  • Case laws mentioned in the video:
    Anvar P.V. v. P.K. Basheer and others 2014: Honorable Supreme Court interpreted section 22A, 45A, 59, 65A, 65B held that secondary data in CD/DVD/PD are not admissible without a certificate under section 65B (4) and cannot be proved by oral evidence and opinion of expert under section 45A cannot be resorted to make such electronic data admissible.
    Abdul Rahman Kunji v. State of West Bengal 2014: Honorable High Court of Calcutta held that an email downloaded and printed from email account of the person can be proved by virtue of section 45B r/w section 88A.
    State of (NCT of Delhi) v. Navjot Sandhu alias Afsan Guru 2005: Secondary evidence of electronic records can be produced without certificate.
    Shafhi Mohammad v. The Sate of Himachal Pradesh 2017 Electronic records need to be certified by a person occupying a responsible official position for being admissible as evidence in any court proceedings.

    I have attached the Mobile Call recording to Gmail 2 years back, it has time and date also in gmail along with attachment . Same day I gave money to someone based on promissory note,
    Mobile is demaged and I throwed it,
    Gmail attached call recording can I submit as evidence to the court?

    Sir, यदि कंप्यूटर से किसी साक्ष्य का पेपर प्रिंट आउट लिया गया है और पुलिस के द्वारा उसको कोर्ट में चालान के साथ पेश भी किया जा चुका है परंतु पुलिस ने 65 बी साक्ष्य अधिनियम का प्रमाण पत्र नहीं लगाया है तो इस स्थिति में कोर्ट एविडेंस मान्य करेगी या नहीं please reply 🙏
