Ramaphosa, saying there was no corruption in the Phala Phala! You people mustn't visit politics if like to comment on them, you must stick to them

      Is your comment an assumption or fiction? Did anyone give any evidence of instruction given to Rhoode to act the way he did? If no than Ramaphosa won't surely be guilty over someone else conduct definitely? Read the report again you would realize that Rhoode and the police conducted a covet investigation while they were not supposed to and they didn't counter the APP when they were given opportunity to oppose that position with the preliminary report, So your assumption doesn't seem hold factual ground somehow

      That's why the acting PP recommended for Rhoode and the other police officer to investigated because they were told to open the case and have the matter taken further, but it turns out that instead of them doing what they told to do, they went out and start to investigate the matter themselves, and it is on that basis that the Acting PP recommended that the police commisioner and the Minister of police should act against Rhoode for that specific conduct because he wasn't supposed to do that. So, next time, try to analyze issues with objective and open mind instead of being pre-conceptual and prejudicial. Gcaleka is not mad to make such serious recommendations against someone if she knows that might hang and tie herself legally in the process. I know some of are passive observers and pre-conceptually analyze this issue with political expedient mind set from that angle, but this beyond conventional politics, so one would be a cacophony if they interpret this matter through political lenses

      @@koolerkool8008 that a lie, the police boss is not the owner of Phala Phala, but the president is, therefore the president as the owner of Phala Phala is the one who was supposed open a case at a police station.

      You still don't get the point. There are two things you are missing here. First, the VIP protection service team of the presidency is hired to carry out specific tasks on behalf of the president that's why Wally Rhoode and his team are employed to do that job, if you want to claim that the president was supposed to bypass protocol to engage in things his is hired to do than you have limited understanding of how certain protocol works in line with powers and privileges given to a sitting President. That is your first weak leg of your argument. Secondly, Rhoode and the other officer conducted covet and unlawful interrogation of witnesses instead of opening the case, and you simply don't want to talk about that because it doesn't fit your narrative. Still, I say your judgment and observations are pre-conceptual and prejudicial because your reasoning doesn't have both factual legitimacy logical validity

    We are all of this because of DA, they join appeal of western cape high court on Busisiwe Mkhwebane to come back. And now DA want us to believe they are strong opposition fighting corruption, so DA put us in this mess .

      It's going to be a difficult journey for the opposition parties, because of the lack of evidence to support their allegations against the president. Until they have concrete evidence to prove otherwise that Acting PPSA was wrong

    Its clear that the public protector is covering up for Ramaphosa and her findings is not correct. Why has Ramaphosa been silent about the matter and not come forward with really happend ? Its clear that Ramaphosa is hiding something. Of course its much easier to blame somebody else for what has happened.

    I do agree with most of what the analyst said in this interview. However the challenge of proving factually and evidence as to whether Rhoode acted on instruction from the President or not will hard to proof especially if there's evidence to elevate that point. It is one thing to assume the proportion but it is another to show and present evidence to back up the claim. From my end the matter will be hotly contested on the legal interpretation of what constituted paid work to establish the breach of ethics code, the rest of the issues are low waters and lingering low hanging fruits to be swamped down the drain

      I haven't heard anyone pushing Fraser for answers as to where he got the whole dossier of Phala Phala documents from. Gcaleka points out that Fraser didn't disclose the source of his evidence, even if he is obliged by the law to do so? So, until this day, no one knows whether or not Arthur Fraser was given stolen information or whether he has secret intelligence service he is running privately somewhere to monitor and download information remotely and covetily, However what I can recover from the independent panel report is that former CJ Zandile Ngcobo raised some grave concerns about certain portions of Fraser's evidence as to how he obtain certain information he gave to authorities, so lets and wait see how things would unfolds in the future though 😉
